Las nuevas realidades políticas y económicas ameritan repensar las categorías básicas del derecho de contratos, especialmente sus principios generales. A tal punto, que es imprescindible reconocer que los principios y tendencias que dominan la teoría posmoderna del contrato en algunos ámbitos se complementan, pero de manera indudable en otros aspectos se contradicen ampliamente. Para solventar la presente problemática, debe tenerse presente que la noción de Principios Generales del Derecho así como la naturaleza relativa del imperativo de seguridad jurídica se enmarcan dentro de la más pura tradición romanista. En realidad, esta contradicción genera una tensión entre los imperativos de libertad y justicia contractual. ; The new political and economic realities need a rethinking on the basic categories of contractual law, specially its general principles. Up to a point, where it is essential to recognize that the principles and tendencies that dominate the postmodern theory of contract in certain contexts complement each other, but undoubtedly in other aspects they contradict themselves widely. To solve this problematic, it must be taken into account that the notion of general principles of law, as well as the relative nature of the imperative need for juridical security, are framed inside the most pure roman tradition. Really, this contradiction generates tension between the imperatives of freedom and contractual justice.

International audience ; In railway operations, a timetable is established to determine the departure and arrival times for the trains or other rolling stock at the different stations or relevant points inside the rail network or a subset of this network. The elaboration of this timetable is done to respond to the commercial requirements for both passenger and freight traffic, but also it must respect a set of security and capacity constraints associated with the railway network, rolling stock and legislation. Combining these requirements and constraints, as well as the important number of trains and schedules to plan, makes the preparation of a feasible timetable a complex and time-consuming process, that normally takes several months to be completed. This article addresses the problem of generating periodic timetables, which means that the involved trains operate in a recurrent pattern. For instance, the trains belonging to the same train line, depart from some station every 15 minutes or one hour. To tackle the problem, we present a constraint-based model suitable for this kind of problem. Then, we propose a genetic algorithm, allowing a rapid generation of feasible periodic timetables. Finally, two case studies are presented, the first, describing a sub-set of the Netherlands rail network, and the second a large portion of the Nord-pas-de-Calais regional rail network, both of them are then solved using our algorithm and the results are presented and discussed.

La volonté politique de développer le fret ferroviaire se heurte à plusieurs problèmes qui le confinent au déclin par son manque de compétitivité. L'initiative MaxiPerfo, lancée en 2010 à la suite de l'Engagement National pour Fret Ferroviaire, a pour objectif de réaliser un saut de performance au fret ferroviaire par le biais du déploiement d'innovations techniques. Les innovations couvrent plusieurs composants du système ferroviaire comme la modernisation du matériel roulant, permettre la circulation de trains longs sur le réseau et l'introduction d'outils d'aide à la décision qui améliorent l'intégration des circulations de trains fret avec celles des trains de voyageurs. Le projet SIGIFret s'inscrit dans ce contexte et vise à étudier l'apport de ces outils d'aide à la décision dans les phases de gestion opérationnelle du trafic comme dans les phases amont de planification. SIGIFret est un projet du programme de recherche PREDIT avec pour partenaires SNCF Réseau et l'IFSTTAR. Le projet est structuré en deux parties. Dans la première partie du projet, l'objectif était d'évaluer l'apport d'un outil d'aide à la gestion opérationnelle du trafic. Pour cela, la ligne Paris-Le Havre a été choisie comme cas d'étude en raison de la mixité des circulations qui la traversent et de la présence de deux noeuds ferroviaires critiques : les gares de Mantes-La-Jolie de Rouen-Rive-Droite. Toute l'étendue de la ligne contrôlée par les postes de régulation de ces gares a été modélisée dans l'outil de simulation OpenTrack. Cet outil est capable de reproduire a un niveau microscopique le comportement des circulations à partir de la description de la topologie de la voie, du système de signalisation et de la dynamique des trains. Avec cet outil, on est donc en mesure d'évaluer l'impact de différentes décisions de régulation. La modélisation couvre 7 kilomètres de ligne autour de la gare de Mantes-la-Jolie et 27 kilomètres de ligne autour de Rouen-Rive-Droite.
