The study addresses the problem of to what extent and in what scope do the regulations concerning political parties, resulting from the Constitution of the Republic of Poland, determine the ordinary legislator? The analysis is made from the perspective of the triad of notions: freedom – duty – responsibility.

Celem opracowania jest podjęcie próby przedstawienia oraz oceny regulacji prawnych dotyczących postępowania z obywatelskim projektem ustawy w polskim porządku prawnym z perspektywy praktyki stosowania tej instytucji. Podejmowane zagadnienie ma nie tylko wymiar teoretyczny, ale również kluczowe znaczenie praktyczne, bowiem zainteresowanie tym mechanizmem prawnym wśród obywateli z każdym rokiem jest coraz większe i wpływa na kształt społeczeństwa obywatelskiego. Problem w tym, iż istnieje wiele barier, przepisów utrudniających obywatelom skuteczne korzystanie z przysługującego im konstytucyjnego prawa, począwszy od rejestracji komitetu aż po etap prac parlamentarnych nad projektem. Biorąc to pod uwagę w podsumowaniu zaproponowano kierunki zmian w zakresie obywatelskiej inicjatywy ustawodawczej.
The reform of the civil service is one of the crucial issues of the political transformation in Poland after 1989. Constructing of the appropriate system of values, principles and procedures aiming to fulfill State's duties through the operating numerous clerks still poses a number of problems for the legislator. Thereby, the authors are also making an attempt to evaluate the regulations concerning the civil service from the perspective of anticipation of new directions of further changes in order to guarantee them compliance with the Polish Constitution from 2 April 1997 and the assurance of the effectiveness of the civil service. ; Reforma służby cywilnej należy do istotnych zagadnień w procesie transformacji ustrojowych w Polsce po 1989 r. Skonstruowanie odpowiedniego systemu wartości, zasad i procedur służących realizacji zadań państwa przez działający w jego strukturach korpus urzędników nastręczało i w dalszym ciągu stwarza ustawodawcy wiele problemów. Dlatego autorzy niniejszego opracowania podjęli próbę oceny regulacji prawnych dotyczących służby cywilnej pod kątem wskazania kierunków dalszych zmian w celu zagwarantowania ich zgodności z Konstytucją RP z dnia 2 kwietnia 1997 r. oraz zapewnienia efektywności działania administracji publicznej.
The text concerns the legal basis of the CJEU judgment of 15 July 2021 in case C 791/19 1European Commission v. The Republic of Poland. In this judgment, the Court adjudicated regarding the EU compliance of the national regulations governing the system of the organs of judicial authority. Against this background, it is argued that the system of the organs of judicial authority in any EU Member State does not fall within the competence granted to the EU, but remains solely within the competence of the Member State. The CJEU is empowered to adjudicate only within the scope of competences conferred upon the EU. The CJEU is not competent to take over the competences of the organs of state power of Member States or to thereby force them to adopt particular legal solutions. Any action taken by the CJEU without a proper legal basis has but the appearance of adjudication. In the authors' opinion, the CJEU judgment raises many doubts as to its compliance with EU law.
We present the institution of a local referendum from a comparative perspective on the example of legal regulations in Ukraine and Poland. The study is the result of the ongoing research of the two Authors and is of crucial importance in the current political situation – the Russian aggression against Ukraine. Hence, it is relevant both nationally, Europe-wide and internationally. The analysis includes a legal comparative analysis of institutions and an attempt to assess their effectiveness. The authors point out that there is a need for effective 'safeguarding' in Ukraine to prevent the referendum from being used as a political instrument (at hoc), against the will of the people. The analysis uses a dogmatic and comparative legal method and draws on the authors' experience of holding local referendums. This research may be useful not only for the researchers of the local government law but also for the legislators.
