¿Cómo puede explicarse que algunas circunscripciones subnacionales tengan mayor fragmentación de su sistema de partidos respecto a otras? De acuerdo a la literatura especializada, la variación en la fragmentación se explica por las instituciones electorales o la diversidad social; no obstante, estas explicaciones no son suficientes cuando se observa a los municipios mexicanos en los últimos 25 años. La propuesta teórica de esta investigación plantea que, además de factores institucionales y sociológicos, la fragmentación de sistemas de partidos subnacionales, se explica por el cálculo que hacen los dirigentes partidistas respecto al beneficio esperado de gobernar una circunscripción subnacional y la expectativa de ganar la elección. Considerando una base de datos inédita de tipo panel -creada por el autor para esta investigación- con elecciones municipales desde la década de 1990, y empleando una regresión múltiple con efectos fijos, la evidencia empírica es consistente con la hipótesis principal: existe una relación no lineal en forma de U invertida entre el presupuesto de egresos y el NEP municipal, de forma que los municipios más fragmentados son aquellos con valores intermedios de recursos. Los resultados son consistentes en dos pruebas adicionales: un diseño cuasi-experimental con Pueblos Mágicos y tres estudios de caso a profundidad. ; How can it be explained that some subnational constituency have greater fragmentation of their party system compared to others? According to the specialized literature, the variation in fragmentation is explained by the electoral institutions or social diversity; however, these explanations are not enough when looking at Mexican municipalities in the last 25 years. The theoretical proposal of this research proposes that, in addition to institutional and sociological factors, the fragmentation of subnational party systems is explained by the calculation made by partisan leaders regarding the expected benefit of governing a subnational constituency and the expectation of winning the election. Considering an unpublished panel-type database -created by the author for this research- with municipal elections since the 1990´s, and employing a multiple regression with fixed effects, the empirical evidence is consistent with the main hypothesis: there is a non-linear relationship in the form of an inverted U between the budget of expenditures and the municipal NEP, so that the most fragmented municipalities are those with intermediate resources values. The results are consistent in two additional tests: a quasi-experimental design with Pueblos Mágicos and three case studies.

Esta investigación aporta una teoría para explicar la intervención política de la Iglesia católica en el ámbito electoral y en el poder Legislativo, cubriendo un vacío en la literatura sobre el tema. Se propone que la normatividad electoral determina la estrategia empleada por la Iglesia católica para influir en la intención de voto, y que a mayor capacidad de movilización de grupos católicos y a mayor presencia de autoridades católicas hay mayor capacidad de influencia de la Iglesia católica en el poder Legislativo. Un estudio comparado de "casos más similares" en Colima y Guanajuato da como resultado, para estos casos, que la normatividad electoral alienta/restringe la participación de la Iglesia católica en la opinión pública, y es irrelevante en la movilización de grupos católicos, pues independientemente de la normatividad se busca movilizarlos; una mayor capacidad de movilización de grupos católicos resulta necesaria, pero no suficiente, para que la Iglesia católica influya en el poder Legislativo, sugiriendo que deberían considerarse la tradición del catolicismo y la presencia de grupos opositores; y la presencia de autoridades católicas no impacta en una mayor influencia de la Iglesia católica en el poder Legislativo, proponiendo que debería considerarse el perfil de arzobispos y obispos.

México está en medio de una actividad de rompimiento de un paradigma, aún no termina en plenitud de dejar atrás un sistema de enjuiciamiento penal y está intentando instaurar uno nuevo; sin embargo al respecto, no todo es simplemente procedimiento, no debemos olvidar que estas decisiones legislativas llevan de por medio también reflexiones que tienen que ver con las políticas públicas en materia de criminalidad, al respecto, el presente estudio pretende desde esa perspectiva analizar críticamente la transición rumbo al nuevo paradigma de justicia penal.
