The subject of the research problem addressed in the article concerns the importance of institutional and legal (or, more broadly, political) factors of energy transition in the European Union. Following Aleh Cherp and his team, political factors are understood as state objectives, political interests and institutional capabilities and factors of other types. All of them, as a whole, enter into a relationship with other factors, such as socio-technical and techno-economic ones. Referring to F. W. Geels, the European Union can be defined as a kind of socio-technical regime (energy regime), responsive to internal or external threats or adverse events. The main purpose of the analysis is to present the relationship between the institutional and legal, socio-technical, and techno-economic factors. In order to specify the research problem, the research question has been posed of the extent to which institutional and legal factors affect energy transition in the European Union. To answer this question, the analysis relies on the theoretical aspects of energy transition studies, the institutional and legal approach and secondary statistical data.
Abstract The material scope of the research problem in the text encompasses selected issues concerning the content and sense of the elements characterizing the offense of establishing contact with a minor via ICT systems and telecommunications networks (also referred to as "grooming") under Polish criminal law. In the legislation currently in force the offense of grooming is criminalized under Art. 200a §1–2 of the Criminal Code. The main purpose of the analysis is to perform a substantive criminal examination of the offense of grooming under Polish law, taking into account a practical case study. The analysis contained in the text is chiefly an overview, and includes mainly an institutional and legal analysis performed with the aid of textual, functional and doctrinal interpretations, which have been supplemented with the author's own conclusions and opinions concerning de lege lata and de lege ferenda solutions. The institutional and legal analysis has been supplemented with an abstract case study of grooming. The presented abstract case study is helpful in considering selected legal problems, and ultimately in presenting example legal classifications of the described acts referred to as grooming.
Zakres przedmiotowy problemu badawczego prezentowanego w tekście obejmuje kwestie związane z istotą i sensem definicji legalnej przestępstwa o charakterze terrorystycznym w polskim prawie karnym. Polski ustawodawca zaimplementował definicję przestępstwa o charakterze terrorystycznym w ramach art. 115 § 20 Kodeksu karnego w 2014 roku, co wynikało z konieczności dostosowania polskiego prawa do regulacji Unii Europejskiej. Stosując metaforę uznać należy, że definicja ta stanowi swoisty rodzaj modyfikatora czynu zabronionego i zakresu odpowiedzialności karnej. Struktura definicji legalnej przestępstwa o charakterze terrorystycznym skalda się z dwóch elementów, będących zarazem przesłankami, które wypełnić ma sprawca. Pierwsza przesłanka ma charakter formalny, i dotyczy wysokości sankcji przypisanej głównemu czynowi sprawcy, z kolei druga przesłanka ma charakter motywacyjny, i dotyczy szczególnego rodzaju celu jaki przyświeca w działaniu sprawcy. Niewątpliwie instytucja przestępstwa o charakterze terrorystycznym w polskim prawie karnym pełni funkcje odstraszającą i represyjną w stosunku do sprawców tego typu przestępstw. W celu uszczegółowienia zakresu przedmiotowego podjętej analizy w tekście przedstawiono następujące pytania badawcze: (1) W jakim stopniu definicja legalna przestępstwa o charakterze terrorystycznym jest efektywna w polityce karnej w zakresie przeciwdziałania i zwalczania zjawiska terroryzmu?, (2) W jakim stopniu treść definicji legalnej przestępstwa o charakterze terrorystycznym może naruszać zasadę nullum crimen sine lege certa? Analiza zawarta w tekście ma głównie charakter poglądowy, w ramach, którego wykorzystano ujęcie instytucjonalno-prawne. W ramach tego ujęcia treść definicji legalnej przestępstwa o charakterze terrorystycznym poddano interpretacji tekstualnej, doktrynalnej i funkcjonalnej. W związku z rozbieżnościami wynikającymi z niejednoznaczności terminów użytych w tej definicji stosunkowo duży nacisk położono na interpretację językową.

The material scope of the research problem presented in the text encompasses the issues concerned with operational surveillance that the Polish civilian counter-intelligence service, i.e. the Internal Security Agency (in Polish abbreviated as ABW – Agencja Bezpieczeństwa Wewnętrznego), is authorised to. The main purpose of the analysis is to assess the changes introduced as a result of the passing of the so-called Surveillance Act in 2016. The Act was supposed to introduce new regulations with regard to the powers concerning operational surveillance and obtaining of ICT data, granted to particular secret and police services. The said changes were enforced by the judgment of the Constitutional Tribunal, which in 2014 found numerous violations of the provisions of the Constitutions of the Republic of Poland caused by the existing regulations authorising the services to engage in particular operational and investigative actions.
In order to elaborate the material scope of the research problem, and to present the conclusions, the following research questions have been presented in the text: Do the legal regulations concerning the powers vested in the Polish civilian counter-intelligence service within operational surveillance infringe individual rights and freedoms (e.g. the right to privacy, protection of personal information, privacy of correspondence), and if so, then to what extent?
Functional and pro-constitutional interpretations have been applied to assess the provisions regulating the powers of the Internal Security Agency with regard to operational surveillance and obtaining of ICT data. The functional interpretation focuses on the function of selected legal solutions, whereas the pro-constitutional interpretation focuses on the assessment of legal solutions in the context of the principles of a democratic state ruled by law, as well as human rights and freedoms. As regards the pro-constitutional interpretation, the tool used for assessment is the test of proportionality, i.e. the rule used for interpreting legal norms according to the degree and legitimacy of the interference in individual rights and freedoms.

In order to elaborate the material scope of the research problem and present the conclusions, the paper asks the following research questions: (1) To what extent are the de lege lata legal solutions in Poland effective in counteracting espionage offenses?, (2) What de lege ferenda solutions ought to be proposed to improve effective counteraction of espionage offenses? The paper includes an institutional and legal analysis aided by textual, functional, and historical interpretations, supplemented with the author's conclusions and opinions concerning de lege lata and de lege ferenda solutions. The institutional and legal analysis is supplemented with a case study of espionage activity. The case study helps consider selected legal problems and presents example legal classifications of the described acts associated with espionage activity. ; Zakres przedmiotowy problemu badawczego w tekście obejmuje wybrane kwestie dotyczące treści i znaczenia elementów charakteryzujących przestępstwo szpiegostwa w polskim prawie karnym. W obecnym stanie prawnym przestępstwo szpiegostwa kryminalizowane jest na gruncie art. 130 § 1–4 Kodeksu karnego. Głównym celem podjętej analizy jest dokonanie karnomaterialnej analizy przestępstwa szpiegostwa w polskim prawie z uwzględnieniem praktycznego studium przypadku, a także oceny rozwiązań prawnych ze względu na bezpieczeństwo państwa. W celu uszczegółowienia zakresu przedmiotowego problemu badawczego i prezentacji wniosków w tekście przedstawiono następujące pytania badawcze: (1) W jakim zakresie rozwiązania prawne de lege lata w Polsce są efektywne w zwalczaniu przestępstw szpiegostwa?, (2) Jakie rozwiązania prawne de lege ferenda należy zaproponować w celu zwiększenia efektywności zwalczania przestępstw szpiegostwa? Analiza zawarta w tekście ma charakter poglądowy, w ramach niej wykorzystano głównie analizę instytucjonalno-prawną za pomocą interpretacji tekstualnej, funkcjonalnej i historycznej, które uzupełnione zostały własnymi wnioskami i opiniami dotyczącymi rozwiązań prawnych de lege lata i de lege ferenda. Analiza instytucjonalno-prawna uzupełniona została o abstrakcyjne studium przypadku czynności szpiegowskich. Zaprezentowane abstrakcyjne studium przypadku pomocne jest do prowadzenia rozważań nad wybranymi problemami prawnymi i w końcowym efekcie prezentacji przykładowych kwalifikacji prawnych opisanych w nim czynów związanych z działalnością szpiegowską.
The objective scope of the analysis encompasses special measures used in the fight against terrorism in the context of ethical and constitutional principles attributed to a democratic state ruled by law and a liberal democracy. A practical example of a special measure used in the fight against terrorism, and presented in the text, is furnished by the content of one of the articles in the Polish Aviation Law, which was found unconstitutional in 2008. The content of this article made it possible for an administrative authority to make a decision with regard to consenting to the destruction of a civil aircraft, if it was used as a means of terrorist attack. The main purpose of the paper is to consider the acceptable scope of radical measures in the fight against terrorism, while taking into account the reinterpretation of priorities in the hierarchy of legal principles. In order to elaborate the objective scope of the analysis, the following research question is phrased: To what extent is it possible to sacrifice the well-being of the individual (dignity, rights and freedoms) for the sake of the common good (security)? The adopted analysis methodology is based on a thought experiment consisting in the reinterpretation of ethical principles and the values of the constitutional norms in a democratic state ruled by law and a liberal democracy. With the benefit of essentialist reduction, it is posited that the two competing constitutional principles are the principle of dignity and the principle of the common good; they can be reduced to, for instance, protection of the life of an individual or of members of the community as a whole. Abstrakt Zakres przedmiotowy analizy obejmuje zagadnienie szczególnych środków walki z terroryzmem w kontekście zasad etycznych i konstytucyjnych przypisanych demokratycznemu państwu prawa i demokracji liberalnej. Przykładem praktycznym szczególnego środka walki z terroryzmem zaprezentowanym w tekście jest treść jednego z artykułów polskiego Prawa lotniczego, który został uznany za niekonstytucyjny w 2008 roku. Treść artykułu dawała możliwość podjęcia decyzji przez organ administracji publicznej w zakresie wyrażenia zgody zniszczenia cywilnego statku powietrznego w sytuacji, gdy ten użyty jest jako środek ataku terrorystycznego. Głównym celem pracy jest rozważanie zakresu dopuszczalności stosowania radykalnych środków walki z terroryzmem przy uwzględnieniu reinterpretacji priorytetów w hierarchii zasad prawnych. W celu uszczegółowienia zakresu przedmiotowego analizy zaprezentowano następujące pytanie badawcze: W jakim zakresie możliwe jest poświęcenie dobra jednostki (godności, praw i wolności) na rzecz dobra wspólnego (bezpieczeństwa)? Metoda analizy opiera się na eksperymencie myślowym polegającym na reinterpretacji zasad etycznych i wartości norm konstytucyjnych w demokratycznym państwie prawa i demokracji liberalnej. Przyjęto za pomocą redukcji esencjonalnej, że dwie rywalizujące ze sobą zasady konstytucyjne, to zasada godności i zasada dobra wspólnego, które mogą być sprowadzone np. do ochrony życia jednostki lub członków wspólnoty jako całości.

The geopolitical conditions should be understood as a variety of relations between geographical conditions and decision-making processes concerned with energy security. The main objective of the text is to present a selection of theoretical problems encountered in the study of energy security, as well as to link them with such issues as gas import dependence and the risk of gas supply disruptions, mainly from the Russian direction. In order to elaborate the objective scope of analysis, the following research questions are presented: (1) To what extent do geographical conditions determine decision-making processes in the energy policy pursued by the European Union?; and (2) To what extent do geographical conditions determine threats to the security of gas supplies to the European Union and its member states? The text is chiefly an overview, but the theoretical part loosely makes use of the premises of the research program concerned with the integration of knowledge as part of the studies of energy security and energy transitions, presented by E. Brutschina, A. Cherp, J. Jewell, B. K. Sovacool and V. Vinichenka. Additionally, knowledge contained in the literature on energy and gas security has been synthesized and enriched with a critical approach, and the author's own assessments and conclusions.
