Wie können irreguläre Migranten und Migrantinnen ihre Interessen vertreten, obgleich ihre Einreise und ihr Aufenthalt als unerwünscht gelten? Die Studie zeichnet die Spuren von Protest, Organisierung und Lobbying in der EU nach. Dabei wird der Blick an die Grenzen Europas wie auch auf das lobbypolitische Zentrum Brüssel gelenkt. Die Studie zeigt auf, inwiefern sich auf europäischer Ebene überraschende und unkonventionelle Ansatzpunkte ergeben - nicht zuletzt durch geschlechterpolitische Allianzen und eigensinnige Praxen der Migrierenden. Das Buch trägt zur sozialwissenschaftlichen Diskussion um »schwache Interessen« und zum gesellschaftlichen Diskurs um »illegale« Migration bei.

AbstractMigrants must often negotiate their rights while being hampered by their precarious resident status, within contexts where the overlap of migration, welfare, labour and gender regimes lead to incoherent and contradictory institutional set‐ups that hinder their claiming of rights. The analysis of the legal consciousness of undocumented migrants in Germany reveals a complex set of orientations. On some occasions they waive their rights, accepting lower working conditions in order not to lose their jobs – a finding that confirms existing research. At the same time, they also informally "enact" rights and access to institutions themselves. They appeal to the experiences of undocumented migrants with laws and access to social services in other countries. The finding of relatively widespread transnational legal consciousness adds a new dimension to the scholarship on migrant legal consciousness and claims‐making, which has hitherto portrayed undocumented migrants as living in a legal limbo between their countries of origin and destination.

Résumé La négociation de la convention « Travail décent pour les travailleuses et travailleurs domestiques » à l'Organisation internationale du travail ( oit ), en 2010 et en 2011, sort de l'invisibilité les travailleuses domestiques. Cet article analyse comment celles-ci se mobilisent en faveur d'une convention et comment elles participent aux négociations internationales en relevant les défis posés notamment par la structure tripartite de l' oit . En examinant les questions abordées par la convention, cet article soutient que le fait d'appréhender le travail domestique salarié comme une question relevant du travail permet de sortir de l'invisibilité la relation de travail qui existe entre les employées domestiques et leurs employeurs et encourage une approche axée sur la défense des droits. On constate cependant qu'en focalisant l'attention sur la question du travail, la convention occulte d'autres questions telles que la division sexuelle et internationale du travail.
