Torsten Soffner untersucht die tatsächlichen und verfassungsrechtlichen Möglichkeiten eines frühzeitigen Einsatzes von Mediation im Sozialrecht. Denn trotz der hohen Konfliktanfälligkeit des emotional aufgeladenen Sozialverwaltungsverfahrens wird Mediation gerade hier – an der Konfliktwurzel – bislang praktisch nicht verwendet. -- Anhand einer Begriffsanalyse zeigt der Autor auf, dass dafür eine Glaubwürdigkeitskrise des deutschen Mediationsbegriffs mitursächlich ist. Als Ausweg wird eine wortgeschichtlich begründete Definition von »Mediation« erarbeitet. So definiert, lässt sich ein großes tatsächliches Potential der Mediation gerade für das Sozialverwaltungsverfahren nachweisen. -- Eine verfassungsrechtliche Analyse zeigt jedoch: Nicht erfüllte Gesetzesvorbehalte treffen auf ein vom Autor eigens entwickeltes, sozialverfassungsrechtliches Kooperationsgebot – mit besonderen Kommunikations- und Kooperationspflichten des Sozialstaats. Der Autor begründet damit die Pflicht von Bund und Ländern, das Sozialverwaltungsverfahren hinreichend kooperativ auszugestalten und Mediation zu ermöglichen. Die Arbeit schließt mit Formulierungsvorschlägen für eine entsprechende Gesetzgebung. -- Ausgezeichnet mit dem »Brüggehagen+Kramer Promotionspreis 2015« und dem »Mediations-Wissenschaftspreis 2016« der Centrale für Mediation. / »Mediation and Social Law« -- This dissertation is about the factual and legal potential of mediation in conflicts between citizens and social security authorities erupting at the early stage of administrative procedures. The author establishes that the ambiguity of the German word »Mediation« has posed a hinderence for the use of this method by social security authorities. After shaping it innovatively, the author can show an immense factual potential of »Mediation« for the conflicts discussed. However, constitutional premises call for more detailed legislation to allow mediation here. The author then deducts from known constitutional premises a new social-constitutional principle of cooperation – containing certain constitutional duties of the Welfare State with regard to communication and mediation
