L'ambition affichée par les Britanniques d'instaurer le « règne du droit » dans les provinces conquises par la Compagnie des Indes à la fin du XVIII e siècle recouvre un projet de modernisation paradoxal, distinct de la rhétorique de la mission civilisatrice qui s'imposera au XIX e siècle : gouverner les Indiens selon leurs propres lois mieux qu'eux-mêmes ne sont capables de le faire. À travers l'analyse d'une affaire cruciale pour l'histoire du système judiciaire impérial, l'affaire de Patna, cet article met en évidence la faillite du dispositif mis en place par la puissance coloniale pour faire contrôler par des juges anglais l'administration du droit musulman dans les tribunaux du Bengale. Ce faisant, l'enjeu n'est pas seulement d'illustrer les difficultés auxquelles se heurte le mode d'exercice du pouvoir privilégié par les Britanniques, la supervision , dans un empire où coexistent plusieurs formes de droit hétérogènes. Il est également d'esquisser à partir des formes de réflexivité déployées en situation par les administrateurs coloniaux une généalogie de l'orientalisme, en montrant comment et pourquoi un savoir capable d'objectiver les systèmes juridiques propres aux peuples colonisés dans leur différence avec celui des colonisateurs est devenu nécessaire à l'exercice de la gouvernementalité impériale.

Forty years after Discipline and Punish, The Punitive Society shows that Foucault wanted to use the concept of discipline to put forward a genealogy of sociology and, especially, of the Durkheimian program. By rejecting a conception of the right as an expression of demands that were immanent in the collective consciousness, this author conceives the moralization of the penalty as a strategy developed during the 19th century by a bourgeoisie concerned in protecting itself against the new illegalism caused by the transformations of capitalist property. In taking as unifying thread the confrontation with the sociological evolutionism that it is found at the basis of the history of penalty reconstructed by Foucault, this article tries to show the benefits that can be obtained by using the archeological method of dissolution of historical continuities. At the same time, it tries too to show the apories to which genealogy is faced when it tries to give an account of the formation of modern political subjects, not from the forms of solidarity, but from the principle of a civil war that is underneath society. ; Cuarenta años después de Vigilar y castigar, La sociedad punitiva demuestra que con el concepto de disciplina, Foucault pretendía proponer una genealogía de la sociología y, en particular, del programa durkheimiano. Rechazando una concepción del derecho como manifestación de exigencias inmanentes a la consciencia colectiva, este autor considera a la moralización de la penalidad como una estrategia desarrollada en el siglo XIX por una burguesía preocupada de protegerse contra los nuevos ilegalismos suscitados por las transformaciones de la propiedad capitalista. Tomando como hilo conductor la confrontación con el evolucionismo sociológico que se encuenta en la base de la historia de la penalidad reconstruida por Foucault, este artículo se propone poner en evidencia los beneficios que se obtienen al utilizar el método arqueológico de disolución de las continuidades históricas, pero también las aporías con las que se topa la genealogía para rendir cuenta de la formación de los sujetos políticos modernos, no ya a partir de las formas de solidaridad, sino a partir del principio de una guerra civil subyacente a la sociedad.
