The present paper aims to compare french and spanish legislations relating to the regulations foreigners access to public health care, with particular reference to the way in which both legislations give especific protection in critical situations of serious illness. In connection with this circunstance of serious illness and from and a comparative perspective, the different practical outcomes of a protection «in full right» and a «discretionary» protection are the most outstanding features. Because the subject matter dealt with —i.e. immigrants' health— is of interest to the different professionals on this sector of activity and with the precision that this document of legal analysis has been made an effort to use non-technical languaje whenever possible so that it can be easily read by anyone interested who not have legal training. ; El presente artículo pretende analizar paralelamente los ordenamientos jurídicos francés y español en cuanto a la regulación del acceso de los extranjeros a una asistencia sanitaria de carácter público y en referencia a la protección específica en ambas legislaciones de la situación excepcional de sufrir una enfermedad grave. A nivel comparado es especialmente destacable —respecto a la circunstancia de enfermedad grave— las diferencias prácticas que pueden encontrarse entre una protección de «pleno derecho» y una protección «discrecional». En atención al interés de la materia —salud del inmigrante para diferentes profesionales del sector y precisando que el artículo constituye un documento de análisis jurídico, se ha procurado, sin embargo, utilizar un lenguaje lo menos técnico posible para facilitar su lectura a personas interesadas no necesariamente «juristas».

This article explores unaccompanied adolescent minors' (UAMs) experiences of deterrent practices at internal EU borders while being on the move. Previous studies have acknowledged the securitisation of external borders through gatekeeping and fencing practices; however, there is a recent and continued renationalisation of internal EU borders by the member states. Like other migrants who are travelling irregularly, UAMs also often face harsh living conditions and repeated rights violations in border areas, regardless of their specific rights to protection and psychological needs. Research has called for a renewed focus on migrant children's experiences as active agents at the borders, but until now studies exploring UAMs' experiences at internal EU borders remain scarce. Drawing on Agamben's notion of "legal exception," we seek to explore how deterrent practices are confusingly intertwined and affect UAMs' psychological wellbeing and subjectivities in the Ventimiglia border space. Participant observations and in-depth interviews conducted with UAMs at the French-Italian border provide unique insights into how these bordering practices affect migrant children's legal and psychological safety and reshape their subjectivities. This contribution highlights UAMs' conflicting needs and feelings of institutional "abandonment" when left without institutional welfare protection in the border space, on the one hand, and feeling pressured to act responsibly towards their relatives, on the other.

Les enfants étrangers, migrant de façon indépendante pour différentes raisons et/ou en quête de protection internationale, sont de plus en plus nombreux en Europe et la France est un pays de destination pour beaucoup d'entre eux. La situation de ces enfants – dénommés mineurs isolés étrangers en France- préoccupe de nombreux acteurs (institutionnels, associatifs, académiques). De manière générale, ces enfants, de nationalités variées, aspirent fortement à une protection. Ils sont demandeurs, souvent avides d'apprendre le français, de se former et de travailler. Pourtant, leur accueil est considéré souvent comme une charge. Face à cette problématique, et depuis une vingtaine d'années, les pouvoirs publics peinent à mettre en place une politique claire et coordonnée et les dispositifs de protection de l'enfance adressés restent insuffisants.
