This article explores the tensions and contradictions between the recognition of same-sex relationships and the development of legal prohibitions against discrimination on the one hand versus the ongoing symbolic and actual criminal regulation of gay sex on the other hand. I describe these tensions as they have unfolded over the last 40 years through the most recent attempts by the Liberal government of Justin Trudeau, elected in 2015, to reform the criminal law, to expunge the record of past criminal convictions for same-sex behavior, and to apologize and compensate lesbian, gay, bisexual, transgender, queer (LGBTQ) communities for past discrimination. I argue that this bifurcated pattern of public policy change and legal reform demonstrates the persistence of political homophobia alongside of homonationalist celebration of queer normativity. By considering the federal government's long-standing failure to reform criminal laws that encapsulate formal-legal inequality of LGBTQ people, the article highlights the persistence of homophobic public policy alongside homonationalist policy discourse and genuine progress in the legal recognition of queer rights. I conclude by considering the implications of this mix for theorizing homophobia and homonationalism in law and policy.

Abstract. This paper argues for a rethinking of how we approach the study of Canadian public policies on diversity and human rights. I explain how human rights can be considered as a distinctive policy field and I consider the advantages and disadvantages of this conceptualization. I then argue for a particular theoretical approach to understanding the evolution of comparative public policies on diversity over time, focusing on a historical, structural and institutional approach to Canadian political development. The development of a specific field of Canadian political development—akin to the subfield of American political development in American politics—can provide a focal point for empirically and historically grounded theorizing about the Canadian case in its North American, comparative and global context.Résumé. Le présent article propose un nouveau regard sur l'étude des politiques publiques canadiennes en matière de diversité et de droits de la personne. J'y explique que les droits de la personne peuvent être considérés comme un champ de politiques distinct et j'y présente les avantages et les inconvénients de cette conceptualisation. Je défends ensuite une approche théorique permettant de cerner l'évolution, au fil des ans, des politiques publiques comparées en matière de diversité, approche qui prend appui sur les dimensions historique, structurelle et institutionnelle du développement politique canadien. L'émergence d'un domaine distinct d'analyse du développement politique canadien – qui s'apparente au sous-domaine du développement politique américain dans la politique américaine – peut servir d'assise à une conceptualisation, ancrée dans l'analyse empirique et historique, du cas canadien dans une perspective nord-américaine, comparative et mondiale.

Cet article vise à analyser l'incidence de la charte canadienne sur les politiques des mouvements sociaux, et plus particulièrement sur le mouvement de défense des droits des gais et lesbiennes. La charte a-t-elle façonné le discours et les stratégies qui sous-tendent les politiques des mouvements sociaux et, si oui, comment? Étant donné que la constitution de 1982 est largement considérée comme illégitime sur le plan politique par bon nombre de Québécois francophones, observe-t-on des différences quant à l'effet de la charte canadienne sur les activités politiques des mouvements sociaux au Québec par rapport au reste du Canada? Après avoir enquêté sur les mouvements gais et lesbiens au Canada anglais et au Québec, l'article conclut que le nationalisme a marqué la façon dont les mouvements sociaux ont réagi aux nouveaux paramètres politiques issus de la charte.

The article draws on post-positivist policy analysis and social movement theory to explore the impact of law in shaping the politics of social movement claims and discursive construction of same-sex marriage as public policy issue in Canadian and American politics. Using the concept of framing, the article discusses the ways in which lesbian and gay rights claimants in Canada and the USA have framed the issue of same-sex marriage in two landmark North American rulings on same-sex marriage, Halpern (Ontario) and Goodridge (Massachusetts). The article finds that, despite differences in legal policy legacies between Canada and the USA, there is a common rights frame governing lesbian and gay struggles over same-sex marriage. Although working with different legal frameworks, judicial precedents, statutory law and human rights protections, courts reached remarkably similar conclusions about same-sex marriage and largely endorsed nearly all of the elements in the rights frame put forth by lesbian and gay litigants. Despite similarities in the framing of lesbian and gay rights issues in the two countries, the article demonstrates that the central difference in the same-sex marriage debate in Canada and the USA concerns the place of the rights frame within the broader political culture.

Le présent article examine les modèles d'organisation des lesbiennes, gais, bisexuels et transgenres (LGBT) dans les communautés ethnoculturelles de Toronto au Canada. On y soutient que de nouvelles formes d'organisation et d'identité locales voient le jour dans les communautés queer, formes qui remettent en question les espaces traditionnels des politiques des mouvements sociaux et la place de choix accordée à l'État-nation en tant que principal niveau d'analyse de la situation des LGBT sous l'angle des droits humains. Plutôt que de s'appuyer sur le concept d'une identité lesbienne et gaie homogène et bien ancrée, l'article décrit les formes multiples que prennent les identités LGBT sous l'effet de l'accélération de la migration, de la création et du renforcement des diasporas et de l'intensification de la diversité ethnoculturelle des centres urbains.
