The purpose of the article is to determine the economic and legal aspects of the regulation of remote employment, to characterize the shortcomings of Ukrainian legislation in this area, to study the attitude of Polish to the development of remote work in the labor market.The introduction to the article highlights the reasons for the expansion of various non-traditional forms of employment in modern conditions, describes the main advantages and disadvantages of remote work and the need for economic and legal regulation of this area. The main part of the article considers scientific approaches to the analysis of current problems of remote employment, reveals the features of remote work, identifies its place in social and labor relations in the world labor market, identifies economic and legal aspects of online regulation, analyzes the Polish experience of using non-traditional forms of employment, a survey of the Polish adult population on the advantages and disadvantages of teleworking was performed.The study used methods of analysis and synthesis, questionnaires, comparisons.A comparative analysis of the economic and legal regulation of non-traditional forms of employment in Poland and Ukraine showed that there are significant shortcomings in the legislation of both countries. In particular, the Ukrainian legislation outlines only some aspects of remote employment. For more effective implementation of remote work, radical changes in labor legislation, both Ukrainian and Polish, are needed.A survey of the Polish adult population showed that in a global pandemic, teleworking is in demand and is beneficial for both employers and employees. It is concluded that the Polish experience of introducing remote forms of employment will be useful for the Ukrainian labor market.Key words: remote work, remote employment, organizational regulation, legal regulation, sociological survey, telework. ; Метою статті є визначити економіко-правові аспекти регулювання дистанційної зайнятості, охарактеризувати недоліки українського законодавства цієї сфери, вивчити ставлення поляків до розвитку дистанційної роботи на ринку праці. Було розглянуто наукові підходи до аналізу актуальних проблем дистанційної зайнятості, охарактеризовано основні переваги та недоліки використання нетрадиційних форм зайнятості населення, проведено опитування польського дорослого населення щодо переваг і недоліків онлайн роботи. У дослідженні використано методи аналізу та синтезу, анкетування, порівняння. Результати дослідження показали, що в умовах світової пандемії робота на відстані користуються попитом та є вигідною як для працедавців, так і для найманих працівників. Сформульовано висновок, що польський досвід впровадження дистанційних форм зайнятості буде корисним і для українського ринку праці.Ключові слова: віддалена робота, дистанційна зайнятість, організаційне регулювання, правове регулювання, соціологічне обстеження, телеробота.
A model is presented for developing creative entrepreneurial competences (CEC), which is focused on the formation of creative entrepreneurial and practical skills in a timely manner (Just-in-Time Learning). The proposed model assumes a high level of motivation, deep immersion, and full dedication of individuals and has a cyclical nature throughout their working life (Lifelong Education Cycle). The central figure of the model is an individual who, by choosing an active form of education and following a precise algorithm of actions, can obtain high performance and achieve entrepreneurial success. The formation of an individual's business consciousness is divided into five stages: UnConscious InCompetence, Conscious InCompetence, Conscious Competence, UnConscious Competence, and the second Conscious InCompetence stage. It is established that the minimum level of creative entrepreneurial competences consists of a combination of basic professional competences, elementary competences of IT&S literacy, and key communicative competences. Furthermore, it is found that an individual's professionalism will grow until the pace of their learning exceeds the pace of the external environment's dynamics. The pandemic caused by this virus, led not only to significant human losses worldwide, but also imposed significant restrictions on the socio-cultural life of the population and radically changed the trends of the global economy and the further functioning of socio-economic systems. Now, huge economic losses have been recorded, which affected almost all sectors of the national economy and the state in the short, medium and long term. However, it is important to consider individual economic development forecasts and measures developed by the governments of the world's leading countries to overcome the negative effects of the COVID-19 pandemic. This will allow to form a real vision of the possible course of economic processes that will directly affect the living standards of the population and the restoration of socio-economic systems.
