Wie werden Urheberrechtsverletzungen im Internet begegnet? Die Studie zeigt den internationalen, europäischen sowie nationale Rechtsrahmen auf, wobei der Schwerpunkt auf dem Recht der EU-Mitgliedsstaaten Frankreich, Großbritannien und Deutschland liegt.Bei der Darstellung nationalen Rechts unterscheidet die Studie zwischen Durchsetzungsmechanismen, die sich gegen den Nutzer selbst, und solchen, die sich gegen die rechtsverletzenden Inhalte selbst richten. Als Herausforderung für die Durchsetzung von Urheberrechten im Internet zeigen sich insbesondere die Suche nach dem richtigen Adressaten einer Maßnahme und die Gestaltung eines Durchsetzungsmechanismus, der nicht nur effektiv ist sondern auch den Grundsatz der Verhältnismäßigkeit beachtet. Neben der Erläuterung und Analyse einzelstaatlicher Regelungen auf ihre Kompatibilität mit Grundrechten und europäischem Recht, liegt auch ein Schwerpunkt auf Fragen der Beweiserhebung im Internet, sowie der technischen Umsetzbarkeit und Effizienz einzelner Maßnahmen

In 1960, a passionate committee led by violinist Isaac Stern succeeded in saving Carnegie Hall, a building the New York Herald Tribune described at the time as "a concert hall that everybody loved but nobody liked." Stern's intervention ensured the famous concert hall's longevity even though its demolition had appeared inevitable a short time earlier. Carnegie Hall is a unique case study within this history of postwar architectural preservation because it offers an unusual success story. Stern, and his committee of musicians, politicians, and lawyers, prevented demolition of the renowned concert hall prior to passage of the Landmarks Preservation Law and formation of the Landmarks Preservation Commission. They overcame a number of obstacles: simultaneous construction of Lincoln Center's new Philharmonic Hall, Carnegie Hall's perceived lack of architectural significance, and an economic incentive to redevelop the site for commercial use. The nature of this preservation success prompts a number of questions. How was Carnegie Hall's preservation accomplished in the progress-driven culture of postwar New York City? Why was the Hall's "mediocre" architecture protected at a moment when more widely admired structures, such as Pennsylvania Station, were destroyed? What characteristics of Carnegie Hall — architectural , social, or historical — gave the building value in the eyes of its preservationists? Through two complimentary case studies, Carnegie Hall and Pennsylvania Station, I will demonstrate that focusing too heavily on aesthetics, at the expense of formulating a feasible economic plan, can prove detrimental to the success of a preservation attempt. An emphasis on economics means that preservation cannot be viewed as solely the work of architects and historians but requires a deeper look at who is leading preservation attempts and the nature of the political structure involved.

As regards the analysis of national law, the study differentiates between enforcement mechanism against end-users directly and mechanisms that are directed against infringing materials as such. AbstractAs the digital generation grows up, societies' norms are being challenged by changing views of what is acceptable communication. Young people live much of their lives online: texting and 'sexting' their thoughts and images to their intimates and strangers alike. These changes have challenged the legal structures committed to protecting society's youth. This paper explores the development of the law in the United States and Germany concerning sexualized text messages or 'sexts'. It asks whether and under what conditions such communications are pornographic and represent a signal for prosecution or protection.

With the COVID-19 pandemic accelerating digital transformation of the Single Market, the European Commission also speeded up the review of the first piece of European Union (EU)-wide cybersecurity legislation, the NIS Directive. Originally foreseen for May 2021, the Commission presented the review as early as December 2020 together with a Proposal for a NIS2 Directive. Almost in parallel, some Member States strengthened (or adopted) national laws beyond the scope of the NIS Directive to respond adequately to the fast-paced digital threat landscape. Against this backdrop, the article investigates the national interventions in the field of cybersecurity recently adopted by Italy and Germany. In order to identify similarities and divergences of the Italian and German national frameworks with the European Commission's Proposal for a NIS2 Directive, the analysis will focus on selected aspects extrapolated from the Commission Proposal, namely: i) the enlarged scope; ii) detailed cybersecurity risk-management measures; iii) more stringent supervisory measures; and, iv) stricter enforcement requirements, including harmonised sanctions across the EU. The article concludes that the national cybersecurity legal frameworks under scrutiny already match the core of the proposed changes envisaged by the NIS2 Proposal.
