"This book examines deliberative democracy and its practical forms and applications in local government public policy. Author Joanna Podgórska-Rykała explores the topic of democracy, leaning in particular on the origins of its representative variant. Analyzing the elite dimension of the concept of representation, she considers what historical and political events have influenced the contemporary shape of democracy and its understanding. How were democratic ideals shaped, and why are we currently experiencing a democratic recession? Why is the debate that should be integral to the functioning of collegiate bodies disappearing? Why aren't decisions based on evidence, and why don't decision-makers take into account expert opinions and stakeholder positions? Drawing on empirical research - interviews with city-level decision-makers - the author considers whether and how deliberative innovation can support the renewal of decision-making in representative institutions. The growing crisis of representative democracy and associated citizen dissatisfaction has stimulated innovative thinking about democracy. Over the past two decades, a wide range of democratic innovations have emerged to increase the involvement of ordinary people in politics, combining direct mass participation with in-depth dialogue on pressing public policy issues. The innovations are rapidly spreading territorially, becoming increasingly institutionalised and tailored to specific political, cultural and social contexts. Mini-publics, which are forums for small-scale debate, are particularly remarkable. Faced with citizens' dissatisfaction with the practice of the public sphere, there are attempts to institutionalise one-off deliberative forums and make them part of a broader political system. This challenge was first taken up by the German-speaking community of Belgium (Ostelbelgien) and followed by other public authorities. Attempts to incorporate mini-publics into the decision-making space have also been made by local authorities – Paris, Newham and Aachen. In this article I argue that citizens' assemblies are the most advanced method of institutionalising deliberative democracy. I demonstrate that although the first citizen assemblies realised in the world were one-offs, following their example, particularly because of the success of the unique Ostelbelgien model, subsequent public authorities have begun to see this innovation as an opportunity to permanently (rather than just one-off) power democracy and make it more resilient to crises. I also show that local authorities can play a leading role in strengthening and institutionalising deliberative processes using mini-publics.

Celem artykułu jest ukazanie istoty samodzielności prawotwórczej jednostek samorządu terytorialnego, scharakteryzowanie poszczególnych form prawnych, które przybierają ich formalne decyzje, oraz wyodrębnienie i zdefiniowanie – posługując się dorobkiem doktryny i orzecznictwem – poszczególnych kategorii aktów tworzonych przez organy samorządowe. Zastosowana metoda badawcza oparta została na analizie prawnoporównawczej oraz badaniach literaturowych, ocenie stanu prawnego istniejącego w zakresie omawianej problematyki, a także na analizie poglądów prezentowanych w nauce prawa administracyjnego oraz w orzecznictwie. Autorka zwraca uwagę, że ustawodawca przyznał organom samorządu terytorialnego dużą samodzielność prawotwórczą. Jej źródeł można doszukać się w Konstytucji RP, a w następnej kolejności w samorządowych ustawach ustrojowych. Unormowania te są dodatkowo wzmocnione przez przepisy Europejskiej karty samorządu lokalnego, stanowiącej o prawie społeczności lokalnych do pełnej swobody działania na swoim terytorium z poszanowaniem zasady legalizmu. Przypisanie przymiotu samodzielności jednostkom samorządowym zostało utrwalone również w orzecznictwie Trybunału Konstytucyjnego. Z daleko idącą niezależnością samorządów mamy do czynienia w wielu dziedzinach ich działalności, jednak prawodawstwo wydaje się jedną z najistotniejszych. Akty prawne wyznaczają normy i reguły postepowania, gdyż wiążą określone grupy adresatów i wpływają na ich sytuację podmiotową: prawa i obowiązki.

The aim of the article is to show the origin and characteristics of the citizens' legislative initiative and the European legislative initiative through the prism of the concept of good governance, which postulates decision-making inclusiveness. The hypothesis assumed in the considerations indicates that the legislative initiative, as a general power at the national or European level, in its current form, is only a sham instrument for socialization of the law-making process in accordance with the concept of governance. Both institutions in question formally fit into this concept, but the analysis of their functioning in practice shows a contradiction with its essence. The content of the considerations consists of both theoretical and legal remarks as well as those related to practical implementation of the examined legal provisions.

The article is an attempt to characterize and analyze the institution of a civic initiative, by describing its idea, genesis and four legislative paths, the last of which was successful. Pursuant to the 2018 amendment to the local government laws, the right to initiate a legislative procedure may be exercised by residents of all Polish municipalities, poviats and voivodships on an equal basis. The considerations of the article focus on the formal following of the legislative path of the act, which is today the legal basis of the discussed institution, as well as the characteristics of the three previous - ineffective - drafts. The axis of the work is a discussion and dispute in the doctrine and among local government officials, among others, about the legitimacy of introducing this regulation and its final shape. The article uses methods characteristic for research on public policy as well as law and administration studies. The main tool is a comparative analysis of draft legal acts, and the auxiliary is a functional system analysis. During deliberations, the authors want to answer the question about the attitude of individual political circles to the legitimacy of regulating the resolution initiative in common law and to the manner and scope of the regulation itself. The question is also why, despite almost a decade of attempts to standardize individual solutions, it was possible to do it only in 2018?

Artykuł koncentruje się na poszukiwaniach odpowiedniego dla polskich realiów, konsensualnego modelu podobieństw, różnic, transferów praktyk oraz użyczania sieci współpracy w dialogu regionalnym. Rozważania te czynione są w ramach analizy dwóch zinstytucjonalizowanych odmian dialogu: społecznego i obywatelskiego na poziomie województwa. Elementy modelowej odpowiedzi na podejmowane przez autorów kwestie konstruuje się w odniesieniu do regionu małopolskiego, ponieważ wcześniejsze badania wykazały, że region ten posiada wyraźny potencjał sprzyjający rozwojowi instytucji dialogowych. Autorzy posługują się wskazanymi kategoriami, uwzględniając narzędzie, jakim jest publiczna deliberacja. Za teoretykami i praktykami uznają deliberację za jedną z najbardziej optymalnych dialogowych ścieżek (przed)decyzyjnych, które prowadzą ku skutecznym i akceptowalnym rozstrzygnięciom i umożliwiają optymalne, sprawiedliwe i przejrzyste publiczne zarządzanie zasobami środowiskowymi. Wychodzą w tekście z założenia, że wzajemne uczenie się nowych sposobów działania przez konkretne instytucje dialogu społecznego i obywatelskiego umożliwia korygowanie w przyszłości utrwalonych już elementów niedialogowych. Zakładają również, że w myśl koncepcji tzw. uczących się regionów, od jednego regionu są w stanie uczyć się dialogu inne województwa. Autorzy korzystają z metodologii nauk społecznych, a w szczególności sięgają do propozycji studiów z polityki publicznej, które uzupełniają elementami analizy formalno-instytucjonalnej: wykorzystują analizę porównawczą dialogu społecznego i obywatelskiego w polskich regionach, a także analizę prawną oraz studia przypadków.
This article focuses on searching for a consensual model of similarities, differences, transfers of practices, and lending networks in regional dialogue, which would be appropriate for Polish realities. These considerations are made within the framework of an analysis of two institutionalized varieties of dialogue: social and civil dialogue at the level of voivodship. Elements of a model answer to the issues addressed by the authors are constructed with reference to the Malopolska region, which was selected due to the results of nationwide research – conducted earlier by one of the authors – indicating that this region has a clear potential which favours the development of dialogue institutions. The authors use the categories indicated, taking into account the tool of public deliberation. Following theorists and practitioners, they consider deliberation as one of the most optimal dialogical (pre)decision-making paths, since it leads to effective and acceptable decisions and enables the optimal, fair and transparent public management of environmental resources. It is assumed that the mutual learning of new ways of doing things by specific institutions engaged in social and civil dialogue enables the correction of already established nondialogue elements in the future. It is also assumed that, according to the concept of so-called learning regions, other regions are able to learn dialogue from one region. The authors use the methodology of the social sciences, and in particular they reach for proposals of public policy studies, which they supplement with elements of formal and institutional analysis. Jego celem jest wskazanie głównych przesłanek reform wprowadzających bezpośrednio wybierane organy wykonawcze w samorządzie polskim i angielskim. Artykuł ukazuje także tło polityczne przeprowadzonych reform, ocenia najważniejsze zmiany, jakie nowe rozwiązania dotyczące organu wykonawczego wprowadziły do funkcjonowania lokalnej demokracji. Rozwiązania angielskie prezentowane są na tle rozwiązań wprowadzonych w Polsce, bliżej znanych polskiemu czytelnikowi.

The issues discussed in this article are clearly related to the COVID-19 pandemic and its negative impact on civic participation. In 2020, the pandemic and combined lockdown temporarily interrupted deliberation of budget processes in over a hundred Polish cities. However, not much has changed in the general landscape and in the shape of the topography of civic budgeting in Poland. It is still a difficult area for deliberation, although it is possible. The authors of the article have attempted to present the effects of those elements of the statutory regulation of civic budgets that are not conducive to the development of deliberation. The results of the analyzes were compared to the typology of participation in civic budgeting known in the literature, taking into account the cases of three Polish cities.
