Abstract: This article presents the first results of a research into the applications of a vague notion to which contemporary Chinese law has been making widespread recourse: the notion of heli, usually translated into English as 'reasonable'. The author analyses it in statutory law, judicial interpretations, and linguistic uses in a 'law and language' perspective.
Résumé: La présente contribution présente les premiers résultats d'une recherche sur les applications d'une notion vague à laquelle le droit chinois contemporain a largement recouru : la notion de heli, traduit habituellement par « raisonnable ». L'auteur l'analyse dans les textes de lois, dans les interprétations juridiques et dans les usages linguistiques dans une perspective de « droit et langage ».
Zusammenfassung: Dieser Beitrag präsentiert die ersten Ergebnisse einer Untersuchung über die Anwendbarkeit eines unbestimmten Begriffs, auf den das heutige chinesische Recht umfassend zurückgegriffen hat: den Begriff heli, der gewöhnlich als angemessen in die englische Sprache übersetzt wird. Der Autor untersucht diesen Begriff im kodifizierten Recht, der juristischen Auslegung und seiner linguistischen Verwendung aus der Recht und Sprache Perspektive.
