Aufgrund einer formalen Konzeption der Autonomie werden Strukturen und objektiv gültige Kerngehalte von Menschenrechten herausgearbeitet. Es werden die Konzeption der Autonomie als Abwägung normativer Argumente sowie deren Zusammenhang mit der Prinzipientheorie des Rechts dargestellt. Auf dieser Grundlage werden Notwendigkeit der Anerkennung von Menschenrechten sowie spezifische Inhalte begründet, ihre Transformation in Grundrechte analysiert und die Konzeption von Menschenrechten als transnationales Verfassungsrecht skizziert. Ziel des Buchs ist, die Möglichkeit objektiver Erkenntnis im Bereich der Menschenrechte auszuloten. Damit wird eine Reihe von Arbeiten fortgesetzt, die Recht auf der Grundlage der Idee der Autonomie rekonstruieren.

Das Buch entwickelt eine Logik für normative Argumentation in Form der Abwägung normativer Argumente. Eine zentrale These ist, dass das Standardsystem deontischer Logik hierfür inadäquat ist und eine Fragmentierung deontischer Logik gemäß dem jeweiligen Geltungsbegriff notwendig ist. Fundamental ist die Unterscheidung normativer Argumente von normativen Aussagen und den für sie geltenden logischen Regeln. Diese Unterscheidung wird systematisch angewandt auf Normensysteme, normative Positionen, das Verhältnis von Werten und Normen sowie auf die Standardformen juristischer Argumentation. Das Buch wendet sich an alle, die an der Struktur normativer Argumentation interessiert sind.

Auf der Grundlage der Konzeption der Abwägung normativer Argumente werden eine Theorie autonomer Normbegründung sowie eine Theorie des Rechts entwickelt, die dessen normativen Charakter und die Notwendigkeit der Rechtfertigung des Rechts aufgrund der Idee individueller Autonomie ernst nimmt. Kritisiert werden kognitive Konzeptionen moralischer Autonomie wie die Kants, propositionale Konzeptionen normativer Argumenten sowie insbesondere die Rechtstheorie Robert Alexys. Es wird aufgezeigt, wie Prinzipien als Gründe für Abwägungsurteile konzipiert werden können, welche Richtigkeits- und Objektivitätsansprüche für Abwägungsurteile begründbar sind, ohne eine kognitive Bestimmbarkeit des Abwägungsergebnisses vorauszusetzen, und welche Autonomierechte anzuerkennen sind. The definition, theory, & purpose of taxation are analyzed in this article. It explores the role of federal institutions in the creation of tax laws & carefully examines the way in which the laws are applied to various factions & members of the population. The author closely looks at domestic & international law, primarily as they relate to Germany, but he does introduce rulings from South American courts as well. More specifically, the system of taxation in the nation of Argentina is briefly compared to that of Germany. Issues of fairness in the lowering & raising of taxes are discussed as are proper models of taxation.
