Abstract
Why do consolidated democracies incorporate international human rights law (IHRL) treaties into national law? Existing research suggests contrastive accounts of the participation of democracies in IHRL regimes. While overall more likely to ratify, consolidated democracies are sometimes reluctant to accept demanding human rights commitments and less likely than both newly democratic and authoritarian regimes to incorporate international law in their constitutions. To theorize why established democracies commit to IHRL, this paper provides a comparative process tracing of the decisions to incorporate the European Convention on Human Rights (ECHR) into national law in Denmark and Sweden in the early 1990s. Why did these solid democracies with an exceptional commitment to human rights wait over 40 years to give domestic effect to a treaty they had helped create? Assessing rival theories of state commitment to human rights norms, the findings suggest that contextual developments in European law provided an opportunity for domestic political elites to seek insurance by incorporating the ECHR to place constraints on executive power. The argument qualifies claims about material strategizing or socialization to European norms as the primary drivers of incorporation.

This paper analyses Jürgen Habermas's claim that democracy and human rights are co-original and its implications for his international theory. A central argument in his theory, the co-originality thesis suggests that human rights and democracy are not only both fundamental and mutually supportive, but also 'equi-primordial' and internally related. Reconstructing Habermas's argument as it has developed over two decades, I argue that his account of constitutional democracy has difficulties accounting for the enmeshment of constitutional and international human rights, while his three-tiered model of global governance, in the absence of democratic legitimation, amounts to a downgrade of the currently institutionalized practice of international human rights. Instead, I suggest that shifting the focus from ideal global institutions to actual processes of domestic contestation, through which groups appropriate and apply international legal norms in order to claim their rights, provides a plausible account of the practice of international human rights consistent with the co-originality thesis.

In recent years, political philosophers have debated whether human rights are a special class of moral rights we all possess simply by virtue of our common humanity and which are universal in time and space, or whether they are essentially modern political constructs defined by the role they play in an international legal-political practice that regulates the relationship between the governments of sovereign states and their citizens. This edited volume sets out to further this debate and move it ahead by rethinking some of its fundamental premises and by applying it to new and challenging domains, such as socio-economic rights, indigenous rights, the rights of immigrants and the human rights responsibilities of corporations. Beyond the philosophy of human rights, the book has a broader relevance by contributing to key themes in the methodology of political philosophy and by addressing urgent issues in contemporary global policy making

This article explores a tension in deliberative democratic theory. The tension consists in that deliberative opinion formation ideally aims to reach consensus, while a consensus, once established, will likely impede the conditions for further rational public discourse. Hence, over time, deliberative democracy might risk undermining itself. While the tension is demonstrable in theory, we also suggest three cognitive and socio-psychological mechanisms by which consensus might hamper the rationality of public discourse: after an agreement, participants cease to develop new arguments, they tend to forget existing arguments and their fear of deviating from the social norm promotes conformism. Existing research has largely neglected to study how consensus in decision making affects future public deliberation. Our article thus serves three purposes: to elaborate the consensus paradox in deliberative democratic theory; to open up a research agenda for examining the paradox empirically; and to assess the theoretical implications of the paradox.

The past sixty years have seen an expansion of international human rights conventions and supervisory organs, not least in Europe. While these international legal instruments have enlarged their mandate, they have also faced opposition and criticism from political actors at the state level, even in well-functioning democracies. Against the backdrop of such contestations, this book brings together prominent scholars in law, political philosophy and international relations in order to address the legitimacy of international human rights regimes as a theoretically challenging and politically salient case of international authority. This editorial introduction presents an overview of the themes explored in the symposium on Deliberation after Consensus. For all the talk of its obsolescence and irrelevance, the concept of consensus still remains centrally contested through generations of deliberative democracy scholarship. In face of criticism for being neither empirically feasible nor normatively desirable, some deliberative theorists have moved away from consensus-oriented teleology and argued in favor of other legitimate outcomes of deliberations. Other theorists have resisted this move, claiming that the aim of deliberation implies that consensus should remain as a regulative ideal for deliberative outcomes. Engaging with these debates about the role of consensus in theories of deliberative democracy, this symposium brings together a selection of innovative, original research articles that raise novel questions about the role consensus could and should play in democratic deliberation and in a deliberative democracy. This introduction offers an overview of the debate over consensus drawing on the notion of successive generations of deliberative democracy research. Our aim is to demonstrate that the view of consensus has changed during generations of deliberative scholarships, but also that some scholars still defend the normative importance of the meaning of consensus once developed by the first generation. Consequently, there are tendencies of both change and continuity in the debate over consensus in deliberative theory. We conclude this introduction by providing a brief synopsis of each paper.
