The article analyzes the current state of ensuring the right to sexual orientation and gender identity, analyzes regulations, examines the statistics of criminal offenses on this issue.To achieve this goal, an analysis of current legislation on the grounds for criminal liability for violation of the rights to sexual orientation and gender identity, examined the results of court proceedings, identified motives for bias.It is established that there is no aggravating circumstance for violation of the right to sexual orientation and gender identity in the Criminal Code of Ukraine.The study showed that the current legislation of Ukraine on criminal liability for violation of the rights to sexual orientation and gender identity does not provide a proper solution to this problem. However, given the need for timely decision-making on this issue, there are reasonable proposals: to expand the list of «protected features» that are subject to protection, in particular criminal law; clearly define sexual orientation and gender identity as «protected traits»; to supplement the list of circumstances that aggravate the punishment provided for in paragraph 3 of Part 1 of Art. 67 of the Criminal Code of Ukraine, the grounds for committing criminal offenses based on hatred of sexual orientation and gender identity; for the correct functioning of the provisions of the Criminal Code of Ukraine, it is necessary to give a clear definition of such phenomena as: «intolerance», «sexual orientation», «gender identity» at the legislative level, which will prevent the abuse of these concepts.Keywords: intolerance, sexual orientation, gender identity, criminal offenses of hatred, protected traits, violations of rights, motives for prejudice ; У статті аналізується сучасний стан забезпечення права на сексуальну орієнтацію та гендерну ідентичність, проаналізовано нормативно-правові акти, досліджена статистика кримінальних правопорушень із зазначеної проблеми.Для досягнення поставленої у роботі мети проведено аналіз діючого законодавства щодо підстав встановлення кримінальної відповідальності за порушення прав на сексуальну орієнтацію та гендерну ідентичність, досліджено результати розгляду судових справ, визначено мотиви упередженості .Встановлено, що обтяжуюча обставина за порушення права на сексуальну орієнтацію та гендерну ідентичність в КК України відсутня.Проведене дослідження засвідчило, що чинне законодавство України щодо визначення кримінальної відповідальності за порушення прав на сексуальну орієнтацію та ґендерну ідентичність не забезпечує належне вирішення цієї проблеми. Проте, зважаючи на необхідність здійснення своєчасного прийняття рішень з цього питання обґрунтовані пропозиції: розширити перелік «захищених ознак», які підлягають охороні, зокрема кримінальним законодавством; чітко визначити сексуальну орієнтацію та ґендерну ідентичність як «захищених ознак»; доповнити перелік обставин, які обтяжують покарання, передбачених п. 3 ч.1ст. 67 КК України, підставами скоєння кримінальних правопорушень на ґрунті ненависті до сексуальної орієнтації та ґендерної ідентичності; для коректного функціонування положень КК України необхідно дати чітке визначення таким явищам, як: «нетерпимість», «сексуальна орієнтація», «гендерна ідентичність» на законодавчому рівні, що унеможливить зловживання даними поняттями.Ключові слова: нетерпимість, сексуальна орієнтація, гендерна ідентичність, кримінальні правопорушення ненависті, захищені ознаки, порушення прав, мотиви упередження

The article is devoted to the analysis of the institute of criminal liability and punishment for minors under the Ukrainian legislation. Theoretical and practical features of sentencing for criminal offenses are examined and the main tendencies of sentencing at the present stage are determined. It is stated, that certain provisions of the Criminal Code of Ukraine on the sentencing of minors do not correspond to the worldwide practice of humanizing the punishment for juveniles. It is determined that the purpose of criminal punishment for minors is the process of education. Also, it is proved, that this goal should be confirmed in the current Penal Code. Attention is focused on the fact that the backbone of the state strategy on criminal law counteraction to juvenile delinquency should be a child-friendly system of juvenile justice.The necessity of adding new types of punishment into Penal Code of Ukraine which would be applied only for young offenders is defined. Moreover, the expediency of forming a new system of punishment for juveniles, which would take into account more sophisticated and new educational measures is proved.The peculiarities of imposing criminal punishment on minors according to the legislation of other foreign countries are clarified. It is shown that special penalties for minors, which are not connected with isolation, are provided by the criminal legislation of most European countries.Keywords: juvenile, sentencing, criminal liability, sanity, punishment, delinquency, criminal law policy, humanism, condemnation, psychological features ; Стаття присвячена дослідженню інституту кримінальної відповідальності та призначення покарання неповнолітнім за законодавством України. Досліджено теоретичні та практичні особливості призначення покарання неповнолітнім за вчинення кримінальних правопорушень та визначено основні тенденції призначення покарання.Встановлено, що окремі положення Кримінального кодексу України, з питань призначення покарання неповнолітнім, не відповідають світовій практиці гуманізації покарання неповнолітніх. Визначено, що метою кримінального покарання неповнолітніх є процес виховання, доведено. що ця мета має дістати своє законодавче закріплення в чинному ККУ. Зосереджено увагу, що основою державної стратегії кримінально-правової протидії правопорушенням неповнолітніх повинна стати дружня дітям система ювенальної юстиції. Встановлена необхідність доповнення КК України новими видами покараннями, які були б розраховані тільки на неповнолітніх злочинців, доведена доцільність формування нової системи покарань для неповнолітніх, яка врахувала б більш модернізовані та новітні заходи виховного характеру.З'ясовано особливості призначення кримінального покарання неповнолітнім за законодавством окремих зарубіжних країн.Обгрунтовано, що спеціальні покарання для неповнолітніх, які не пов'язані з ізоляцією, передбачаються кримінальним законодавством більшості європейських держав.Ключові слова: неповнолітній, призначення покарання, кримінальна відповідальність, осудність, покарання, злочинність, кримінально-правова політика, гуманізм, осуд, психологічні властивості

Im Rahmen des Projektes Digital REseArch Mining DREAM wird prototypisch eine Plattform zusammen mit der Smartphone App ploc entwickelt, welche die Recherche nach wissenschaftlichen Inhalten unterstützt, auf neue und potentiell interessante Open Access Inhalte hinweist, ForscherInnen außerhalb ihres Netzwerks zusammenbringt und die Möglichkeit schafft an einem transparenten Feedback-Prozess teilzunehmen. Um diese Ziele zu erreichen wird die Gebrauchstauglichkeit verschiedener Darstellungsformen im mobilen Kontext bewertet, ein Treuhandsystem auf Basis von Blockchain-Technologien realisiert und statistische Modelle für die Verarbeitung von Text eingesetzt. Die Ergebnisse des Projekts werden unter Open Source veröffentlicht. Die App richtet sich primär an ForscherInnen und Studierende, die wissenschaftliche Inhalte suchen, produzieren, oder sich stärker in ihrem Arbeitsumfeld vernetzen wollen. Leicht verständliche, von AutorInnen bereitgestellte Teaser erlauben es auch wissenschaftlich interessierten LeserInnen, wie z.B. JournalistInnen, VertreterInnen von NGOs, PolitikerInnen und UnternehmerInnen, sich über den Stand der Forschung in verschiedenen Gebieten zu informieren. Das Projekt wird vom Bundesministerium für Bildung und Forschung (BMBF) finanziert und vom Alexander von Humboldt Institut für Internet und Gesellschaft und dem FZI Forschungszentrum Informatik ausgeführt. Die Förderung erfolgt mit dem Ziel der Umsetzung innovativer Ideen zur Schaffung, Verbreitung und Handhabe von Open Access-Publikationen. Over the years, the scholarly debate about communication on the science-policy interface changed fundamentally: from simply regarding scientific advice to policy making as a linear process it shifted towards a transdisciplinary and interactive concept that includes academic experts, political decision-makers, intermediaries and non-academic societal stakeholders. This is also mirrored in the discussion about the Sustainable Development Goals. Under Sustainable Development Goal (SDG) 17 the 2030 Agenda emphasizes the role of intermediaries and postulates effective co-creative platforms for coordinating multiple stakeholders as a key means of policy implementation. This paper presents an in-depth case study of the Science Platform Sustainability 2030 (the wpn2030). It was initiated by the German scientific community in 2017 as an integral part of Germany's Sustainable Development Strategy of 2016 and developed several formats for communication on the science-policy interface. The goal of the platform is twofold: On the one hand, it sets out to strengthen broad scholarly engagement in the implementation of the 2030 Agenda/SDGs and the German Sustainable Development Strategy. On the other hand, the platform seeks to channel and mainstream scholarly input on SD into German politics more effectively. The objective of our case study is to highlight difficulties and accomplishments in setting up a platform designated to mediate the communication between researchers and political decision-makers on sustainability issues. The paper draws upon first-hand experience of developing the platform by example of one of its dialogue formats it set up together with the Sustainable Solution Development Network (SDSN) Germany: A dialog with the German scientific advisory councils. Reaching the end of the second year of its operations, the paper asks the questions whether so far, the platform was able to live up to its promise and what lessons learned can be drawn from the experience of the dialog to inform future endeavors of building and sustaining science platforms for the implementation of SD, in Germany and elsewhere.

AbstractIn this article, we examine the making of research infrastructures for digital research. In line with many scholars in this field, we understand research infrastructures as deeply relational and adaptive systems that are embedded in research practice. Our aim was to identify the relevant context factors, actor constellations, organizational settings, and strategies which contribute to the evolution of a basic service into an actual infrastructure. To this end, we conducted thirty-three case studies of non-commercial and commercial research services along the research life cycle. By examining how these services emerge, we hope to gain a better understanding of the conditions and strategies to transform a service into an infrastructure. We are able to identify competitive disadvantages for publicly financed infrastructure projects with regard to the mode of implementation and the resources invested in development and marketing. We suggest that the results of this study are of practical relevance, especially for individuals, communities, and organizations wanting to create research infrastructures, as well as for funders and policy makers wanting to support innovative and sustainable infrastructures.

In this article, we investigate the making of research infrastructures. Our aim is to identify the relevant context factors, actor constellations, organizational settings, and strategies for a mere service to become an actual infrastructure. To this end, we conducted 36 case studies of non-commercial and commercial research services. Our research sheds light on the motivations and logics behind infrastructure development and the reasons why not every service succeeds in becoming one. We believe that the results of this study are therefore of practical relevance, especially for persons and organizations that want to create and sustain research infrastructured.

Science is increasingly expected to help in solving complex societal problems in collaboration
with societal stakeholders. However, it is often unclear under what conditions this can happen, i.e., what kind of challenges occur when science interacts with society and what kind of quality expectations prevail. This is particularly pertinent for Social Sciences and Humanities (SSH),
which are part of the object they study and whose knowledge is always subject to provisionality. Here we discuss how SSH researchers can contribute to adressing societal problems, what challenges might occur when they interact with societal stakeholders, and what quality expectations arise in these arrangements. We base our argumentation on the results of an online consultation among 125 experts in Germany (representatives from SSH, learned societies, stakeholders from different societal groups, and relevant intermediaries).
