L'objet de cet article est d'analyser la manière dont les émeutes urbaines de novembre 2005 ont constitué une fenêtre d'opportunité politique pour entamer une réforme du système d'orientation scolaire. Les auteurs étudient en premier lieu le processus de mise à l'agenda de la question de l'orientation. Dans une seconde partie, ils décrivent les différentes étapes du processus décisionnel ayant abouti à la loi de novembre 2009 réformant la formation professionnelle et l'orientation et analysent la nature des changements opérés par sa mise en œuvre.

L´évaluation est une manière d´inscrire des repères dans l´apprentissage des élèves et de les aider à se situer dans leur progression. En France, il est souvent fait référence dans le système d´éducatif au contrôle, à l´interrogation (l´interro) faisant percevoir l´évaluation essentiellement comme sanction d´un savoir. Le diplôme est le moment de reconnaissance officielle du passage d´un niveau à l´autre, c´est un rituel du système éducatif permettant de refléter à l´élève ses compétences et ses qualités. Dans le champ du FLE, la question de l´évaluation se pose depuis de nombreuses années (Delorme, 1987 ; Gaonac´h, 1987 ; Hadji, 1989 ; Lussier, Turner, 1992) dans l´optique d´améliorer les compétences langagières des apprenants. Il se trouve qu´avec la création en 1990 de l´association des centres d´évaluation en langues en Europe (ALTE), la question de l´harmonisation des certifications de langues étrangères en Europe a été posée. Le cadre européen commun de référence adopté en 2001 a permis de faire un grand pas en la matière. L´insuffisance relative, dans de nombreux contextes nationaux européens, de formation initiale à l'évaluation des futurs enseignants reste cependant un handicap : il existe chez ces derniers une tendance inévitable à reproduire des pratiques vécues en tant qu'élèves ou étudiants (Barbé, 2005). To calibrate public action in terms of individual capability, the economist Amartya Sen has devised a system based on the distinction between "functioning", which are what individuals effectively achieve and "capabilities", which depend on real freedom in individual behaviour. To incorporate the role of politics more directly, a second distinction is made between the resources and capabilities of individuals. Resources consist of the goods and services which people have at their disposal, whether they are distributed through the political, economic, or social system. Nonetheless, as everyone knows, equal resources correspond to individual capabilities that are completely unequal. To measure this degree of inequality, Sen proposes the "conversion factor" which consists of the actual ability of a person to transform his resources into individual capabilities. The Capability Approach provides an analytical framework to asses and explain a huge part of public policies (in)efficiency within policy subsystems. Without the adequate conversion factors, public policies risk two pitfalls: offering freedom that is only formal; and requiring "compliant" behaviour without an equitable distribution of the ability to comply. In this case, allocated resources remain untapped and hence useless. To illustrate the relevance of this model and demonstrate the generic dimension of this approach, we give a series of examples based on academic guidance issues.
Abstract This paper aims to ground the research paradigm of public engagement within the field of landscape and heritage. Both the European Landscape Convention and the Faro Convention, major international agreements that shape both these dimensions, stress the need to reinforce the democratic nature of projects. This participation needs to go beyond informing stakeholders and formal hearings, and community values and ideas should be included in the planning process. This entails addressing the complexities of stakeholder deliberation and the solution of thorny problems. The present study examines in detail four case studies from the Netherlands, Slovenia and Denmark, in which public participation was crucial in different stages of the project development. The methodologies employed, as well as the effect that such engagement had on the general results, will be highlighted. Finally, the discussion of results will evaluate the findings through the lens of deliberative democracy within territorial planning.
