Balcony in the Post-Soviet City: Private and Public in the Legal Perspective

The article deals with the balcony as a borderland between private and public everyday life of post-Soviet cities' inhabitants in the legal perspective. For finding out the differences between usual practices of balconies arrangement and current legislation, an analysis of numerous legal documents related to urban development activities was conducted. In particular, a number of important documents, such as valid state building regulations, the Instruction on the procedure for conducting a technical inventory of real estate objects, the Rules for the maintenance of residential buildings and adjoining territories, etc., were analyzed. Also, the research includes the results of processing media materials and the Unified State Register of court decisions. As a result of the study, it was found that current norms allow glazing of balconies and loggias if this is not related to the reconstruction of the dwelling, does not contradict the rules of fire safety, and does not interfere with insolation and ventilation. However, nowadays the legislation prohibits complex reconstruction of the house's façade with typical glazing of all summer premises. At the same time, after the reconstruction, residents of all apartments have the right to make glazing of their balcony or loggia. Along with that, such a practice only modulates chaotic glazing and in no way contributes to the safety and comfort of living in multi-apartment buildings. There are a lot of similar paradoxical legal situations in the everyday lives of Ukrainian townspeople. In addition, excessively restrictive norms do not contribute to the integrity of their observance, while some of the current rules are obsolete and impede the dynamic transformation of urban development. City dwellers have formed their own norms of the balconies' glazing and rebuilding. Such practices became possible due to the economic instability and weakness of state control bodies (in particular, through corruption schemes). As a result, every year Ukrainian cities look even more bizarre, while practices of parasitic architecture create a new cultural landscape of the Ukrainian urban environment. ; У статті розглядається балкон як пограничний простір між приватною і публічною сферами щоденного життя мешканців пострадянських міст. Задля означення того, наскільки реальні практики населення у сфері облаштування літніх приміщень різняться з унормованими чинним законодавством, було проведено аналіз численних юридичних документів, що стосуються містобудівної діяльності. Зокрема, було вивчено масив чинних державних будівельних норм, Інструкцію про порядок проведення технічної інвентаризації об'єктів нерухомого майна, Правила утримання жилих будинків та прибудинкових територій тощо. Також було додано результати опрацювання матеріалів ЗМІ та Єдиного державного реєстру судових рішень. У результаті дослідження виявлено, що чинні норми дозволяють склити балкони та лоджії, якщо це не пов'язано з перебудовою помешкання, не суперечить правилам пожежної безпеки та не перешкоджає доступу сонячного світла та повітря. Проте наразі законодавством заборонено комплексну реконструкцію фасаду будинку, що передбачає типове скління всіх літніх приміщень. При цьому опісля проведення реконструкції мешканець кожної квартири має право здійснити скління свого балкона чи лоджії. Така практика лише унормовує хаотичне скління і жодним чином не сприяє безпеці та комфорту мешканців багатоквартирних будинків. Подібних парадоксальних з юридичної точки зору ситуацій у повсякденному житті мешканців українських міст налічується немало. Переобтяженість суворими нормами не сприяє сумлінності їх дотримання, тоді як окремі з чинних правил морально застаріли і перешкоджають динамічному перетворенню міської забудови. До того ж на фоні економічної нестабільності та слабкості державних контролюючих органів сформувались узвичаєні способи обходу державних будівельних вимог (зокрема, за допомогою корупційних схем) задля оздоблення, скління і перебудування балконів на власний розсуд власників помешкань. У результаті з кожним роком українські міста виглядають ще химерніше, а практики паразитної архітектури творять новий культурний ландшафт українського урбаністичного середовища.

Architectural elements and everyday practices of interaction of citizens with them are an integral part of the image and space of the city. That is why the analysis of the balcony as a social item requires its consideration precisely as a phenomenon in the multitude of its interrelationships with the urban space and the exploration practices. The article presents the anthropological and sociological characteristics of the urban balcony culture not as an architectural component, but in the focus of the everyday functions of their use and re-exploration. The word "balcony" is chosen to denote various types of balcony-like spatial forms, including loggias, small attics, bay windows, etc., because the "classic" balcony in Ukrainian mass construction is the most common. There is an outlined range of reasons that make the residents of Ukrainian cities fix a rather recognizable, so-called «domestic» look behind their balconies, thus creating authentic signs of modern Ukrainian cities. Based on the experience we have learned, we have proposed solutions to such an urban planning problem as the re-exploration and glazing of open balconies in the form of two strategies — pressure and encouragement. The presented theoretical and applied study concerns primarily the post-Soviet Ukrainian balconies. The research is mainly based on Kyiv materials, but the described tendencies are typical for most Ukrainian cities, regardless of their size and geographic location. A note on terminology: this text uses the word «balcony» for all types of spatial forms (rooms), including loggias and small attics, bay windows, etc. We realize that there are differences between these architectural elements, however, for convenience, and also because of the fact that the so-called «original» balcony is the most common in Ukrainian mass development, so the word «balcony» is used there as a generalizing term.

Архітектурна логіка міської забудови завжди провокує появу кордонів у міському просторі. Ці кордони можуть бути як об'єктивними (географічними, адміністративними тощо), так і суб'єктивними (уявними, такими, що базуються на традиціях, соціальних нормах та повсякденних практиках). Утім для кожного містянина найважливіший кордон стосується межі між приватним і публічним простором, власним домом і зовнішнім світом. Ця межа не завжди є очевидною, адже існують численні способи взаємопроникнення цих двох територій. Однією зі стратегій, яка вправно долає усталені урбаністичні кордони, є паразитна архітектура. Так називають перехідні форми архітектури, пов'язані з розміщенням певних конструкцій на вже існуючих будівлях. У сучасному архітектурному дизайні паразитну архітектуру не таврують як негативне явище, навпаки, її розглядають у контексті посередництва між змінами в суспільстві та міською системою, адже формальне міське будування завжди провокує появу подальших адаптацій. У пострадянських країнах яскравим прикладом паразитної архітектури є розширені/перебудовані/засклені балкони. Ці архітектурні елементи стають способом перетворення публічного простору на приватний, експансії квартири назовні, на територію фасаду будинку. Перебудовані балкони давно перестали бути проявами маргінальності окремих жителів міст, перетворившись на потужну щоденну практику, яка стала традиційною і унормованою. Балкон – це передусім декларація приватності, яка є наслідком конкретних історичних передумов, а також віддзеркаленням економічного та політичного контекстів. Перебудований балкон – це претензія на більш гнучку архітектуру (тобто архітектуру з більш гнучкими кордонами), яка відповідатиме низовим потребам мешканців міст, а не задумам державних або приватних забудовників. У такий спосіб аналіз українських балконів в контексті актуальних трендів паразитної архітектури дасть змогу глибше зануритися в сучасне міське повсякдення, механізм творення суспільних норм та долання урбаністичних кордонів. ; The architectural logic of urban development always provokes the appearance of boundaries. These boundaries can be both objective (geographical, administrative, etc.) and subjective (imaginary, based on traditions, social norms, and everyday practices). However, for citizens, the most important border concerns the boundary between private and public space, between their 'home' and the outside world. This boundary is not always obvious because these two options interpenetrate in many ways. Parasitic architecture is one of the strategies that successfully overcome the established urban boundaries. It means transitional forms of architecture, which are associated with the placement of certain structures on existing buildings. Parasitic architecture is no more regarded as a negative phenomenon in the contemporary architectural design. Moreover, it is considered in the context of mediating between the changes in the society and the urban system, since formal urban construction always provokes the emergence of further adaptations. In the post-Soviet countries, the most impressive example of parasitic architecture is presented by the expanded/remodeled/glazed balconies. These architectural elements become a way of transforming public space into a private one. They make expansion of the apartment outwards, into the territory of the facade of the house. Remodeled balconies are not a manifestation of city outcasts anymore. They became a powerful daily practice, traditional and standardized. Balconies are primarily a declaration of privacy, but also, they are the result of a specific historical background, as well as a reflection of economic and political contexts. Remodeled balconies are a claim for a more flexible architecture (that is, a type of architecture with more flexible borders), which will meet the grassroots needs of city dwellers instead of the intentions of public or private developers. Thus, the analysis of Ukrainian balconies in line with the current trends in parasitic architecture will allow a deeper immersion in the modern urban everyday life and comprehension of the mechanism for creating social norms and overcoming urban boundaries.

The following conversation took place as an online round table organized by the Anthropology of Peace, Conflict, and Security research network of the European Association of Social Anthropologists on 14 March 2023. The aim of the round table was to create a space where Ukrainian anthropologists would reflect collectively on the anthropological approach to the invasion of Ukraine one year on. We asked them: What kinds of debates, narratives, imaginaries, and forms of activism have emerged under the invasion, and how have they shifted with time? How does an anthropological lens complicate some of the debates that have perhaps been posed in too simplistic terms? What is the view "from below" in Ukraine regarding life under the invasion, prospects for peace, solidarity, hope, and resistance? And last, but not least: how can we—anthropologists, non-Ukrainians—support them?
