The financial crisis posed new challenges for the administrations of Eurozone countries, including: how to respect EU obligations when the economy is under stress? How to improve the overall implementation of EU policies and domestic reforms? How to negotiate effectively with the Troika and then quickly and efficiently fulfil the requirements of the Memoranda of Understanding? This volume offers the first analysis of EU coordination by national executives in the light of the legal and political consequences of the crisis, using case studies of five severely affected Member States: Cyprus, Greece, Ireland, Italy, and Portugal. It examines from an interdisciplinary perspective how they have adapted their coordination systems since the outbreak of the crisis, shedding light on the adjustments undertaken by domestic administrations. The comparison reveals that in this process Prime Ministers and Ministers of Finance were empowered in a common shift towards the centralization of EU coordination.

This paper examines the issue of life-work balance for working mothers in light of recent data proving that the burden has been disproportionate during the COVID-19 pandemic with respect to fathers. It starts describing the constitutional foundation of the special protection recognized to this category according to Article 37 of the constitution, inserted in a comparative framework. After a critical analysis of the evolution of both case law and legislation concerning the role of both parents in the care of kids and the progressive emergence of the interest of the child as core-value in this field, the author goes back to the current situation and draws conclusions on recent developments.

This contribution addresses, from a comparative perspective, the topic of inter-ministerial coordination of European policies, adopting a polythetic classification based on a plurality of parameters, including the location of the mechanisms for coordination, as well as the establishment of a specific Ministry for European affairs. The taxonomy is explained through the use of a straight line, on which different points correspond to each "pure" model, while on the segments the author places the real systems adopted throughout the Member States. The article also tests the theories elaborated by political scientists on the evolution of coordination systems, checking their (partial) transposition into legal sources. Recalling the essential results of the stress test that occurred with the economic crisis on the performance of national administrations, with particular reference to their resilience, the text lays the foundations for an assessment of the coordination of European policies in the management of the COVID-19 pandemic. ; Il contributo affronta, in prospettiva comparata, il tema del coordinamento interministeriale delle politiche europee, adottando una classificazione politetica basata su una pluralità di parametri, tra cui la collocazione delle sedi di coordinamento e l'istituzione di un Ministero specifico per gli affari europei. La tassonomia viene spiegata attraverso l'utilizzo di una retta, su cui vengono individuati punti corrispondenti a ciascun modello "puro", mentre sui segmenti l'autrice colloca i sistemi reali adottati nei diversi Stati membri. L'articolo testa, inoltre, la tenuta delle teorie politologiche sull'evoluzione dei sistemi di coordinamento, verificando la loro (parziale) trasposizione giuridica. Riprendendo i risultati essenziali dello stress test verificatosi con la crisi economica per la performance delle amministrazioni nazionali, con particolare riferimento alla resilienza delle stesse, il testo pone le basi per una valutazione del coordinamento delle politiche europee nella gestione della crisi della pandemia da COVID-19.

A finales de 2016 el Tribunal Constitucional federal alemán tuvo que decidir un recurso individual que reivindicaba, para los ciudadanos de Baviera, la posibilidad de un referéndum independentista. Este artículo analiza la decisión del Tribunal, contextualizándola a la luz de la jurisprudencia previa, del contexto político y de la doctrina. Finalmente, propone unas reflexiones críticas en perspectiva comparada.At the end of 2016, the German Federal Constitutional Court issued a decision concerning an individual appeal claiming the possibility of an independentist referendum for the Bavarian population. This article analyzes the Court's decision, contextualizing it in the light of previous jurisprudence, political context and scholarship. Finally, it offers critical reflections from a comparative perspective.

<p>El estudio analiza los sistemas de coordinación de las políticas europeas adoptados en los Estados fundadores de la UE. Teniendo en cuenta la evolución normativa, la autora propone una clasificación cua-tripartita, basada en la aplicación combinada de distintos elementos determinantes: la existencia o inexistencia de un Ministro para los Asuntos Europeos; la existencia o inexistencia de un órgano de coordinación interministerial específico y su colocación en la Presidencia del Gobierno o en el Ministerio de Asuntos Exteriores. Los resultados del análisis comparado son finalmente cotejados con los de otros estudios anteriores y en las conclusiones se enfoca el tema desde la óptica de la circulación de modelos</p>

This essay deals with the implications of the judicial review related to Constitutional amendments, through the selection of some representative cases. It focuses on the case-law of the legal systems chosen where Constitutional or Supreme Courts asserted being enabled to verify the effectiveness of limits against possible misuses by political actors. Those Courts used different arguments to demonstrate that the control of amendments is an unavoidable consecuence of the Constitutional supremacy and all of them are analyzed in the text. ; Este estudio investiga el alcance del papel de la jurisdicción constitucional relativa a las reformas, mediante el análisis de algunos casos representativos. Se centra en las decisiones tomadas en los ordenamientos seleccionados, donde los Tribunales Constitucionales —o Supremos, en su caso— han reivindicado la función de supervisores de la efectividad de los límites, frente a posibles excesos de los actores políticos.
