The essay reviews the current-day implications of the democratic model. It argues that this model, particularly the Latin one, is subjected to important design failures, particularly the immoderate hegemony of political parties. Secondly, the author sketches the historical evolution of that model, with particular attention to the Spanish case, and shows the main constitutional and legal amendments that he estimates necessary in orden to attain the regeneration of the democratic pattern. ; El modelo democrático vigente, en especial el latino, adolece de un grave defecto de diseño: la excesiva hegemonía de los partidos políticos, sin cuya mediación –y mediatización– no es posible participar en la vida política. El autor traza la genealogía histórica del modelo partidocrático, con especial atención al caso español, y apunta las principales reformas constitucionales y legislativas que considera imprescindibles para conseguir una regeneración del modelo democrático.

The author seeks to examine the thesis implied in both title and subtitle (Democracy without democrats? Democracy is unviable without civic-political education). The first part sudies how the strategic role fulfilled by civic-political education in democratic regimes is traced back to Promethean Myth according to Protagoras´ version. In fact so it has been understood by republican regimes, but not by liberal conservatives (indirect representation). The second part presents a case applied to Spanish democracy with the Constitutional Text as its starting point. ; El autor intenta probar la tesis enunciada tanto en el título como en el subtítulo. La primera parte del ensayo estudia cómo el papel estratégico que cumple la educación cívicopolítica en los regímenes democráticos se remonta al mito de Prometeo según la versión del Protágoras. De hecho, así lo han entendido los regímenes republicanos, aunque no los liberales conservadores (representación indirecta). La segunda parte presenta una aplicación al caso español a partir del Texto Constitucional.

Is Rousseau a representative of the law of nature tradition or a conventionalist? The debate is old enough, but R. Derathé's authority, adscribing Rousseau to the former tradition, seems to have prevailed, even over Vaughan's interpretation, that considers him a conventionalist. Indeed, we can find texts or paragraphs of both tendencies. Hence a genealogical study becomes necessary, as the one presented here. Hesitations appear as early as in the Discourse on inequality and are clear in the Geneva Manuscript, but Rousseau finally elaborates his own methodology based on the dialectics conscience-reason. I have proposed to call this methodology constructivist. It neatly appears in the Social Contract and in Emile. However, there are still paragraphs mixing the above cited traditions, and there are quite a few examples of the former one. The law of nature tradition provided the dominant political language of the age, thanks mainly to the iurisconsulti. Rousseau criticizes them, but he does the same with Hobbes.This paper aims to contribute to clarifying definitely this issue, thats heds light on the real meaning Rousseau had given to the social contract and to his democratic model. ; ¿Es Rousseau iusnaturalista o convencionalista? La polémica ha sido larga pero parece haberse impuesto la autoridad de R. Derathé adscribiéndole al iusnaturalismo, pese a que Vaughan le había adscrito antes al convencionalismo. En realidad es posible encontrar textos o párrafos de ambos enfoques. Por eso se hace preciso un estudio genealógico como el que presentamos. Las vacilaciones aparecen ya en el Discurso sobre la desigualdad, y son claras y se hacen más patentes en el Manuscrito de Ginebra, pero Rousseau encuentra finalmente su propia metodología basada en la dialéctica conciencia-razón. He propuesto denominar constructivista esta nueva metodología, que aparece ya netamente en el Contrato social y en Emilio. No obstante, todavía seguirá ofreciendo párrafos de tinte iusnaturalista o convencionalista, en especial del primero, dado que era el lenguaje político dominante en su tiempo gracias a los Jurisconsultos, a quienes por lo demás critica siempre fuertemente; pero lo mismo hace con Hobbes. Este estudio pretende contribuir a clarificar definitivamente esta cuestión, que arroja mucha luz sobre el sentido real de su propuesta de contrato social, así como de su modelo democrático.
