The implementation of the Orlando Reform proves problematic for the dispute that has arisen over the labour protection of lay judges and for of the compatibility of the honorary magistracy statute to constitutional principles. It is necessary to reckon with the consolidated historical origins of various figures of honorary magistrates and with the stable reliance of justice on the work of honorary court judges and on honorary deputy prosecutors to overcome the backlog.They timely introduction in the reform proposals of a disciplinary system and of rules on transfers do not fully reconcile with the idea of a magistrate not bound by a professional relationship with the State as he is destined to perform his duties on a part-time basis and for a strictly limited period of time, while the economic incentives offered to the category do not represent the orthodox way to comply with the European Union rules against the abusive reiteration of fixed-term contracts.For an effective justice service, it would be necessary to ensure to the judicial offices a stable and competent contribution of honorary magistrates, which is difficult to reconcilewith article 106 of the Constitution. Therefore, there are necessary basic choices to make such as semi-professionalizing the honorary magistrates by affecting the constitutional norm, or limiting their use to the minimum necessary by returning to a lay jurisdiction of proximity, or still preserving the existing honorary courts by repealing the new powers introduced by d. lgs. no. 116/2017. In any case, effective decision-making powers must be ensured to the GOP even in the criminal sector (limited only to certain offences). The opportunity of the PNRR funding resources cannot be lost. ; L'attuazione della Riforma Orlando si dimostra problematica sia in ragione del contenzioso insorto sulla tutela lavoristica dei magistrati onorari sia per la compatibilità dello statuto unico della magistratura onoraria rispetto ai principi costituzionali. Occorre fare i conti con le consolidate origini storiche di diverse figure di magistrato onorario e con lo stabile affidamento della giustizia, per superare l'arretrato, sul lavoro dei giudici onoraridi tribunale e dei viceprocuratori onorari.La pur opportuna introduzione del sistema disciplinare e delle norme sui trasferimenti nelle proposte di riforma non si conciliano pienamente con l'idea di un magistrato non legato da un rapporto professionale con lo Stato in quanto destinato a svolgere le funzioni a tempo parziale e per un periodo di tempo rigorosamente limitato, mentre gli incentivi economici proposti alla categoria non rappresentano la strada ortodossa per conformarsi alla regole eurounitarie contro l'abusiva reiterazione dei contratti a termine. Ancora più complesse sono le scelte per i magistrati onorari già in servizio.Per un servizio giustizia efficace servirebbe assicurare agli uffici giudiziari un contributo stabile e competente dei magistrati onorari di difficile compatibilità con l'art. 106 Cost. Risultano necessarie, pertanto, delle scelte di fondo come semi-professionalizzare i magistrati onorari incidendo sulla norma costituzionale, limitarne il ricorso al minimo necessario ritornando ad una giurisdizione laica di prossimità o conservare il giudice di pace abrogando le nuove competenze introdotte dal d. lgs. n. 116/2017. In ogni caso vanno assicurati effettivi poteri decisori ai GOP anche nel settore penale, limitatamente a determinate materie. Non può essere perduta, comunque, l'occasione della erogazione delle risorse del PNRR.

The European Parliament has recently adopted several resolutions on the subject of artificial intelligence, including those on autonomous lethal weapons systems, on intellectual property rights and on the Civil liability regime and artificial intelligence (20 October 2020).The latter also contains a proposal for a regulation which, having duly ruled out the option of recognising the legal personality of AI systems and clarified that the protection provided for by the regulation is additional to that deriving from contractual conditions or other rules (including the unitary euro directive on product liability), identifies the liable parties, distinguishes between the various types of AI systems and differentiates their liability regime; it also regulates insurance obligations, the right to evidence and the limitation regime for actions for damages by victims.The resolution, which focuses on the concept of AI as software or hardware that simulates human intelligence and acts with a certain degree of autonomy in order to achieve specific objectives, distinguishes between "high-risk" AI systems, for which strict liability is provided for, and other AI systems, for which liability is culpable.The Resolution also deals with the problem of evidence and access by the judicial authorities to the "black box", in particular for AI systems based on neural and deep learning. ; Il Parlamento Europeo ha adottato recentemente diverse risoluzioni sul tema dell'intelligenza artificiale, tra cui quelle sui sistemi autonomi di armi letali, sui diritti di proprietà intellettuale e sul Regime di responsabilità civile e intelligenza artificiale (20 ottobre 2020).Quest'ultima, contiene anche una proposta di regolamento la quale, opportunamente esclusa l'opzione del riconoscimento della personalità giuridica ai sistemi di IA e chiarito che la tutela prevista dal regolamento è aggiuntiva rispetto a quella derivante dalle condizioni contrattuali o da altre norme (tra cui la direttiva euro unitaria in materia di responsabilità da prodotti difettosi), individua i soggetti responsabili, distingue le diverse tipologie di sistemi di IA e ne differenzia il regime di responsabilità; inoltre, regola gli obblighi assicurativi, il diritto alla prova e il regime della prescrizione delle azioni risarcitorie delle vittime.
