Bacon or Beef? 'Fake' Halal Scandals in the Russian Federation: Consolidating Halal Norms Through Secular Courts

Abstract
This article aims at analyzing how the penetration of a commercial rational into the religious field impacts the relations between the State and the Muslim religion in the case of post-Soviet Russia. Here, the rise of a 'halal market' – that is the market for halal products and the market of halal certification – was punctuated by scandals. This research scrutinizes one of them, linked with halal meat products containing pork dna. This scandal is studied as it reveals the pre-existing order and is considered per se, as a critical test when common values and norms are either abandoned or strengthened, and previously established relations are transformed.
First, the article presents how Islam is organized and regulated in the Russian Federation; then it analyzes the 'scandalization strategy,' which leads to the reconfiguration of the game of actors. Lastly, it examines how the scandal, through the use of law and court decisions, contributes to the extension, legitimization and consolidation of the certificated 'halal' norm beyond the circles of pious Muslims.
This research is based on empirical data gathered in Moscow and Kazan in 2018: the observation of a court trial and the analysis of documents relating to the legal proceedings, semi-structured interviews and online research.

I will try to cover three different examples on issues in which the Inter-American and the European Courts have had different approaches, some substantive, some methodological, regarding the following issues:
1.A substantive and radical difference in the approach of the right to appeal a criminal conviction;2.A substantive but slight difference in the approach of cases of involuntary or forced sterilization;3.An example of evolution from divergence to convergence in the subject of access to information; and4.A radical difference in the approach with respect to reparations.

Cet article analyse les processus de redéfinition des relations entre l'État et les cultes en Géorgie postsoviétique, à partir de l'étude des textes normatifs, de la presse et d'entretiens réalisés entre 2009 et 2011. Il montre la diversité des conceptions de la laïcité qui se sont affrontées sur la scène politique géorgienne, depuis la laïcité juridictionnaliste jusqu'à la laïcité séparatiste et libérale, et analyse les rapports de force mouvants qui ont présidé aux arrangements entre les deux institutions durant la présidence d'E. Chevardnadze (1992-2003) et depuis la « révolution des roses » (2003). Il examine le contenu de l'accord constitutionnel signé en 2002 entre l'État et l'Église orthodoxe géorgienne, qui confère à celle-ci des prérogatives symboliques, administratives et financières dont les autres cultes sont privés puis montre le décalage existant entre les accords institutionnels et les modalités pratiques de fonctionnement. La faiblesse de l'État, les calculs stratégiques des uns, tant au sein de la sphère politique que de la sphère religieuse, et l'idéologie des autres se sont combinés pour placer le flou au cœur de la gestion pratique des cultes.

Various ideas about church-state relations have clashed in Georgian politics since the period of "juridictionalistic laicism" till that of liberal secularism based on the separation of the two institutions. The moving lineup of forces is examined that has presided over the arrangements made between church and state under President Chevardnadze (1992-2003) and since the Rose Revolution in 2003. The constitutional agreement signed in 2002 between the government and the Georgian Orthodox Church endows the latter, unlike other religious denominations, with symbolic, administrative and financial prerogatives. Chapter 14 FROM CULTURE TO CULT: MUSEUM COLLECTIONS AND RELIGION IN CONTEMPORARY GEORGIAN NATIONAL DISCOURSE
International audience ; In 1999, the Georgian Ministry of Culture, the Baltimore Walters Art Gallery and the Foundation for International Arts and Education decided to exhibit 160 artefacts, including sacred objects, from Georgian collections in American museums. A small circle of students in Tbilisi, the capital of Georgia, started a protest action against the exhibiting of sacred artefacts, soon gaining support from the political opposition leaders and a large part of population. As a result, the authorities decided to cancel the exhibition. Based on the case study of these protest actions, this chapter aims to show the ways in which modern-day Georgian nationalism has been remodeled around religious categories, and the political and social implications of this remodeling. The chapter argues, that the impoverishment of the specific religious meaning of Christianity during the socialist rule has provided a background for filling Orthodox Christianity with new meanings and interpretations. In the context of new political developments, this process facilitated the re-emergence of Christianity as the central aspect of the national and political discourse. In present-day Georgia religion appears to engage discourses and issues which go beyond religious matters, such as those of foreign policy, political orientation, corruption, and national identity. Such re-interpretation of Christianity in the contemporary context has contributed to the process of de-secularization of the society.

Pierre Nora reminds that the word « space »is torn between two poles of meaning, history and geography: in one respect, it refers to aterritory, limited by borders inside which the power is exercised, in another to nature, these twopoles being indissolubly connected in the definition of French national identity2. Numerousstudies have indeed scrutinized the process by which space is invested by the forms of powerand have analysed the link between the appropriation of space and nation building.

Les populations russes du Caucase méridional, vieillissantes, appauvries et numériquement affaiblies, rencontrent de grandes difficultés pour s'adapter à la situation née de l'éclatement de l'URSS. Aujourd'hui citoyens des nouveaux États indépendants, les Russes jouissent à ce titre de droits similaires aux populations locales mais, auparavant massivement employés dans l'armée ou l'industrie lourde, ils sont frappés de plein fouet par les transformations économiques et géopolitiques. Le recul de la russophonie, qu'il provienne ou non de politiques délibérées de promotion de la culture nationale, dont témoigne par exemple la disparition progressive des « écoles russes », les marginalise un peu plus. À la différence des autres minorités nationales, ces anciennes élites de l'empire sont en outre dépourvues des ressources symboliques et politiques fournies par l'ethnicité pour négocier leur place dans les nouvelles sociétés.

Les enjeux politique de la référence révolutionnaire en Géorgie
International audience ; Le 22 novembre 2003, Mikhail Saakachvili et ses hommes font irruption au Parlement géorgien réuni en première session après les élections contestées du 2 novembre, une rose à la main ; le président Édouard Chévardnadzé est contraint à la démission. Le lendemain, une journaliste de la télévision indépendante Roustavi 2 demande à M. Saakachvili si on peut qualifier les événements de « révolution des roses ». L'expression passe à la postérité : dorénavant, même si elle est controversée, avec ou sans guillemets, elle désigne les événements qui ont conduit à ce changement de pouvoir à la tête de l'État géorgien. Pourtant, la révolution a longtemps eu mauvaise presse, associée à l'image de la révolution bolchevique, anti-démocratique, violente, sanguinaire. Et effectivement, le terme émerge tardivement. La presse géorgienne, jusqu'à l'été 2003, n'y avait pas fait référence et certains acteurs, tel Zourab Jvania, explicitant leur aversion pour l'idée même de révolution en ce qu'elle supposait l'usage de la violence1. L'objet de cet article est de s'interroger, non sur la pertinence, mais sur les enjeux politiques de la labellisation. Celle-ci impose en effet une grille de lecture, et la controverse qui l'entoure s'inscrit dans une lutte pour l'imposition d'un sens des événements qui a de fortes implications, tant sur la scène internationale que sur la scène intérieure.
