The text intends to investigate and clarify the salient aspects and limits of a possible and barely deepened relationship of proximity between H. Plessner and C. Schmitt regarding the interpretation and use of the friend/enemy dichotomy. One of the goals is to show that, although in his text of 1931 Political Anthropology Plessner tries to ground political anthropology by explicitly referring to the friend/enemy dichotomy as it was formulated by Schmitt, he develops this dualism in the light of the opposition between "familiar" and "foreign." This development leads Plessner, beyond Schmitt's aims, to the problematization of intersubjectivity and the possibility of "Euro-excentrism."

The processes of claims on the imprescriptibility of crimes against humanity in Latin America have in recent decades involved an advance in guaranteeing justice for victims of serious human rights violations in recent military dictatorships. But this progress in the criminal area has not been accompanied by judicial measures that allow civil claims to the perpetrators of serious crimes and particularly the State as institutional responsible for the state agents who committed them. The unenforceability of civil actions under the new State responsibility regime in Argentina raises new debates on its legal regulation, in accordance with the international obligations assumed by the State. ; Los procesos de reclamación sobre imprescriptibilidad de delitos de lesa humanidad en el ámbito latinoamericano han implicado en las últimas décadas un avance en la garantía de justicia para las víctimas de graves violaciones a derechos humanos en las últimas dictaduras militares. Pero ese avance en el ámbito penal no ha sido acompañado con medidas judiciales que habiliten reclamaciones civiles a los autores de los graves crímenes, y particularmente al Estado como responsable institucional de los agentes estatales que los cometieron. La imprescriptibilidad de las acciones civiles en el marco del nuevo régimen de responsabilidad de Estado en Argentina plantea nuevos debates sobre su regulación legal, acorde con las obligaciones internacionales asumidas por el Estado.

The guidelines of the Washington Covenant in the 90s, involved the political and economic transformation of the Latin American states due to the liberalization of the economy, government reform, deregulation and privatization. Following these guidelines, the term "foreign investment" became an imperative for economic growth and development, so that the states to achieve such purposes resorted to bilateral solutions, modifying national legislation and signing Bilateral Investment Treaties (bit). The incorporation of a series of protection standards as fair treatment, expropriation clauses, most favored nation, as a condition for the participation of foreign investors in the public services of the states, are a clear example of this new reality. La incorporación de una serie de estándares de protección como trato justo, cláusulas de expropiación, de nación más favorecida; como condición para la participación de inversores extranjeros en la prestación de servicios públicos de los Estados son un claro ejemplo de esta nueva realidad.
