The global financial crisis that began in 2007 was the most destructive since the 1930s. The rapid spread of the crisis across borders and the complexity of these cross-border linkages highlighted the importance for authorities of working together in responding to the crisis. This book examines the transnational response that relied heavily on a set of relatively informal transnational regulatory groupings that had been constructed over previous decades. During the crisis these arrangements were made stronger and more inclusive, but they remain very complex. Thousands of pages.

Building upon a wide range of literatures this book argues that international regulatory institutions become stronger when oligopolistic institutional arrangements decay and competitive pressures intensify. This is shown to be the case for global finance by careful studies of two inter-state institutions, the Basle Committee on Banking Supervision and the International Organization of Securities Commissions, and of the international banking and securities industries which they seek to regulate.

AbstractWhile the importance and key features of transnational benchmarking have received increased attention in recent years, the organisational contexts of this benchmarking have not yet been analysed systematically enough. Drawing on actor-network theory, this article identifies two key aspects of these contexts. The first is embeddedness, which refers to the degree to which there are networks that carry information and action from the benchmark to its contexts and back that are sustained institutionally, including by technical artefacts, objects, and routine local practices. Embeddedness is critical to the effectiveness of benchmarking. The second is publicness, which refers to the degree to which these networks exhibit expanding flows of information across widening circles of engagement, or instead are marked by control, domination, and exclusion. The article argues that benchmarking as a form of governance has an inherent impetus toward greater publicness, although this can be prevented by self-interested actors or problems associated with embeddedness. The article then explores the relevance of these conceptual points by examining cases of transnational benchmarking: disaster risk reduction and supply chain management.

AbstractThis article sets out the concept of a technical system and explores its ability to explain why some transnational regulatory domains are governed by a single transnational business governance (TBG) scheme, while in others there are many such schemes. By linking the numbers of TBG schemes that govern any particular transnational regulatory domain to technical systems in this way, important insights are provided into TBG interactions. Where technical systems are present, the TBG schemes that govern them will be specialized and complementary, rather than competitive. More generally, a technical systems approach illuminates the set of extended relationships that connect TBG schemes to the industry they seek to regulate. By tracing out these relationships we can reveal indirect interactions between TBG schemes that may be mediated through firms or market infrastructures. These indirect interactions can be obscured by approaches that only focus on the direct interactions among TBG schemes. The article analyzes two cases of TBG schemes in global finance. The first, derivatives, has a single overall TBG scheme. The second case, professional financial designations, has multiple competing TBG schemes.

Numerical indices and peer review processes, which are used increasingly to assess and rank countries, are relatively novel governance instruments. They have serious practical consequences and pose conceptual challenges for conventional international relations theories. This article draws on concepts from actor-network theory (ANT) to analyse the differences between these two mechanisms, their relationship to networks, their differing materialities, and how they succeed or fail. These concepts include actants, translation, enrolment, black-boxing, obligatory passage points, and immutable or mutable mobiles, which together provide useful insights into the way in which humans and objects work together in transnational networks to produce, alter, or resist power. The article argues that ANT can address some problems associated with the concept of governmentality, while complementing its strengths. Numerical indices and peer review processes engage with humans, objects, and networks in different ways and this can alter how larger global forces are or are not transmitted, modified, or resisted. A remarkable feature of the international policy response to the 2008 financial crisis has been the degree to which it has relied heavily upon existing transnational regulatory arrangements involving public and private actors. The article starts by accounting theoretically for the autonomy of such arrangements. It then examines the role played by these networks before and during the crisis, while also acknowledging the relevance of competing approaches that emphasize the power of states and private actors. Understanding the role of these arrangements in shaping the interactions among public and private actors is important both for the reform of the global financial architecture, and for our more general theoretical understanding of transformations in sovereignty.
