A proposito di uso politico della paura
Qualche riflessione su una delle tante possibili declinazioni del tema della 'paura' mi è stata suggerita da un convegno sulle mobilitazioni di piazza, che ha avuto per fili conduttori la 'piazza' come «punto di partenza per una nar- razione del basso della storia d'Italia» e la ricerca «dell'interazione fra 'piazza' e istituzioni».Il nesso tra i due diversi ambiti tematici appare evidente se si considerano i nodi posti al centro del Laboratorio di storia del penale e della giustizia. Paura/e e, in particolare, il cosiddetto 'principio di precauzione' che, nell'at- tualità, come nel passato, consente e ha consentito «a lobbies o agli stessi Stati» di «focalizzare le opinioni pubbliche su allarmi che si presume possano generare consenso» per evocare proprio sulla base di tali allarmi l'esigenza di «protezione».L'"uso politico" della paura è fenomeno ben noto nel passato come nel presente e siamo purtroppo abituati alla ricorrente strumentalizzazione in tanti Stati del mondo di paure talvolta effettive, talvolta, invece, indotte dalla propaganda delle opposizioni oppure dai 'discorsi' della politica allo scopo di ottenere consensi per l'introduzione o il rafforzamento di progetti di riforma, per non dire di investimenti pubblici (basti pensare al muro sul confine del Messico ideato dall'attuale presidente degli USA). La maggiore difficoltà consiste, invece, nel decifrare quanto determinate paure siano condivise da governi e società, e quanto, al contrario, si verifichi, da questo punto di vista, un deciso «scollamento» tra Stato e societa.

Judging and settling disputes in the Middle Ages
The period between the 11th and 12th centuries is usually indicated as an age of transition from the early to late Middle Ages. The paper aims at focusing on the continuities and discontinuities in this time, and specifically on how the search for new models and new procedures for the administration of justice played a 'constitutional' role, just as it would in many other historical eras to follow. From this perspective, the emergence of positiones in the judicial practices and in the ordines iudiciorum provides an interesting point of view in order to investigate, on one hand, whether the parties were more interested to go to trial or to settle their disputes by negotiations, and, on the other hand, to understand the legal policy of the medieval governments between two conflicting interests: to ensure justice ascertaining the truth and to re-establish peace through arbitration procedures and avoid malicious litigation which might slow down the course of justice. ; Il periodo compreso tra 11 e 12 secolo è normalmente indicato come età di transizione tra alto e basso medioevo. Lo scritto intende mettere a fuoco gli elementi di continuità e di discontinuità di questo periodo soprattutto con riguardo al fatto che la ricerca di nuovi modelli e di nuove procedure per l'amministrazione della giustizia giocò un ruolo 'costituzionale', non diversamente da quanto avvenuto in altri periodi successivi. In questa prospettiva, l'emergere delle positiones nelle prassi giudiziarie e negli ordines iudiciorum offre un interessante punto di vista per verificare, da un lato, se le parti fossero più interessate a andare in giudizio o a risolvere le loro controversie in via negoziale; dall'altro per comprendere la politica giudiziaria degli ordinamenti medievali tra due interessi tendenzialmente contrastanti: quello di assicurare giustizia con l'accertamento della verità e quello di ristabilire la pace sociale tramite arbitrati evitando così con l'abuso del processo il rischio di rallentare la giustizia. ; Ciencias Religiosas ; Derecho

The book Riflessioni interdisciplinari per un dibattito contemporaneo su violenza, ordine, sicurezza offers an interesting interdisciplinary perspective on aspects of the social life that undoubtedly show continuity between past and present and that exert a strong influence on criminal systems. If fear, as an instinct, constitutes a natural defense tool for the individual, 'collective' fear is a phenomenon open to different declinations, not all positive, as we will see, for example, in the current hypertrophy of the criminal law. Sometimes collective fear is triggered by objective causes (e.g. by natural catastrophes, epidemics, famines, wars or revolutions); sometimes, instead, collective fear is generated by the so called 'culture of fear'. Such culture instills and amplifies a sense of insecurity towards true or presumed enemies by using propaganda, rhetoric or violence (just think at the 'function' of terrorism). This insecurity, in turn, drives people to search safety and strengthens the power of those who offer protection even with the tools of the criminal law.

The Double Effect of COVID-19 Confinement Measures and Economic Recession on High-Risk Drug Users and Drug Services

The ongoing COVID-19 pandemic is likely to have a profound impact on the lives of high-risk drug users and on the services responding to their needs in at least two important ways: first, through the restrictive measures introduced to mitigate the spread of the virus and, second, as a result of extensive economic downturn. Currently there is great uncertainty as to the future intensity and duration of the pandemic. In addition, the lessons we have been able to learn from previous economic downturns may be of limited applicability to the current situation, which differs in a number of significant respects. Experience nevertheless suggests that the potential consequences for drug users' health and well-being may be severe. The ongoing uncertainty serves to underline the importance of close monitoring of the drug situation and preparing flexible and innovative solutions to be able to meet new challenges which may arise.
