Memory and learning tragic pages of history, such as genocide and crimes against humanity, are of great importance for the future of the state. This article deals with the problem of the looted art, itsplace in the politics of memory of the Federal Republic of Germany. The problems of protection, preservation, and repatriation of the cultural heritage looted by the Nazi before and during World WarII have received new treatment in the German society. It is pointed out that Germany has extensive experience of addressing the burdensome past, it has been established how the FRG solves the problem of its overcoming, its new facets and dimensions are revealed. The German experience of the last decades in the matter of search and restitution of lost and illegally transported works of art and its value for Ukraine is analyzed. ; Вагоме значення для майбутнього країни має пам'ять та опрацювання трагічних сторінок історії, таких як геноцид та злочини проти людства. У статті розкрито проблему викраденого мистецтва, його місця в структурі політики пам'яті ФРН. Проблема захисту, збереження і повернення культурних цінностей, викрадених націонал-соціалістами напередодні та під час Другої світової війни, набула в німецькому суспільстві нового осмислення. Підкреслено, що Німеччина має значний досвід подолання обтяжливого минулого. Встановлено, в який спосіб країна вирішує проблему його подолання, розкрито її нові грані та виміри. Проаналізовано німецький досвід останніх десятиліть у справі пошуку і реституції втрачених і незаконно переміщених творів мистецтва і його цінність для України.
The article focuses on the problem of cultural values, which as a result of the World War ІІ, were scattered in the world – taken out of Germany, Austria, Poland, Ukraine, displaced or permanentlylost. There are found out the ways of how cultural values, as a result of military action, occurred in different countries-museums, private collections. The movement of cultural values due to the sale andchange of the owner far beyond the country of origin is shown, the problem of alienation of cultural values of violent way is singled out. It is drawn down the contractual-legal base, which gives groundsfor protection of cultural heritage, and it was analyzed German-Polish dialogue in the case of return and restitution of cultural values, displaced or lost during the World War ІІ. Along with the aftermathof World War II and the complexities that have to be overcome, the examples of the return of priceless paintings taken during the war are presented. The history of the picture "Lady with an ermine" andGerman-Polish dialogue on the possibilities of its return is described. This masterpiece from the Museum of Chartoryiskikh in Krakow is considered one of the most valuable pieces of Poland. The keyissues that develop and that hamper dialogue on protection of cultural values during wars and armed conflicts and also restrict their return and restitution have been revealed. ; У статті акцентавано увагу на проблемі культурних цінностей, які внаслідок Другої світової війни були розпорошені по світу – вивезені з Німеччини, Австрії, Польщі, України, переміщені або назавжди втрачені. З'ясовано, яким чином унаслідок військових дій, культурні цінності потрапили до різних країн світу – музеїв, приватних колекцій. Показано рух культурних цінностей унаслідок продажу і зміни власника далеко за межі країни походження, виокремлено проблему відчуження культурних цінностей насильницьким шляхом. Окреслено договірно-правову базу, яка дає підстави для захисту культурної спадщини, проаналізовано німецько-польський діалог у справі повернення і реституції культурних цінностей, переміщених або втрачених під час Другої світової війни. Поряд із наслідками Другої світової війни і складнощами, які ще мають бути подолані, наведено приклади повернення безцінних картин, вивезених під час війни. Описана історія картини «Пані з горностаєм» та німецько-польський діалог щодо можливостей її повернення. Цей шедевр із музею Чарторийських у Кракові вважається одним із найцінніших творів, який належить Польщі. Розкрито ключові питання, які розвивають і гальмують діалог щодо захисту культурних цінностей під час війн і збройних конфліктів, а також обмежують їх повернення і реституцію.
Preparations for the adoption of the new Law on Cultural Values Protection, its discussion and debates, that seriously puzzled the German Government, and also caused acute criticism from the representatives of the world of art are analyzed. Attention is focused on approaches to the important and quite complex in this regard issue concerning preservation of illegal movement of cultural objects that belong to the cultural heritage of the state. The main purpose of the bill is to enhance the protection of cultural property and effectively combat the illicit trafficking of them. The intentions of the Federal Government to integrate pre-existing laws in the field of cultural values into one law are very important. The main principles of the law in the new edition are protection from being sold overseas collections of state museums, including exhibits from private ownership that are in museums temporarily. It is highlighted that under current legislation, in each federal state of art and other cultural treasures, including libraries, must be entered in the register of national cultural values. These items have privileges in taxation, their export outside Germany requires special permission from the Ministry of Internal Affairs of Germany, which can be stipulated for a number of restrictions and reservations. In the article it is underlined that he XXIcentury has set new challenges and tasks for German scientists that require operational, but balanced approach in their solution. ; Аналізується підготовка нового закону про захист культурних цінностей. Його обговорення та дискусії поставили серйозні проблеми перед урядом Німеччини, а також викликали гостру критику представників світу мистецтв. Зосереджена увага на підходах до важливого і складного у зв'язку з цим завдання запобігання незаконному переміщенню об'єктів культури, які належать до низки культурного надбання держави. Головною метою законопроекту є посилення захисту культурних цінностей та ефективної боротьби з незаконною торгівлею ними. Важливими є наміри Федерального уряду з об'єднання раніше існуючих законів у сфері охорони культурних цінностей в одному законі. Основними положеннями закону у новій редакції є захист від розпродажу за кордон колекцій державних музеїв, зокрема експонатів із приватного володіння, що зберігаються в музеях тимчасово. Підкреслено, що згідно чинного законодавства, у кожній федеральній землі твори мистецтва та інші культурні цінності, включаючи бібліотеки, повинні бути внесені до реєстру національних культурних цінностей. Ці предмети користуються пільгами при оподаткуванні, їх вивезення за межі країни потребує спеціального дозволу Міністерства внутрішніх справ ФРН, яке може бути обумовлено низкою обмежень і застережень. У статті наголошується, що XXI ст. поставило перед вченими та суспільством ФРН нові виклики і завдання, які потребують оперативного, але виваженого підходу в їх вирішенні.
The article deeply analyzes the difficult thirty-year practice of the development of the Republic of Azerbaijan in the context of considering the main components that made it possible to overcome the huge crisis phenomena and challenges that called into question the very existence of the state in the first post-Soviet years, and entering the trajectory of socio-economic development and recovery. The authors argue that it is the strengthening of all state institutions, a balanced consolidating strategy of Azerbaijan studies, skillfully and quickly carried out broad economic reforms, rational approaches to attracting foreign direct investment and creating an appropriate business climate that have been and remain the engines of positive socio-economic transformations. The end of the military confrontation, the departure from the attitudes of extreme nationalism, as well as a number of unpopular measures that were taken under the firm leadership of Heydar Aliyev, were used to overcome separatism and disintegration phenomena, at the same time, human and organizational resources were subordinated to the preservation of Azerbaijan's national identity and growth public consciousness of its society. The recovery of economic growth in post-Soviet Azerbaijan is inextricably linked with the development of oil resources on the shelf of the Caspian Sea. This was facilitated by a stable domestic and foreign policy, constitutional and legal framework for the development of entrepreneurship, which allows attracting foreign direct investment in the long term. At the present stage, official Baku professes strategic goals for the formation of a socially-oriented, diversified national economy, strengthening its free market relations and the ability to self-development in the context of trends in the world economy. This is facilitated by measures to implement a long-term strategy for the management of oil and gas revenues and a program for the socio-economic development of the regions of the Republic of Azerbaijan. Consequently, the national consolidation, economic growth of Azerbaijan along with the development of the armed forces have become effective factors in the restoration of territorial integrity and the return of uncontrolled territories and their modern restoration. ; У статті ґрунтовно аналізується непроста тридцятирічна практика розвитку Азербайджанської Республіки у контексті розгляду засадничих складових, які уможливили подолання величезних кризових явищ та викликів, що ставили під питання саме існування держави у перші пострадянські роки, та виходу на траєкторію соціально-економічного розвитку і піднесення. Автори доводять, що саме зміцнення всіх державних інститутів, виважена консолідуюча стратегія азербайджаністики, уміло і швидко проведенні широкі економічні реформи, раціональні підходи щодо залучення прямих іноземних інвестицій і створення належного підприємницького клімату були і залишаються рушіями позитивних соціально-економічних перетворень. Припинення воєнного протистояння, відхід від настанов крайнього націоналізму, як і непопулярні інші заходи, які здійсненні за твердого керівництва Гейдара Алієва, були використанні для подолання сепаратизму і дезінтеграційних явищ, натомість час, кадрові та організаційні ресурси підпорядковувалися збереженню національної самобутності Азербайджану та зростанню суспільної свідомості його соціуму. Відновлення зростання економіки пострадянського Азербайджану нерозривно пов'язане з освоєнням нафтових ресурсів на шельфі Каспійського моря. Цьому сприяла стабільна внутрішня і зовнішня політика, конституційно-правові засади розвитку підприємництва, що дозволяють залучати прямі іноземні інвестиції на довготривалу перспективу. На сучасному етапі офіційний Баку сповідує стратегічні цілі щодо формування соціально-орієнтованої, диверсифікованої національної економіки, зміцнення її вільних ринкових відносин і здатності до саморозвитку в контексті тенденцій світового господарства. Цьому сприяють заходи по реалізації Довгострокової стратегії з управління нафтовими і газовими доходами та програми соціально-економічного розвитку регіонів Азербайджанської Республіки. Відтак національна консолідація, економічне зростання Азербайджану разом із розбудовою збройних сил стали дієвими чинниками відновлення територіальної цілісності і повернення непідконтрольних територій та їх сучасної відбудови.
The article is an analytical review of the evolution of historical and collective memory issues and of the development of memory studies. The analysis of the scientific achievements in the field ofmemory studies has revealed the ineffably selective nature of collective memory, in which its work for restoration of the Past is carried out according to the laws and needs of the Modernity. Thus, thepoliticization of the Past is an integral part of its functioning in the Present. In the countries of young democracy the increase of the degree of politicization of the Past is also determined by the logic of the nation-building processes. It was revealed that sacred and mythological nature of the "heroic narrative" is serving as the identification basis for the community and the "reference point" is associated with it. That is why very often the moment when "everything began" causes the deployment of "wars of memory" around them. In the context of globalization the "war of memory" goes beyondnational borders and turns into a factor of interstate relations. It is found that in the modern world in the field of memory politics a global consensus has already been formed, and it is based on theprinciples of the universality of human rights, freedom and democracy. This causes a change in the earlier memory narratives, which were based on images of victories and triumphs, by the narratives ofhistorical trauma and sacrifice. ; Стаття є аналітичним оглядом еволюції проблематики історичної й колективної пам'яті та розвитку меморіальних досліджень. Аналіз наукових здобутків меморіальних досліджень виявив неусувно селективний характер колективної пам'яті, за якого її робота з відновлення минулого здійснюється за законами сучасного і відповідно до його потреб. Таким чином, політизація минулого залишається невід'ємним складником його функціонування в сучасному. У країнах молодої демократії підвищення ступеню політизації минулого зумовлено ще й логікою розгортання націєтворчих процесів. Виявлено, що сакрально-міфологічна природа «героїчного наративу», який слугує ідентифікаційною основою для спільноти, і пов'язаної з ним «точкивідліку», того моменту, коли «все почалося» зумовлює розгортання навколо них «війн пам'яті». В умовах глобалізації «війни пам'яті» виходять за національні межі й перетворюються начинник міждержавних відносин. Встановлено, що в сучасному світі в царині політики пам'яті уже сформовано глобальний консенсус, в основі якого – принципи універсальності прав людини,свободи і демократії. Останнє зумовлює зміну панівних раніше наративів пам'яті, заснованих на образах перемог і тріумфів, наративами історичної травми й жертовності.
