Das Buch befasst sich mit dem laufenden Reformprozess zur Investor-Staat Streitbeilegung in der UNCITRAL-Arbeitsgruppe III und insbesondere dem Vorschlag zur Schaffung eines multilateralen Investitionsgerichtshofs (MIC). Eine Einleitung gibt den Rahmen vor und verschafft einen Überblick zu historischem Hintergrund und aktuellen Entwicklungen. Auf dieser Grundlage werden in den folgenden Kapiteln verschiedene Aspekte der Schaffung und Implementierung eines MIC beleuchtet. Die Kapitel behandeln Schlüsselelemente des MIC-Vorschlags wie den institutionellen Rahmen des Gerichtshofs, die Ausgestaltung eines Berufungsmechanismus, den Einsatz von Verfahren zur Beilegung von Massenklagen und die Einrichtung eines Beratungszentrums für Entwicklungsländer. Darüber hinaus wird die Auswahl und Ernennung der Richter diskutiert. Neben der Struktur und den Verfahren des Gerichts stellen sich auch Fragen der Implementierung. Wie kann der MIC in das bestehende ISDS-System integriert werden? Wie kann die Durchsetzung seiner Entscheidungen sichergestellt werden? Auf politischer Ebene geht das MIC-Projekt auf eine Initiative der EU zurück. Daher wird die Rolle der EU im Reformprozess in einem eigenen Kapitel analysiert. Anmerkungen aus der Sicht der Rechtspraxis runden die Beiträge ab. Jedes Kapitel hebt die zu diskutierenden Rechtsfragen hervor und stellt sie in einen größeren Zusammenhang. Ziel ist es, den Leserinnen und Lesern ein Verständnis für die verschiedenen Teile der komplexen Gesamtdiskussion zu vermitteln, welche Kernfragen wichtig sind und wie diese miteinander zusammenhängen. Abstract
The European Court of Justice (ECJ) made a ground-breaking shift away from the current system of investor–State dispute settlement (ISDS) by rendering its judgment in the matter of Achmea v Slovak Republic. However, since March 2018, a large and ever-growing number of investment tribunals have found that the Achmea judgment does not deprive them of arbitral jurisdiction. Against this background, the aim of the present article is to analyse the effects of the Achmea judgment on the jurisdiction of tribunals to settle intra-European Union (EU) investment treaty disputes. By taking due account of the reasoning conducted by the ECJ, the scope of the Achmea jurisprudence will be clarified. It is concluded that the incompatibility of intra-EU ISDS with EU law concerns all intra-EU investment treaties, including article 26 of the Energy Charter Treaty (ECT). On this basis, we ask whether, and to what extent, the applicability of the Achmea judgment is relevant to arbitral jurisdiction. Considering the law applicable to the arbitration agreement, we conclude that International Centre for Settlement of Investment Disputes (ICSID) tribunals and those seated outside the EU remain competent to settle intra-EU investment disputes. In contrast, the Achmea judgment renders ISDS clauses contained in intra-EU investment treaties inoperable if the tribunal is seated within the EU. The article closes with an outlook that puts these conclusions into perspective by considering recent developments such as the EU Member States' ratification of a multilateral termination treaty.

Abstract: In March 2018, the European Court of Justice rendered its Achmea judgment, by which the Court considered the investor-State dispute settlement (ISDS) clause contained in the Dutch-Slovakian investment treaty to be incompatible with EU law. Even though the judgment is considered to be a landmark decision, its potentially far-reaching consequences remain, due to a rather obscure legal reasoning, difficult to assess. The aim of the present contribution is to assess the scope of the Achmea judgment in order to shed light on its relevance for pending and future intra-EU investment arbitrations. In view of the ECJ's Opinion 1/17 rendered in April 2019 and in consideration of recent arbitral practice it is concluded that the scope of the Achmea judgment concerns the incompatibility of intra-EU investment treaty arbitration with EU law. This means on the one hand that the reasoning in Achmea is transferrable not only to ISDS clauses in other intra-EU BITs, but also to Article 26 of the Energy Charter Treaty. On the other hand, the analysis shows that contract-based investment arbitrations are not concerned by the ECJ's findings. Finally, and in view of its clarified scope of application, the relevant factors for analysing the consequences of the Achmea judgement are identified.

Im vorliegenden Werk wird das Verhältnis von Investitions- und Menschenrechtsschutz umfassend dargestellt und eine Methode entwickelt, anhand derer die menschenrechtlichen Bezüge einer Investitionsstreitigkeit systematisch erfasst und argumentativ fruchtbar gemacht werden können. Die Analyse der Schiedspraxis zeigt, dass das Verhältnis von Investitions- und Menschenrechtsschutz im Schiedsverfahren anhand von drei (als Gleichlauf, Konflikt und Missbrauch bezeichneten) Grundmustern systematisch beschrieben werden kann. Die sich anschließende Untersuchung des schiedsrichterlichen Mandats macht deutlich, dass Schiedsgerichte zur Berücksichtigung von Menschenrechten verpflichtet sind. Art und Umfang der Berücksichtigung hängen jedoch davon ab, welche der drei Grundkonstellationen vorliegt. Diese systematische Berücksichtigung erhöht nicht nur die Rechtssicherheit, sondern leistet zudem einen Beitrag zur Durchsetzung von Menschenrechten im Kontext ausländischer Direktinvestitionen.

Telecommunications activities are based on the use of the satellite segment which represents the largest sector in the space industry, generating revenues of hundreds of billions of dollars annually and constantly growing. The article seeks to answer the question of whether investments made for the realization of telecommunications activities can enjoy protection under bilateral investment treaties (BITs) by taking into consideration the scope of financial contributions involved, the significant duration of a telecommunications project from planning to operating a satellite in outer space, and the generally inevitable involvement of more than one national legislation for the implementation of the activity. Through investigating the cross-sections and pitch points between international space law and investment law and looking at all phases of satellite-based telecommunications projects, the article demonstrates that investment law can be applied to space activities and that BITs may provide favorable protection standards for investors.

Das Zusammenspiel von Investitionsschutz, Menschenrechten und der internationalen Schiedsgerichtsbarkeit ist komplex. Theorien zur Interaktion dieser Rechtsregime sind ein hilfreicher Ausgangspunkt. Gleichzeitig stoßen allgemeine Erklärungsansätze an Grenzen, sobald es um die Lösung konkreter Fragestellungen geht. Das Recht des Schutzes ausländischer Investitionen befindet sich an der Schnittstelle von Völkerrecht und Diplomatie – im Kontext einer globalisierten Wirtschaft. Es ist daher nicht überraschend, dass das Investitionsrecht im letzten Jahrzehnt grundlegende Veränderungen erfahren hat. Die exponentielle Zunahme von Schiedsgerichtsfällen hat eine Reihe komplexer rechtlicher und politischer Fragen aufgezeigt, die die Effizienz und Legitimität der Investor-Staat-Streitbeilegung (ISDS) in Frage gestellt haben. Selbst für Experten auf dem Gebiet ist es eine Herausforderung, den Überblick über die rasanten und grundlegenden Veränderungen in diesem wohl dynamischsten Gebiet des Völkerrechts zu behalten. Vor dem Hintergrund des Wandels stellt der vorliegende Band die "Evolution, Bewertung und zukünftige Entwicklungen im internationalen Investitionsrecht" dar. Weltweit führende Wissenschaftler und Praktiker beleuchten die wichtigsten Entwicklungen wie die Entwicklung des Investitionsrechts und das Verhältnis zum allgemeinen Völkerrecht, die praktische Bedeutung von Staatsverträgen, die Rolle des Investitionsschutzes im Zeitalter des Klimawandels sowie aktuelle Reformvorhaben bei ICSID und UNCITRAL. Der Band basiert auf sechs Impulsreferaten, die auf der 10-Jahres-Jubiläumskonferenz des International Investment Law Centre Cologne gehalten wurden.
