L'Allemagne a traversé la crise sanitaire avec peu de restrictions. Le gouvernement a rapidement mis en place des mesures d'aide économique. Même si leur exécution a parfois été lente, elles ont contribué, avec la négociation collective, à sauvegarder l'emploi, la compétitivité des entreprises et le niveau de vie de la population, notamment grâce à la subvention massive de l'activité partielle. Elles se sont toutefois révélées insuffisantes pour combler les disparités sociales aggravées par la crise sanitaire.

La dynamique des accords d'entreprise transnationale a atteint son sommet en 2008. Depuis, on observe une stagnation des accords internationaux et un essoufflement des accords européens. L'article analyse les facteurs déterminants de ces dynamiques sur les entreprises françaises et allemandes, en partant des stratégies et pratiques des acteurs. Il révèle le rôle des procédures de mandatement adoptées par les fédérations syndicales européennes et internationales.

Le congrès de Vienne de la Confédération européenne des syndicats (CES) a été marqué par un esprit unitaire. Les documents programmatiques adoptés se situent dans la prolongation des congrès précédents et manifestent la difficile recherche de consensus sur des sujets controversés comme le salaire minimum ou l'intervention publique pour consolider la négociation collective de branche. Pour la première fois, le congrès n'a pas seulement élu un secrétariat, plus restreint, mais aussi un « présidium » collectif doté d'un rôle politique plus actif pour donner la priorité à l'action et pour rapprocher la CES de ses affiliés nationaux.

Frankreich ist eines von 18 EU-Ländern mit Mitbestimmung im Aufsichts- bzw. Verwaltungsrat. Seit 2013 ist sie auch im Privatsektor für Unternehmen mit mehr als 1.000 Beschäftigten in Frankreich bzw. 5.000 weltweit obligatorisch. In den letzten Jahren hat sich die wissenschaftliche, gewerkschaftliche und politische Debatte in Frankreich zum Thema Mitbestimmung spürbar intensiviert. Selbst Präsident Macron hatte im Wahlkampf eine Ausweitung der Mitbestimmung versprochen. Umgesetzt wurde dies bisher aber nur sehr begrenzt. Die sozialistische Fraktion hat einen Gesetzesvorschlag eingebracht, der u.a. ab 5.000 Arbeitnehmer/innen eine paritätische Mitbestimmung vorsieht. Aufgrund der Mehrheitsverhältnisse ist die Umsetzung derzeit aber wenig wahrscheinlich. Die Frage der Mitbestimmung wird zunehmend nicht nur im Zusammenhang mit den wirtschaftlichen und sozialen Erfordernissen diskutiert, sondern auch unter dem Gesichtspunkt ökologischer Nachhaltigkeit.

France is one of 18 EU countries with workers' participation in the supervisory board or the board of directors. Since 2013, moreover, it has also been obligatory in the private sector for companies with more than 1,000 employees in France or 5,000 worldwide. In recent years, the academic, trade union and political debates on workers' participation in France have palpably intensified. Even President Macron promised to extend workers' participation in his election campaign. To date, however, implementation has been limited. The socialists in parliament have introduced a bill that, among other things, envisages parity-based workers' participation in companies of 5,000 employees or more. There is little prospect of implementation given the current composition of parliament. Workers' participation is increasingly discussed not only in the context of economic and social needs, but also in that of environmental sustainability.

Purpose
The purpose of this paper is to present the actors, institutions and changing rules of the French system of industrial relations (IR). It questions whether the traditional view of the French model as "state-centric" is still adequate.


Design/methodology/approach
Based on institutionalist IR theories of social regulation and neocorporatism, the paper analyses the evolution of the French IR system from a "State-centric" model to the development of collective bargaining, both at the sector and company level, as well as of tripartite concertation.


Findings
Initially based on adversarial relations between trade unions and employers, compensated by strong state interventionism, the French IR system has experienced a series of reforms, adopted under the pressure of the unions in the 1980s and mostly under the pressure of the employers' organisations since the turn of the century. These reforms boosted collective bargaining at the workplace level and tripartite concertation at the peak level. The paper analyses the limits of both developments and explains why a reversal of the hierarchy of norms was imposed in 2016 by law without prior concertation.


Originality/value
The paper presents an original explanation of the change of the initial French IR model, stressing the importance of power relations and the role of IR experts in the different reform moments.

Le statut de la société européenne (SE) de 2001, assorti d'une directive sur l'implication des salariés, veut faciliter la mobilité des entreprises en Europe tout en sauvegardant les droits nationaux de participation préexistants des salariés. Au-delà, ce statut donne aux salariés l'opportunité d'européaniser leurs droits de participation à travers la négociation, c'est-à-dire de les étendre à l'ensemble des salariés de la nouvelle SE. L'article vérifie la réalisation de ces objectifs à partir d'une enquête qualitative dans dix SE, dans lesquelles les négociateurs ont mis en place un « comité de la SE ». Là où un comité d'entreprise européen existait auparavant, les droits d'information et de consultation du nouveau comité ont été systématiquement améliorés. Dans les SE qui disposaient auparavant de droits de participation au conseil d'administration ou de surveillance, ces droits ont été maintenus et élargis à des représentants des salariés d'autres pays. L'impact de cette européanisation reste toutefois limité, car le nombre total de SE avec participation est encore modeste.
