The witness whereof and the implementation of its functions in the civil process ; Місце свідка та реалізація його функцій в цивільному процесі
The article describes procedural characteristics of witness, the procedure for his involvement in trial, testimony and special features of implementation of these procedures through the provisions of Ukrainian legislation. The legislative norms governing the range of procedural actions related to a witness on the basis of the theory of law and from the point of view of judicial practice are analyzed. It is concluded that the development of the institution of witnesses should take into account the combination of the experience of national judicial practice and the experience of foreign countries. ; У статті описано процесуальну характеристику свідка, порядок його залучення до судового процесу, давання показань та особливості реалізації цих процедур через положення українського законодавства. Визначена роль свідка як суб'єкта цивільного процесу. Проаналізовано законодавчі норми, що регулюють коло процесуальних дій пов'язаних з особою свідка з урахуванням теорії права та з точки зору судової практики. Зроблено висновок, що розвиток інституту свідків повинен відбуватися з урахуванням поєднанні досвіду національної судової практики та досвіду зарубіжних країн.
