El discurso político-jurídico finisecular se alimentaba, en el espacio iberoamericano y por ende en el argentino, de variadas matrices ideológicas, confiriéndole un carácter ecléctico.2 Por un lado, acompañando el proceso emancipatorio primero, y luego la organización de los estados nacionales, se puede observar la consolidación de una tópica adscripta al ideario liberal, de cariz secularizante en alguna de sus manifestaciones,3 que dominó el espacio cultural y político, traduciéndose en prácticas políticas y legislativas concretas.4 Por el otro, la persistencia de un pensamiento tradicional, alimentado por la matriz castellanaindiana y en la filosofía y teología escolástica, que si en ocasiones se enfrentó a aquella, en otras operó sutilmente, resignificándola.
Resumen: Este trabajo estudia la pervivencia de una interpretación jurisprudencial (en sentido amplio), que lejos de legitimar al código por su sanción legal, lo hace a partir del saber de los juristas. El examen se concentra en la codificación civil y el discurso civilista. Se analiza la proyección sobre el proceso codificatorio de distintas categorías que concibieron al código como un "cuerpo de doctrina oficial", sustentado en el saber jurisprudencial, verificando luego su gravitación durante su sanción legal. Se examina también la resignificación de aquel concepto, entendido luego como "derecho científico" a la luz de las ciencias sociales y de una nueva teoría del derecho receptada a principios del siglo XX a fin de determinar su impacto sobre la conceptualización de la acción legislativa y sus límites. Se concluye explicando el peso de estas cuestiones en el primer intento integral de reforma del código civil, concretizado en el Proyecto de 1936. ; Abstract: The essay studies the survival of a jurisprudential interpretation (in the broad sense), which, far from legitimizing the code by its legal sanction, it does it upon the knowledge of jurists. The review focuses on civil codification and "civilist" discourse. It analyzes the projection on the civil codification process of different categories that conceived the code as a "body of official doctrine", based on jurisprudential knowledge, to verify its gravitation during its legal sanction. It is also examined the re-signification of that concept, later understood as "scientific law" in the light of the social sciences and a new theory of law received at the beginning of the twentieth century to determine its impact on the conceptualization of legislative action and its limits. It concludes by explaining the weight of these issues in the first comprehensive attempt to reform the civil code, which was embodied in the 1936 Project.
Resumen: El presente trabajo aborda el debate parlamentario de las leyes 11.152 y 11.157, que intentaron brindar una solución legislativa al problema habitacional que en ese momento atravesaba nuestro país. La hipótesis de nuestra investigación plantea que lejos de buscar en las discusiones conceptos cerrados o rígidos, las referencias a nociones como código, derecho, propiedad, libertad de contratar, derecho extranjero, nos remiten a lugares de discusión desde donde se argumentan las disímiles posturas suscitadas frente a las medidas proyectadas. Creemos que una fuente privilegiada donde es posible rescatar las múltiples significaciones de nuestras instituciones jurídicas y sus trasfondos ideológicos, lo constituyen los debates parlamentarios. En efecto, se ha visto en los parlamentos, una «asamblea de los representantes de los principales puntos de vista en conflicto en la sociedad», conduciendo sus «deliberaciones y toma de sus decisiones en el marco del conflicto y la controversia sobre losmismos» y creando derecho «sobre la base de las convicciones y los votos explícitamente partidistas de sus miembros». En este contexto, el derecho ya no sería entidad abstracta y aséptica, lógica en sus consecuencias, sino más bien tópico, argumentación jurídica de un cierto posicionamiento ideológico, frente a las circunstancias fácticas de una determinada sociedad. Una arista peculiar de nuestro análisis es el derecho extranjero como tópico. Nuestra mirada, más que simplificar, intentará acercarse a la complejidad de los procesos de circulación de ideas jurídicas y seguimiento de modelos jurídicos europeos que gravitaron sobre las élites argentinas durante la primera mitad del siglo XX. ; Abstract: This article pretends to deal with the parliamentary discussion of the laws 11.152 and 11.157 that intended to bring a legislative solution to the habitual problem that Argentina was going through at that moment. The hypothesis of our investigation is that, far from trying to find closed or rigid concepts in those debates, the reference to notions such as code, right, property, freedom to hire, foreign law, takes us to areas of discussion from which different opinions on the measures taken can be formed. We think that a privileged source from which it is possible to rescue the multiple meanings of our juridical institutions and their ideological backgrounds are the parliamentary debates.Therefore, parliaments are seen as an »assembly of the representatives of the main points of view which are found in society«, taking their »deliberations and decisions to the frame of the conflict and the controversy on those views« and creating law »on the basis of convictions and votes explicitly partisan«. In this context, the law is no longer an abstract and neutral entity, logical in its consequences, but a topic, a juridical argumentation of a certain ideological position, dealing with the factual circumstances of a certain society. A particular aspect of this analysis is Foreign Law as a topic. Our point of view stresses that rather than seek to simplify, we should try to understand the complexity of the circulation processes of juridical ideas and the adoption of European juridical models that were in the mind of the Argentinian elites during the first half of the 20th century.
Resumen: A fines del siglo XIX y principios del XX la realidad científica argentina recibe la influencia de las nuevas orientaciones y perspectivas que traían la "ciencia social" o sociología, acompañadas también de un "enfoque nacional", que perseguía, la búsqueda, a través de ellas del "alma argentina", y que era el eco de la afirmación nacionalista que agitaba el mundo político e intelectual de la Argentina desde 1880. En el ámbito del derecho, el embate sociológico puso en crisis el método exegético poniendo en evidencia el "enorme abismo entre el fenómeno socio-jurídico y la ciencia del derecho". Es así que la mayoría de nuestros juristas se empeñaron en rastrear lo que "podía haber de propio en nuestra constitución o en nuestras leyes". Desde esta perspectiva, el objeto del presente trabajo es el análisis de aquellos discursos, que en el ámbito del derecho constitucional, se construyeron en torno a la identidad de nuestra constitución nacional, y que apartándose de aquéllos que la consideraban como una copia de la norteamericana, planteaban una interpretación de sus normas fundamentada, principalmente, en los factores y antecedentes nacionales. ; Abstract: At the end of the 19th century and the beginning of the 20th, the scientific Argentinean panorama receives the influence of new orientations and perspectives that were brought by the "Social Science" or Sociology, together with a "National point of view", which was seeking the search, through them, of an "Argentinean soul" and was the eco of a Nationalist affirmation that was influencing both the political and intellectual life of Argentina since 1880. In the sphere of the Law, the sociological influence brought a crisis in the exegetic method by putting into evidence "the huge abysm between the socio-juridical phenomena and the Law as a science". That is why most of our jurists insisted on tracking what "might be of our own in our Constitution or our laws". From this perspective, the object of this investigation is to analyse those speeches which, in the sphere of the Constitutional Law, were built up considering the identity of our National Constitution and moving away from those speeches that considered it as a copy of the American Constitution. They set out an interpretation of its rules, basing this interpretation, mainly, in the national facts and precedents.
Resumen: El artículo se propone analizar, en los dictámenes que Dalmacio Vélez Sarsfield produjo como asesor del Estado de Buenos Aires entre los años 1854 y 1857, las concepciones en torno a los derechos sobre la tierra, en especial aquellas referidas a las nociones de posesión y propiedad, y su articulación con la política modernizante del Estado de Buenos Aires. Lejos de encontrar construcciones dogmáticas definidas se advertirá la relación estrecha de estas con la problemática que acuciaba a la campaña bonaerense y que recibieron una esmerada atención de los historiadores que se han abocado a estos temas: el avance de la frontera y la distribución de las nuevas tierras ocupadas, la situación de los enfiteutas, la preservación de los campos de pan llevar, la instalación de las municipalidades y la formación de los ejidos, la actuación del Departamento Topográfico, entre otros. Para ello se estudiarán las argumentaciones de Vélez sobre el derecho romano, indiano y patrio y la reinterpretación de esta normativa a la luz de nuevas ideas propietarias liberales. Se advertirá que, como muchos juristas contemporáneos, Vélez no manifestó una posición rupturista de la tradición jurídica anterior, sino que conceptualizó un derecho de propiedad exclusivo que empalmó con aquella. ; Abstract: The article aims to analyze, in the opinions that Dalmacio Vélez Sarsfield produced as an advisor to the State of Buenos Aires between 1854 and 1857, the conceptions around the rights to land, especially those referring to the notions of possession and property, and its articulation with the modernizing policy of the State of Buenos Aires. Far from finding defined dogmatic constructions, it will be noted their close relationship with the problems that affected the Buenos Aires campaign and that they received careful attention from historians who have focused on these issues: the advance of the border and the distribution of the new ones occupied lands, the situation of the emphyteuts, the preservation of the pan llevar lands, the installation of municipalities and the formation of ejidos, the performance of the Topographic Department, among others. For this purpose, Vélez's arguments on Roman, Indian and national law and the reinterpretation of this regulation will be studied in the light of new liberal proprietary ideas. It will be noted that, like many contemporary jurists, Vélez did not manifest a rupturist position of the previous legal tradition, but rather that he conceptualized an exclusive property right that he linked with it.
The volume contains essays on the modernization of private law in Europe and Latin America from the viewpoint of legal history. Through a comparison between different forms of legal development in various normative und cultural contexts, the papers seek to open up new research perspectives on the concept of modernization in the field of private law.
Resumen: En el contexto de institucionalización del poder estatal en el partido de San Vicente, las fuentes relevadas en el Archivo de Cultura de San Vicente nos permiten plantear como hipótesis de trabajo que durante el siglo XIX las necesidades de la población del Departamento de San Vicente se fueron transformando de acuerdo con los cambios políticos e institucionales referidos al proceso de formación del Estado-Nación. Estos cambios han tenido un fuerte impacto, tanto en el plano simbólico, como en las materialidades que formaron parte de la vida política y cotidiana. No obstante ello, fueron los reclamos de los vecinos los que habilitaron la institucionalización de organizaciones político-jurídicas locales. De ello también se deriva que estos reclamos, asentados como "objetos" en fuentes administrativas de fines del siglo XIX, podrían ser entendidos como la aceptación y el reconocimiento institucional de las necesidades cotidianas locales, lo que desde nuestra perspectiva de estudio se transforma en un fondo documental preferencial para el acceso a una porción de las memorias y tradiciones de al menos un sector de la población de San Vicente, el de los llamados "vecinos", que complementa los registros arqueológicos y permite una mejor comprensión de ellos. A fin de aportar a la reflexión sobre los procesos de construcción de las estructuras de poder institucional en la campaña bonaerense, y en relación con este espacio de análisis, en este trabajo analizamos como objetivo principal, y específicamente, una porción de los reclamos asentados en las fuentes históricas de los Libros municipales de San Vicente del siglo XIX y principios del XX. Se trata de las necesidades vinculadas con los elementos y tipos de cercamientos de los terrenos. ; Abstract: In the context of the institutionalization of state power in the San Vicente party, the sources surveyed in the San Vicente Culture Archive allow us to propose as a working hypothesis that during the 19th century the needs of the population of the Department of San Vicente were transformed in accordance with the political and institutional changes referred to the process of formation of the Nation-State. These changes have had a strong impact, both on a symbolic level and on the materialities that were part of political and daily life. However, it was the claims of the neighbors that enabled the institutionali-zation of local political-legal organizations. It also follows that these claims, established as "objects" in administrative sources from the late nineteenth century, could be understood as the acceptance and institutional recognition of local daily needs, which from our perspective of study becomes a preferential documentary fund for access to a portion of the memories and traditions of at least one sector of the population of San Vicente, the so-called "neighbors", which complements the archaeological records and allows a better understanding of them. In order to contribute to the reflection on the processes of construction of institutional power structures in the Buenos Aires campaign, and in relation to this space of analysis, in this work we analyze as the main objective, and specifically, a portion of the claims established in the historical sources of the Municipal Books of San Vicente from the 19th and early 20th centuries. These are the needs related to the elements and types of enclosures of the land.
