El presente trabajo analiza las medidas legislativas que se obligan a adoptar los Estados parte en el Protocolo adicional al Convenio sobre la Ciberdelincuencia de 2003 para homogeneizar la legislación penal sobre la difusión de «material racista y xenófobo» en internet tipificando como delito determinadas conductas contra personas o grupos por razón de su raza, color, ascendencia, origen nacional o étnico o religión, tratando en primer lugar las cuestiones interpretativas que plantea su redacción y que han sido abordadas por el Informe explicativo. A continuación se estudian los problemas que plantea la aplicación de los criterios que resultan del Protocolo al llamado «discurso del odio» en las redes sociales: la intencionalidad de la conducta y de los efectos de la difusión teniendo en cuenta las especificidades de las redes sociales; la publicidad intencional de la conducta, que se deslinda de las comunicaciones privadas no penalizables por la predeterminación del destinatario, con los problemas que se plantean cuando el destinatario es un grupo de personas; y la definición del material racista y xenófobo que propugna, promueve o incita al odio, la discriminación y la violencia, por remisión a los instrumentos internacionales en los que la incitación es un elemento clave de forma que se incorpora como requisito implícito adicional el «riesgo inminente» según el conocido estándar norteamericano. Finalmente, se examina cómo algunos de estos criterios –en particular, la doctrina del «riesgo inminente»– han sido aplicados en una reciente sentencia del Tribunal Europeo de Derechos Humanos de 2018 sobre el discurso del odio en internet.
The paper deals with the impact of the first ruling of the Constitutional Court on glorification of terrorism (112/2016) in the interpretation of this offence by the Supreme Court, which demands hermeneutically requirements absent from the literality of art. 578 of the Criminal Code and that the Constitutional Court required in its previous case law on hate speech, recently reiterated in the ruling 35/2020 of the Constitutional Court. Firstly, the text addresses the initial description of the elements of this criminal figure by the Supreme Court and its characterization as public defence without incitement, as opposed to the definition of the crime of public provocation to terrorism in the 2008 Framework Decision of the European Union and the Council of Europe Convention for the prevention of terrorism of 2005, both requiring direct or indirect incitement to terrorism, intention to incite and generation of a risk.Secondly, the fundamental aspects of ruling 112/2016 are summarized.This judgement extrapolates the doctrine established in the ruling 235/2007 of the Constitutional Court on the justification of genocide to glorification of terrorism, relying on previous international texts as wellas on the case law from the ECtHR. Accordingly, this makes the constitutionality of punishing glorification of terrorism conditional on both, indirect incitement to terrorism - contradicting the legal doctrine of the Supreme Court that considers it public defence without incitement - and the existence of a risk for other people or for the system of liberties.The central part of the text focuses on the reception of this constitutional interpretation of glorification of terrorism in the legal doctrine of the Supreme Court arising from the aforementioned ruling 112/2016, dealing separately with the three elements required by this ruling: the intention to incite as «trend element» whose criminal relevance was denied in a widely known ruling (subsequently affirmed in the most recent case law though); indirect incitement to terrorism, based on the Convention, the Framework Decision and the recent 2017 Directive, despite another judgement considers that art. 578 CC does not require incitement but the aptitude to raise a potentiality of risk; and, finally, the risk itself that, on the one hand, is linked to the impact of expressions on social networks, mainly attending to the criterion of potential diffusion based on qualitative elements and, on the other hand, is characterized as an abstract and not specific, aptitude risk to create a favourable atmosphere to terrorism, which is estimated based on the elements listed in the Directive. Finally, in the context of a recapitulation of the elements that constitute the «application canon of constitutionality» of glorification of terrorism, the text concludes with an analysis of the ruling 35/2020 of the Constitutional Court, which reaffirms the need to assess the intention in the criminal prosecution of glorification by considering whether the conduct constitutes the exercise of freedom of expression or not, and a prospective reflection on the practical consequences of these constitutional leading cases on the application of the offence of glorification by the criminal courts. Theruling 35/2020 of the Constitional Court and concluding remarks. ; El trabajo estudia el impacto de la primera sentencia del Tribunal Constitucional sobre el enaltecimiento del terrorismo (STC 112/2016) en la interpretación de este delito por el Tribunal Supremo, al exigir por vía hermenéutica requisitos ausentes de la literalidad del art. 578 del Código Penal y que el Tribunal Constitucional ha exigido en su jurisprudencia anterior sobre el discurso del odio, recientemente reiterada en la STC 35/2020.Se aborda en primer lugar la descripción inicial de los elementos de esta figura delictiva por el Tribunal Supremo y su caracterización como apología sin incitación, contrastando con la definición del delito de provocación pública al terrorismo de la Decisión Marco de 2008 de la Unión Europea y del Convenio del Consejo de Europa para la prevención del terrorismo de 2005, que requieren incitación directa o indirecta al terrorismo, intención de incitar y generación de una situación de riesgo.A continuación, se resumen los aspectos fundamentales de la STC 112/2016 que, extrapolando a la apología del terrorismo la doctrina establecida en la STC 235/2007 sobre la justificación del genocidio y apoyándose en los anteriores textos internacionales y en la jurisprudencia del TEDH, condiciona la constitucionalidad del delito de enaltecimiento del terrorismo a que se produzca una incitación indirecta al terrorismo — entrando en contradicción con la doctrina del Tribunal Supremo que lo considera una apología sin incitación— y, en segundo lugar, a la existencia de una situación de riesgo para otras personas o para el sistema de libertades.La parte central del trabajo se dedica a la recepción de esta interpretación constitucional del enaltecimiento del terrorismo en la doctrina del Tribunal Supremo posterior a la mencionada STC 112/2016, tratando separadamente los tres elementos exigidos por dicha sentencia: la intención de incitar como «elemento tendencial» cuya relevancia penal se ha negado en una sentencia muy conocida aunque posteriormente se ha afirmado en la jurisprudencia más reciente; la incitación indirecta al terrorismo, sobre la base del Convenio, la Decisión Marco y la reciente Directiva de 2017, aunque alguna sentencia considera que el art. 578 CP no requiere incitación sino aptitud para hacer surgir una potencialidad de riesgo; y, finalmente, la situación de riesgo que, por una parte, se vincula al impacto de las expresiones en las redes sociales atendiendo mayoritariamente al criterio de la difusión potencial en función de elementos cualitativos y, por otra parte, se caracteriza como un riesgo abstracto y no concreto, de aptitud para crear un clima favorable al terrorismo, cuya presencia se estima en función de los elementos enumerados en la Directiva. Finalmente, en el contexto de una recapitulación de los elementos que integran el «canon aplicativo de constitucionalidad» del enaltecimiento del terrorismo, se analiza la STC 35/2020 que reafirma la necesidad de valorar la intención en el enjuiciamiento penal del enaltecimiento al ponderar si la conducta constituye ejercicio de la libertad de expresión, concluyendo con una reflexión prospectiva acerca de las consecuencias prácticas de la jurisprudencia constitucional analizada sobre la aplicación del delito de enaltecimiento por los tribunales penales.

El treball analitza les mesures legislatives que cal que els estats membres adoptin en el Protocol addicional al Conveni sobre la Ciberdelinqüència de 2003 per homogeneïtzar la legislació penal sobre la difusió de «material racista i xenòfob» a internet, tipificant com a delicte determinades conductes contra persones o grups per raó de la seva raça, color, ascendència, origen nacional o ètnic o religió. En primer lloc, tracta les qüestions interpretatives que planteja la seva redacció i que han estat abordades per l'Informe explicatiu. A continuació, estudia els problemes que planteja l'aplicació dels criteris que resulten del Protocol de l'anomenat «discurs de l'odi» a les xarxes socials: la intencionalitat de la conducta i dels efectes de la difusió tenint en compte les especificitats de les xarxes socials; la publicitat intencional de la conducta, que es distingeix de les comunicacions privades no penalitzables per la predeterminació del destinatari, amb els problemes que es plantegen quan el destinatari és un grup de persones; i la definició del material racista i xenòfob que propugna, promou o incita a l'odi, la discriminació i la violència, per remissió als instruments internacionals en què la incitació és un element clau, de manera que s'incorpora com a requisit implícit addicional el «risc imminent» segons el conegut estàndard nord-americà. Finalment, examina com alguns d'aquests criteris –en particular, la doctrina del «risc imminent»– han estat aplicats en una recent sentència del Tribunal Europeu de Drets Humans de 2018 sobre el discurs de l'odi a internet. ; The work analyses the legislative measures which the Party States in the Additional Protocol at the 2003 Convention on Cybercrime are obliged to adopt in order to harmonise the criminal legislation on the dissemination of "racist and xenophobic material" on the Internet, classifying as criminal certain conduct against individuals or groups for reasons of their race, colour, descent, national or ethnic origin or religion, addressing firstly the interpretative issues which its composition brings forward and which were addressed by the Explanatory Report. Next, there is a study of the problems posed by the application of the criteria resulting from the Protocol to that which is termed "hate speech" in social networks: the intentionality of both the conduct and the effects brought about by the dissemination, taking into account the specifities of the social networks; intentional dissemination to the public in relation to the conduct, which is separate from private communications that are unpunishable due to the predetermination of the recipient, with the problems which arise when the recipient is a group of people; and the definition of the racist and xenophobic material which advocates, promotes or incites hatred, discrimination and violence, by reference to the international instruments in which incitement is a key element so that "imminent danger" is incorporated as an additional implicit requirement in accordance with the recognised North American standard. Abstract: Within the framework of the European parliamentary monarchies, the constitutional design of the contemporary Swedish monarchy has some singularities worthy of attention. The paper starts from a panoramic overview of the Swedish monarchy in the Instrument of Government of 1975 that dissociates the Head of State from the state powers thus setting up a characteristic model of rationalization of the parliamentary monarchy in the written constitutional text and analyzes the significant lack of powers that individualizes the position of the Swedish Head of State compared with the rest of the European sovereigns. To continue, the evolution of the institution in Sweden from the previous Instrument of Government of 1809, that established a constitutional monarchy based on the principle of separation of powers, is considered. Parliamentarism was progressively introduced from 1918 without formally amending the constitutional text, giving new sense to the constitutional dispositions by means of interpretation. It was in 1969 that, through a partial reform of the Constitution, the parliamentary system was formally incorporated when Parliament was granted the possibility of bringing a vote of no confidence. Then, it goes on with the discussion about the King's powers in the travaux préparatoires of the new Constitution of 1975 that culminated with the so-called Compromise in Turekov in 1971 in which the Swedish political parties finally agreed on a constitutional design restricting the King's powers, paying attention to the circumstances and reasons that explain why the Swedish monarch lost the formal powers that had coexisted since 1918 with the functioning of the parliamentary system, emphasizing the motivations of the parties represented in the Commission that drafted the new Instrument of Government.The paper concludes by referring to the striking exclusion of the Swedish Head of State from the Cabinet formation process in the Government Instrument of 1975 and the unusual variant of negative parliamentarism adopted in which the vote of the Prime Minister previous to his appointment is not really a vote of confidence but of «no no-confidence». With the constitutional reform of 2011, the novelty introduced was that, following the elections, the Prime Minister must undergo a mandatory vote of confidence, although the principle of negative parliamentarism is maintained essentially as long as he can continue in office if more than half of the members of Parliament do not vote against him, irrespective of the favorable votes he receives. ; Resumen:En el marco de las monarquías parlamentarias europeas, la configuración constitucional de la monarquía sueca contemporánea presenta singularidades que merecen atención. Se parte de una visión panorámica general de la monarquía sueca en el Instrumento de Gobierno de 1975 que desvincula la Jefatura del Estado de los poderes estatales estableciendo así un modelo propiode racionalización de la monarquía parlamentaria en el texto constitucionalescrito y se analiza la significativa carencia de competencias que individualiza la posición del Jefe de Estado sueco respecto de los restantes soberanos europeos.Se aborda a continuación la evolución de la institución en Suecia a partir del anterior Instrumento de Gobierno de 1809 que estableció una monarquía constitucional basada en el principio de separación de poderes. Progresivamente se fue introduciendo el parlamentarismo desde 1918 sin modificar formalmente el texto constitucional, atribuyendo nuevo sentido por vía interpretativa a las disposiciones constitucionales. Fue en 1969 cuando mediante una reforma parcial de la Constitución se incorporó formalmente el sistema parlamentarioal reconocerse al Parlamento la posibilidad de presentar una moción de censura.Se trata después la discusión sobre los poderes del Rey durante la tramitación parlamentaria de la nueva Constitución de 1975 que culminó con el denominado Compromiso de Turekov de 1971 en el que los partidos políticos suecos consensuaron finalmente un diseño constitucional restrictivo de las competencias del Rey, atendiendo a las circunstancias y razones por las que el monarca sueco perdió los poderes formales que desde 1918 habían coexistido con el funcionamiento del régimen parlamentario, poniendo el énfasis en las motivaciones de los partidos representados en la Comisión que redactó el nuevo Instrumento de Gobierno.El trabajo finaliza haciendo referencia a la llamativa exclusión del Jefe de Estado sueco del proceso de formación del Gabinete en el Instrumento de Gobierno de 1975 y a la variante inusual del parlamentarismo negativo adoptada por cuanto la votación previa al nombramiento del Primer Ministro no es en realidad de confianza sino de «no censura» o «no desconfianza». By contrast, Council of Europe Convention n.º 196 on the Prevention of Terrorism (2005) characterizes public provocation to terrorism deliberately including indirect incitement and requiring both specific intent and a result of danger of commission of a terrorist offense. The Explanatory Report of the Convention refers to the case-law of the ECtHR to fix on the elements to be considered in the assessment of the danger, thus making it an interpretative parameter. The Framework Decision of the Council of the European Union has adopted since 2008 the same definition that the Convention as it is possible to speak of a European model of criminalization of incitement to terrorism that has been criticized for using a broad and open definition in conflict with the principle of legal certainty and not determining the nature of the danger caused by incitement. These criticisms have not prevented, however, that the Special Rapporteur of the United Nations has considered the definition of the Convention as a best practice in the fight against terrorism. After the Convention, the ECtHR has led to relevant developments of case-law on the indirect incitement as cases Leroy (2008) and Yavuz and Yayali (2013). The US approach that requires imminence and likelihood of danger is the benchmark for the critical positions with the European standard that is intended to extend universally in a draft international convention for the prevention of incitement to terror raising the issue if it is appropriate beyond the European context in which it has emerged. ; La Resolución 1624 (2005) del Consejo de Seguridad de las Naciones Unidas no define la incitación al terrorismo. Sí lo hace, por el contrario, el Convenio núm. 196 del Consejo de Europa de 2005 que caracteriza la provocación pública al terrorismo incluyendo deliberadamente la incitación indirecta, exigiendo una intencionalidad específica y un resultado de peligro de comisión de un delito terrorista. El Informe explicativo del Convenio remite a la jurisprudencia del TEDH para establecer los elementos a considerar en la apreciación de dicho peligro haciendo así de ella un parámetro interpretativo. La Decisión Marco del Consejo de la Unión Europea ha adoptado desde 2008 la misma definición que el Convenio por lo que cabe hablar de un modelo europeo de penalización de la incitación al terrorismo que ha sido criticado por utilizar un definición abierta y general en conflicto con el principio de seguridad jurídica y por la indeterminación de la naturaleza del peligro provocado por la incitación. Estas críticas no han impedido, sin embargo, que el Relator Especial de las Naciones Unidas haya considerado la definición del Convenio como una práctica óptima en la lucha contra el terrorismo. Con posterioridad al Convenio, el TEDH ha dado lugar a desarrollos jurisprudenciales relevantes sobre la incitación indirecta como los casos Leroy (2008) y Yavuz y Yayali (2013).
