In ihrem Beitrag stellt die Verfasserin eine von ihr gefertigte annotierte Übersetzung des Gesetzes betreffend das "close-out netting" bei Finanztransaktionen zwischen Finanzinstituten vor. Das Gesetz ist Teil der japanischen Antwort auf die internationale Diskussion über "safe harbour"-Regelungen in Insolvenzen, welche die Abwicklung von finanziellen Transaktionen sichern, die andernfalls im Rahmen eines förmlichen Insolvenzverfahrens nichtig wären. Das Gesetz war Teil der sog. "Big Bang"-Finanzreform, die Ende der 1990er Jahre in Japan durchgeführt wurde. In ihrer Kommentierung analysiert die Verfasserin unter anderem die Ursachen, die zur Verabschiedung des Gesetzes führten, wozu sie neben einem internationalen Trend und einer generellen Harmonisierung der Finanzmärkte auch die Sorge der japanischen Regierung zählt, die im Zuge der Deregulierung des japanischen Finanzmarktes erwarteten neuen Finanzprodukte für den breiten Markt regulatorisch in den Griff zu bekommen. Ferner werden das Zusammenspiel zwischen diesem Gesetz und den allgemeinen Insolvenzgesetzen beleuchtet und schließlich die potentiellen Auswirkungen der Regelung auf den Markt mit Blick auf repurchase agreements (Repo-Geschäfte) und die globale Finanzkrise diskutiert, welche die Aufmerksamkeit auf "safe harbour"-Regelungen gelenkt hat. ; In this article I provide an annotated English translation of the Japanese Act concerning close-out netting of specified financial transactions undertaken by financial institutions etc ("Act"). The Act forms part of Japan' response to the debate about bankruptcy safe harbour provisions, which save transactions which may otherwise be void in a formal insolvency proceeding. The Act was part of the Big Bang financial reforms introduced in Japan at the end of the 1990s. As part of my commentary on the Act I discuss the drivers for its introduction, which included harmonization and international trends, and concerns about financial regulation of new financial products aimed at a wider audience in the post-Bang, deregulated environment. I also consider the interaction of the Act with Japan's formal insolvency proceedings. Finally, I analyse the potential market implications of the Act in light of repurchase agreements and the global financial crisis, which focused attention on bankruptcy safe harbour provisions.

The economic fallout of the COVID-19 pandemic prompted many governments to provide emergency payments to citizens. These one-off and recurring payments revealed the shortcomings of existing financial infrastructures even as electronic payments replaced cash for everyday expenses. Delays in getting government payments to citizens in many countries focused attention on the potential benefits of central bank digital currencies (CBDCs). This article outlines the social and economic policy choices involved in designing a CBDC and the consequences of these choices for privacy. Priorities including preventing the criminal abuse of the financial system, geopolitical concerns and private sector innovation compete with, and potentially undermine, privacy. We identify and categorize four key privacy risks as 'losses' associated with current CBDC models: loss of anonymity, loss of liberty, loss of individual control, and loss of regulatory control.

Der Beitrag untersucht eine wichtige Entwicklung im gegenwärtigen japanischen Wahlrecht. Es geht um die Absenkung des Wahlalters von 20 auf 18 Jahre, damit junge Menschen aktiv an allgemeinen Abstimmungen und Wahlen teilnehmen können. Die Absenkung des Wahlalters ist untrennbar mit dem Vorhaben der LDP, die japanische Verfassung zu reformieren, verbunden. In einer eingehenden Analyse des Gesetzgebungsverfahrens und der einschlägigen parlamentarischen Debatten zeigt der Beitrag jedoch, dass die angestrebte Verfassungsreform nicht der einzige Grund für die Wahlrechtsreform war. Die Reformer hatten auch internationale Standards, demographische Ungleichgewichte und sinkende Wahlbeteiligungen im Blick. Die erste allgemeine Wahl, die im Jahr 2016 nach Inkrafttreten der Reform abgehalten worden ist, hat allerdings die bestehende Vormachtstellung der LDP trotz Berichten über eine in der Bevölkerung weit verbreitete Unzufriedenheit mit vielen Aspekten ihrer Politik noch weiter verstärkt. (Die Redaktion) ; This article examines an important development in contemporary electoral law in Japan: the lowering of Japan's eligible referendum and election voting age from 20 to 18 years old. The lowering of the voting age is inextricably linked to the LDP's agenda of constitutional reform in Japan, but the article's detailed examination of the processes and debates which led to the voting age reforms shows that this agenda was not the sole driver; reformers were also concerned about global norms, demographic imbalances and declining voter participation and turnout rates. The first election after the reforms held in July 2016, however, further cemented the Liberal Democratic Party's dominance, despite reporting of widespread dissatisfaction with many of its policies, and possibly paves the way for controversial constitutional amendments.

Der Beitrag ist die erste detaillierte Untersuchung der "Richtlinien für die außergerichtliche Novation bei Einzelschuldnern" (fortan: Richtlinien) und ergänzt eine vorläufige Übersetzung der japanischen Originalversion ins Englische durch die Autoren. Unmittelbarer Auslöser für die Veröffentlichung der Richtlinien im August 2011 war die sog. "Doppelkreditkrise", womit die Lage bezeichnet wird, in der sich einige Opfer des großen Erdbebens in Ostjapan befinden, die der doppelten Belastung ausgesetzt sind, bestehende Kredite zurückzahlen zu müssen und sich gleichzeitig um Mittel für ihren Lebensunterhalt und zum Wiederaufbau ihrer Unternehmen und Eigenheime bemühen müssen. Die Richtlinien sind darauf angelegt, natürlichen Personen (kojin) die Überwindung solch harter finanzieller Umstände zu erleichtern. Sie wurden rasch geschnürt und gelten seit dem 22. August 2011, aber bauen auf anderen, in Japan bestehenden außergerichtlichen Verfahren auf, die sich mit der Insolvenz von Unternehmen befassen, einschließlich der "Richtlinien für die außergerichtliche Novation bei Gläubigermehrheit" (fortan: Unternehmensrichtlinien), des Verfahrens von Japans "Industrial Revitalization Commission" und der "Enterprise Revitalization ADR Procedure". Red.) ; This article presents the first detailed English-language analysis of the Guidelines for Individual Debtor Out-of-Court Workouts ('Guidelines') and complements a tentative translation of the original Japanese version translated into English by the authors. The immediate catalyst for the publication of the Guidelines in August 2011 was the socalled 'double loan crisis', which refers to the situation where some victims of the Great East Japan Earthquake are suffering from the double hardship of paying out existing loans whilst seeking new finance to rebuild lives, businesses and homes; the Guidelines are designed to help individuals (kojin) overcome such financial hardship. The Guidelines were pulled together very quickly and commenced operation on 22 August 2011, but they build on other established out-of-court procedures in Japan dealing with corporate insolvency, including the Guidelines for Multi-Creditor Out-of-Court Workouts ('Corporate Guidelines'), the operation of Japan's Industrial Revitalization Commission and the Enterprise Revitalisation ADR Procedure. The procedure and wording of the Guidelines are closely based on the Corporate Guidelines with amendments to reflect the Guidelines' focus on personal insolvency and dealing with the aftermath of a disaster. The article gives a detailed commentary of the Guidelines' provisions and compares them to existing formal Japanese insolvency procedures. The Guidelines reflect typical Japanese legislative drafting techniques and the variety of opinions held by the diverse group of drafters. Some issues may have been controversial for the drafters to provide final and definitive pronouncements, and others may have been left deliberately ambiguous to allow market participants the chance to adapt the Guidelines to individual cases. The article also examines the drivers and stakeholders which led to the Guidelines' creation, and argues that their limited success is not just due to a failure in public relations. The government estimated that up to 20,000 people might be eligible for the Guidelines, but very few people have benefited from the Guidelines. Only 300 individual plans were filed in the first 12 months of the Guidelines operation, despite over 2000 consultations being facilitated. The article examines the current status and operation of the Guidelines and argues that these types of informal mechanisms have an important role to play in a functioning insolvency regime, despite some initial teething problems. They also provide additional flexibility to Japan's modern insolvency procedures and reflect global trends for dealing with debtors in financial hardship. Japanese courts are also building on a tradition of flexibly resolving practical issues arising out of specific insolvency circumstances, which should lead to better outcomes for disaster victims. Creditors have little to lose in utilising the Guidelines given that they are under no legal obligation to consent to any debt reduction or release, but there is anecdotal evidence that financial institutions are individually negotiating workouts directly with debtors and obtaining terms more favourable to the institutions than what they might otherwise achieve under the Guidelines. Financial institutions may find themselves under social and political pressure to highlight the existence of the Guidelines to disaster victims and agree to more payment plan proposals in future.

This set of articles in this special issue illustrate a number of ways that the realities of a global pandemic may challenge different perspectives on privacy protection and the appropriate relationship with other rights and responsibilities. They arose from a virtual roundtable, held on 15 June 2020 at Melbourne Law School, under the aegis of the Privacy and Pandemics Information Network. The network was formed as a rapid response to the overwhelming number of privacy issues being raised almost simultaneously by, or as a result of, the various government and private actor attempts to deal with COVID-19 in Australia and around the world.

In the twenty-first century, the concept of internationalisation remains a crucial tool for understanding the dynamics of globalising processes. It draws attention to the dimensions of conscious action in inter- and trans-national phenomena, connecting globalisation with individuals' experience of everyday life. AbstractThis article highlights reliance on lay participation as a mechanism for solving perceived problems in Japanese criminal justice by examining three reforms aimed at increasing lay participation in Japanese criminal justice: the mandatory prosecution power given to Prosecution Review Commissions, thesaiban'in seido(lay-judge system), and Penal Institution Visiting Committees. The article argues that lay participation plays an important role in legitimizing aspects of the current system. Despite the Nagoya Prison Scandal in 2002–03, Japan's extraordinary achievements in order inside prisons have been maintained and citizens are comforted that the system has oversight by Visiting Committees. Although PRCs andsaiban'in seidorepresent a more open approach to eligibility and selection than Visiting Committees, they too help to legitimize existing structures. The article concludes by considering challenges to the continued reliance on lay participation in Japan including reform fatigue, the demographic crisis, the impact of geography, and technological developments.
