The article addresses Ukrainian legislation that governs hearing economic cases with a foreign element. Relevant statutes in the realm have been analyzed. The algorithm for determining the applicable legislation is investigated. The main drawbacks of the laws in force are spotlighted and the ways for further improvement are envisaged. The author identifies the main risks business entities can encounter when a case involving foreign element is litigated. The grounds for consideration by commercial courts of Ukraine of cases with a foreign element are investigated. The author notices that the case law on these issues is inconsistent. Among the vexed questions related to the category of economic cases at hand, the following deserve special attention: determination of jurisdiction of the case; determination of the applicable law; features of proof; recognition and enforcement of court decisions abroad. The author concludes that the choice of a foreign court or law should be conscious and clearly motivated, as this is very important for judicial protection. The attention is focused on the complicated interaction between international and national law when economic dispute involving foreign element is considered by the court. The modern tendencies of judicial practice in this sphere are discovered. The typical procedural errors of the parties to a dispute are summarized and the problems of law enforcement are covered. The author analyses effective legal methods for considering a dispute on the basis of Ukraine legislation. The article contains recommendations for courts on learning the content and interpretation of foreign law for the purpose of its application in cases involving foreign element. The application of the institute of contractual jurisdiction in commercial cases with a foreign element is investigated. International audience ; This article examines why and how workers adhere and contribute to the perpetuation of the freedom fantasy induced by neoliberal ideology. We turn to Hannah Arendt's analysis of the human condition, which offers invaluable insights into the mechanisms that foster the erosion of human freedom in the workplace. Embracing an Arendtian lens, we demonstrate that individuals become entrapped in a libertarian fantasy-a condition enacted by the replacement of the freedom to act by the freedom to perform. The latter embodies the survivalist modus operandi of animal laborans (1) who renounces singularity, by focusing on the function of supervised labor, (2) who renounces solidarity, by focusing on individualist and competitive labor, and (3) who is deprived of spontaneity, by focusing on the measured productivity of labor. Therefore, we propose a new corporate governance perspective based on the rehabilitation of political action in organizations as the best way to preserve human capacity for singularity, solidarity, and spontaneity.

This article takes advantage of an unusually long strike (51 days) in Ottawa to study the environmental impact of public transit. Overall, we find a robust significant increase in the concentration of particulate matter (PM) and ozone (O3) and a decrease in the concentration of nitrogen oxide (NO) during the strike on workdays between 7:00 a.m. and 7:00 p.m. The first two effects are probably due to an increase in car traffic during the strike, and the last one could be related to the absence of public buses with diesel engines. Interestingly, the concentration of PM and O3 decreased significantly during the last three weeks of the strike, suggesting that commuters eventually adapted to the lack of public transit by using environmentally friendly means of transportation. By only considering short strikes, previous studies may therefore overestimate the long-term environmental impact of public transit.

The desire to reach the level of European quality of life standards leads to an increase in the importance of the non-state pension system. Such a system is one of the alternative forms of development of social protection of the population, since it contributes both to the formation of additional pension protection and the ability to meet the investment needs of the real sector of the economy. That's why the studies of the nature, specifics and principles of operation of non-state pension funds require updating in this aspect. The purpose of this work is a scientific and critical analysis of theoretical approaches to the interpretation of the essence of "non-state pension fund" (NSPF) concept, identifying the characteristics of funds as institutional investors. In the article the author used general scientific and special methods. They are: analysis, synthesis, induction, deduction, comparison, analogy, generalization. The methodological basis of the research is the systematic approach and the dialectical method of scientific knowledge. In the article the author clarifies the distinctive features of non-profit organizations, the main characteristics of an institutional unit and an institutional investor. A discussion on the dualistic nature of non-state pension funds is presented, which is determined both by the goals and objectives of the activities of the NPF and investment management, taking into account the effectiveness of using the tools of the market economy mechanism. The author's interpretation of the economic content of non-state pension funds is proposed. Conclusions. We believe that the role of NSPF, which they are intended to play in the life of citizens from the standpoint of their personal finance, undeservedly remains out of sight in academic circles. So, we propose to consider the economic content of an NSPF as a special organizational and legal form of a financial institution, designed to create an individually significant level of pension provision for citizens due to the redistribution of their income part between capable and disabled life cycle phases through the accumulation of pension savings, preserving and increasing their real value and the further implementation of retirement benefits on an individual basis. Unlike other ones, such an interpretation reveals the importance of the NSPF in planning citizens' personal finances during their life cycle in order to preserve their social status in case of disability.

To survive, nascent grassroots organizations—and their respective causes—must earn the trust of various audiences that can impact credibility advancement. However, it can be quite difficult for grassroots organizations to access suitable settings, times, and collocated audiences. One context that can yield this type of access is an event as it constitutes a rare opportunity for organizations to engage in practices that impact credibility advancement. We investigate how a volunteer-based grassroots organization orchestrates a high-profile event at the United Nations to promote African diaspora entrepreneurs as a valuable force in the mitigation of development challenges in their home countries. We employ qualitative data collected from ethnographic observations, interviews, and secondary sources and apply grounded theory approaches to demonstrate how organizational credibility can be advanced through performative strategizing within event settings. Drawing from heuristics used in theatrical performances, we found that the grassroots organization mobilized specific audience groups in participative role-playing across two acts, thereby producing and consecrating a temporary simulacrum of a cause-related community it claimed to represent. Our findings demonstrate how an unproven organization can strategically use audience mobilization to convert event settings into performative spaces for simulacrum creation and credibility advancement.

International audience ; In this article, we interrogate vergonha alheia (shame on behalf of others; or "vicarious embarrassment"), which is experienced when viewing an embarrassing action from the outside. We question if shame-associated with the worst of human behavior brought about and made visible by the COVID-19 pandemic-can ignite a new kind of cultural sensitivity to the pain of others. Turning to the work of several feminist scholars, we reveal the generative power of shame in artistic and political mobilization. We study examples of artistic activism (i.e., artivism) during the COVID-19 pandemic, as presented by two Brazilian women-Adriana Calcanhotto and Debora Diniz. By intimately engaging with their work and situating it in the context of the popular feminist struggle in Brazil-that is, a luta (the struggle), we discern two performative patterns articulated through distinct symbolic utterances: indignação and declaração corporal (indignation and bodily declaration). We contend that these utterances help overcome individual apathy, summon radically different forms of sensitivity and meaning making that may initiate potentially transformative shifts in public perceptions of social justice. We conclude with our reflections on how feminist artivism in Latin America not only questions the validity of the abstract, universal, and modern human being but also reveals new frames of progress.

Although most studies on philanthropy have focused on corporate benefactors, limited attention has been given to beneficiaries and their characteristics. The literature thus falls short in explaining how the variance in the perceived value of those characteristics can condition the philanthropic attractiveness of recipients for donors. Drawing from Bourdieu's concept of symbolic capital and qualitative insights drawn from our empirical context of philanthropy in the field of cultural production in the Russian Federation, we argue that the attractiveness of cultural organizations for potential corporate benefactors depends on a range of determinants, which we classify under the broad umbrellas of respectability and reputability. By using political orientation as a moderator, we show that, although respectability is an indiscriminately attractive part of symbolic capital, reputability, associated with artistic celebrity and renown, can become a deterrent to potential donors when it augments the risk of jeopardizing their relationship with the government. We also demonstrate that a board of trustees, which signals openness to stakeholder involvement, diminishes the returns of reputability for potential donors. We test our hypotheses using original and representative longitudinal data on 449 Russian theaters (2004–2011). Taking an indirect recursive approach to estimate models with high-dimensional fixed effects, we find strong support for our hypotheses across a variety of econometric specifications. Our research offers a unique focus on the beneficiary side of the beneficiary-benefactor relationship, which has both theoretical and practical implications for the literatures on corporate philanthropy, and cultural industries.
