A description of 20th cent econ & pol'al discrimination against Chinese minorities in South Vietnam, Cambodia, Thailand, Indonesia, the Philippines & Malaya; the history of Chinese immigration to South-East Asia is sketched, & the rise of nat'lism & racialism in modern South-East Asia is discussed. It is concluded that the majority of Chinese in the area no longer wish to support Communist China or Taiwan (Formosa) at the price of antagonizing the local pop's. In Thailand, Cambodia, Vietnam, & Burma, the possibilities of assimilation are real & the necessity for it even greater. If native xenophobia does not drive the Chinese too hard, they will assimilate. In Indonesia, & to a lesser extent in the Philippines, the future of the Chinese is no longer in their own hands. In Malaya, they seem to have reached a stable accommodation based on the acceptance of 2nd-class citizenship, provided the econ situation does not deteriorate. Modified AA.

Ausgehend von einem Überblick über die chinesische Rechtsgeschichte (Zeit der Streitenden Reiche bis Ende des Kaiserreiches) mit ihren durch konfuzianische Ethik- und Moralprinzipien geprägten, stark personalisierten, aber kaum kodifizierten Rechtsvorstellungen, erläutern die Autoren die Rechtsentwicklung in der Yanan bzw. Bürgerkriegsphase (1911-1949: Rezeption europäischer Rechtsideen, "6 Gesetzbücher der Kuomintang"), um schließlich das Rechtssystem der VR China näher zu beleuchten. Untersucht werden in diesem Kontext die Organe, Funktionen und Kompetenzen der Legislative und Judikative, die ideologischen und politischen Hemmnisse einer Systematisierung und Kodifizierung des chinesischen Rechts, die Situation des Strafrechts und des Strafprozeßrechts, des Zivil- bzw. Wirtschaftsrechtsektors sowie der Rechtswissenschaft (Rechtstheorie/Rechtslehre) in der Phase der Reform (Stand: 1987). BIOst-Hml)
