Cet article étudie le rapport qui pourrait sembler paradoxal entre productivisme et écologie dans la pensée de Marx. Pour ce faire, nous proposons d'analyser le productivisme chez Marx comme un dispositif conceptuel combinant un aspect explicatif et un aspect normatif, dispositif dont on ne peut comprendre pleinement le sens et la portée qu'en le référant à son arrière-plan ontologique, l'être comme production. Si ce dispositif est particulièrement efficace pour comprendre les tenants et aboutissants de la pathologie productiviste qui est au cœur du mode de production capitaliste, il semble faire croire que cette critique épuise toute critique du productivisme, laissant comme point aveugle la question du productivisme dans l'horizon de l'utopie communiste. Promouvant un « Marx ésotérique-hétérodoxe » contre un « Marx exotérique-orthodoxe », le courant actuel Critique de la valeur entend élaborer une critique sociale sur la base d'une interprétation radicale de l'analyse structurale par Marx du capitalisme. Tout en en soulignant l'apport antinaturaliste original, cet article se propose de montrer en quoi ce courant ne fait que reformuler à nouveaux frais une approche déterministe qui vide la praxis de toute épaisseur ontologique, ce qui le prive des moyens de rendre compte du « monde » capitaliste en tant que tel et du coup d'en penser la transformation hors d'une logique du tout ou rien.

In Marx's thought, is 'law of value' a particular law of capitalism (historicism) or a general law of the economy (naturalism)? To clarify this ambiguity, this article proposes to employ the social ontology of Cornélius Castoriadis. For it, 'labour' is not a substance, but a recent historical creation through which, finally, the capitalist mode of production expresses a fundamental truth about all society's way of being. From this perspective, we explore some consequences of this deconstruction for the theory of value as current neo-Marxist approaches may employ it today in their economic analyses.

Introduite en France depuis une dizaine d'années, l'œuvre de Moishe Postone se présente comme une réinterprétation globale de l'œuvre de Marx. Elle est articulée autour de la thèse selon laquelle Marx ne propose pas une critique du capitalisme du point de vue du travail, mais une critique du travail sous le capitalisme. Cet article évalue la portée de ce marxisme hétérodoxe en cherchant à en situer l'arrière-plan épistémologique entre interprétation structuraliste et interprétation phénoménologique de Marx. Il montre que Postone construit un structuralisme original, combinant Althusser et Hegel, mais peine à lui articuler une théorie de la subjectivation et de l'action à la hauteur d'une pensée qui a en vue la transformation sociale et l'émancipation du capitalisme.

Dans Spectre de Marx (1993), Derrida propose une interprétation de l'ontologie sociale de Marx à partir de la notion de « spectre », élaborant ainsi une « hantologie » qui fait la « différance » . L'article revient d'abord sur le point nodal de cette déconstruction, à savoir l'analyse derridienne de l'énigme de la marchandise, cette « chose sensible-suprasensible » décrite dans le livre I du Capital . L'article défend ensuite la thèse suivante : Derrida va jusqu'au bout de la déconstruction de l'ontologie substantialiste propre à la critique de l'économie politique marxienne, là où sans doute Marx s'était arrêté en chemin et là où s'arrêtent sans doute aussi aujourd'hui les approches « constructivistes » de la valeur. À défaut d'en respecter la lettre, Derrida prétend ainsi faire vivre aujourd'hui tout l'esprit de Marx.

Dans l'analyse économique marxiste, quel statut épistémologique peut-on donner à la théorie du fétichisme de la marchandise ? En nous situant sur le plan de l'ontologie sociale, nous défendons l'idée que répondre à cette question revient toujours à distinguer deux interprétations de Marx : (1) l'interprétation essentialiste (le fétichisme est un phénomène de surface et économiquement secondaire) et (2) l'interprétation constructiviste (le fétichisme est fondamental s'agissant de rendre compte du mode d'être marchand). Cette distinction permet d'éclairer aussi ce qu'engage « positivement » la notion de critique chez Marx, au sens où il développe une « critique de l'économie politique ».

From the analytical point of view of Hegel's philosophical anthropology, in Kojève's interpretation, work is an existential structure through which the dual process of subjectification and socialization unfolds. For Hegel, however, this process is not taken for granted: its possibility is understood in terms of the culmination of man's conquest of humanity, taking as a point of departure the relation of mastery to servitude and the undertaking to transform this relation precisely from within the perspective of servitude. The goal of this article is to reconstruct the conceptual framework of this philosophical moment, to our mind an indispensible precondition for the apperception of our modern societies' functioning at the most fundamental level, to the extent that they consider themselves to be 'work based societies.'

Le concept d'autorité a été introduit par Ronald Coase et par Herbert A. Simon dans le champ de l'analyse économique standard de la relation salariale. Il fait fond sur une problématique d'incertitude radicale telle qu'on la trouve initiée chez Frank Knight. Nous allons montrer que mobiliser, sans fondements structuraux et en restant dans l'univers interindividuel des transactions volontaires, la notion d'autorité ne peut donner lieu à une conceptualisation pertinente des enjeux du salariat dans les sociétés capitalistes, voire peut constituer un contre-feu pour occulter le rapport social inégalitaire entre employeur et employé. De sorte que la nouvelle micro-économie qui en découle ne sait pas vraiment quoi faire de cette notion et finit toujours par rabattre la conceptualisation de la relation salariale sur le paradigme marchand, ce qui n'est pas sans effets de pouvoir symbolique dans les débats publics sur l'économie.

As a fundamental right inherent in American citizenship and the nature of the federal union, the right to travel in the United States is basic to American liberty. The right precedes the creation of the United States and appears in the Articles of Confederation. The U.S. Constitution and Supreme Court recognize and protect the right to interstate travel. The travel right entails privacy and free domestic movement without governmental abridgement. In the era of surveillance, the imposition of official photo identification for travel, watchlist prescreening programs, and invasive airport scans and searches unreasonably burden the right to travel. They undermine citizen rights to travel and to privacy. These regulations impermissibly require citizens to relinquish one fundamental right of privacy in order to exercise another fundamental right of travel. The government must preserve these rights in addressing policy goals. The original conception of the right to travel embodies it as a broadly-based freedom that encompasses all modes of transport. Its explicit articulation in the Articles of Confederation became implicit in the Privileges and Immunities Clause of the Constitution. Contrary to the appellate "single mode doctrine," abridgement of any mode of transportation undermines the constitutionally enshrined travel right. The U.S. Supreme Court needs to rearticulate an originally consistent and politically robust multi-modal right to travel.
