TOMMASO NATALE E CESARE BECCARIA
In: Rendiconti
ISSN: 1124-1667
Only few people continue to believe in the insular legend, which he himself spread, that Marquis Natale was alleged a foreunner of Cesare Beccaria. Disproved on a historical and textual level, that thesis is anyway secondary as compared to the huge gap between these two authors, both in terms of contents and of values.
FRIEDRICH SPEE E LA PRESUNZIONE D'INNOCENZA
In: Rendiconti
ISSN: 1124-1667
In his famous Cautio Criminalis, published for the first time in 1631, Jesuit Father Fiedrich Spee seems to have anticipated, a century and a half before the French Revolution , the idea of Presumption of Innocence. The Author deals with it below two profiles: with reference to the victim of trials based on illicit evidences and to the so called elision of the clues to be assessed for the application of torture. Father Spee will be reported as one of the most significant figures for the abolition of the torture.
CARLO CATTANEO E LA «SCIENZA PENITENZIARIA»
In: Rendiconti
ISSN: 1124-1667
The manifold genius of Carlo Cattaneo had the chance also to put his mind to the complex and antiquated regulation of the punishment in prison. In various circumstances, and moving from complementary perspectives, he aimed to highlight the need to put in place a virtuous circle of intersections between practical experimentation and theoretical elaboration, in order to give birth, through a multidisciplinary approach, to concrete and positive reform outcomes.

Waiting for the opportunity of reading the text of the sentence, many are still the points deserving explanation to begin with the connection with Voltaire.(**)

A proposito dei senatori nominati a vita
In: Il politico: rivista italiana di scienze politiche ; rivista quardrimestrale, Band 70, Heft 1, S. 165-175
ISSN: 0032-325X
The author returns, after a few years, to the theme of the nomination of life senators on the part of the president of the republic, in order to give an account of the recent applications of the relative norms &, in particular, of the paths leading to reform of those norms within the wider context of constitutional reform. The author also takes note of the recent "extra-institutional" phenomenon consisting in the fact of numerous "candidatures" being put forward informally &, conversely, the three nominations made by the current president Ciampi (2001/2004). The author concludes with some critical considerations concerning the utility of the institution of presidential nomination of life senators. Adapted from the source document.
