This article is the first one to offer an investigation, from a biological perspective, of "natural philia" or "kin-based" philia (commonly translated as "friendship") in Aristotle's practical philosophy. After some preliminary considerations about its place in Aristotle's ethical treatises, the discussion focuses on Aristotle's biology. Here we learn that natural philia, couched in terms of a biological praxis rather than a trait of character, is widespread in the animal kingdom, although in different ways and to varying degrees. To account for such differences, Aristotle establishes a Scala Philiae in two different biological texts—Historia Animalium and Generation of Animals—where natural bonds in animals are classified in view of their strength and duration. Each level of Aristotle's Scala is examined. Finally, the argument returns to Aristotle's ethical and political texts, drawing greater attention to the biological mechanisms that underlie natural philia in human beings. I conclude that natural philia provides one fundamental biological building-block of Aristotle's ethics and politics.

AbstractThis paper provides a new interpretation of Plato's account of justice as psychic health in Republic IV. It argues that what has traditionally been considered to be one single analogy is actually a more complex line of reasoning that contains various medical analogies. These medical analogies are not only different in number but also in kind. I discuss each of them separately, while providing a response to various objections.

El alimentario es un litigante privilegiado que a pesar de las múltiples reglas procesales a su favor no logra, en muchos casos, el pago de la deuda. Este análisis demuestra que de acuerdo con la legislación chilena vigente el juez de familia puede ordenar el pago de los alimentos con los fondos previsionales del alimentante. Para acudir a esta forma de pago es necesario, desde un punto de vista general, emplear la analogía y descartar que se trate de una sanción para el alimentante y, en concreto, realizar una serie de distinciones relevantes tanto en el ámbito de la regulación previsional como familiar para fijar los límites de esta forma de pago en el juicio de alimentos.

Summary The role of rules of probative weight is to introduce a hierarchy among the available evidence when taking a decision. That article refutes the two premisses of the argument that those rules are an unjustified privilege for the State administration, when it uses rules which attribute probative value to audit reports and other evidence in the context of its power to impose penalties. Those premisses are, on the one hand, an application — whether indiscriminate or nuanced — of criminal guarantees to administrative proceedings and, on the other hand, conceptual confusion between those rules and other categories of evidence, such as presumptions, the burden of proof and the rules of corroboration. This work shows that the two scenarios are not supported, since the first premiss depends on a political issue which is still open to debate — and which now seems to be inclined towards a design of guarantees specific to the administrative headquarters — while the latter reveals a categorical imprecision between different dogmatic figures, which originates from the Chilean legislation itself. In addition to the above, the work shows how the risks posed by the use of these weight-of-evidence rules can be controlled in the context of the administration's procedural privileges. ; Resumen La función de las reglas de peso probatorio es introducir una jerarquía entre las evidencias disponibles a la hora de tomar una decisión. Este artículo refuta las dos premisas de la tesis que sostiene que estas reglas son un privilegio injustificado para la Administración del Estado, cuando ella se vale de reglas que les asignan fuerza probatoria a las actas de fiscalización y a otros elementos de juicio en el marco de su potestad sancionadora. summary: Maintenance is a privileged litigant which, despite the many procedural rules in its favour, does not, in many cases, enable payment of the debt. This analysis shows that, in accordance with the Chilean legislation in force, the family judge may order maintenance to be paid from the feeder's pre-retirement funds. In order to have recourse to this form of payment, it is necessary, from a general point of view, to use the analogy and to rule out the possibility that it is a penalty for the maintenance farmer and, in particular, to make a number of relevant distinctions in both the pre- and family-related regulations in order to set the limits for this form of payment in maintenance proceedings. ; Resumen: El alimentario es un litigante privilegiado que a pesar de las múltiples reglas procesales a su favor no logra, en muchos casos, el pago de la deuda. RESUMEN: The prohibition on acting against its own act is a typical scenario of infringement of good faith in proceedings, the content and limits of which have not been defined by Chilean law. This article analyses the two interpretations — one broad and the other restricted — that touch upon civil case law with regard to this duty of consistency and the way in which they affect the parties' rights of defence. The text distinguishes between a secondary application (obiter dicta) and a residual application of that duty, the latter being a judicial review of the legal arguments of the litigant in the event of abuse, deception and manifestly delaying actions. The procedural effect of breaching that duty is the inadmissibility of the inconsistent act. This effect is compatible with other specific measures, such as the payment of costs and compensation for damage caused. ; RESUMEN: La prohibición de ir contra acto propio es un escenario típico de infracción a la buena fe procesal, cuyo contenido y límites la ley chilena no ha definido. Este artículo analiza las dos interpretaciones -una amplia y otra restringida- que cobija la jurisprudencia civil respecto de este deber de coherencia y la manera en que ellas inciden en el derecho de defensa de las partes. El texto distingue entre una aplicación secundaria (obiter dicta) y una aplicación residual de este deber, siendo esta última un control judicial de la argumentación jurídica del litigante ante situaciones de abuso, engaño y actuaciones manifiestamente dilatorias. El efecto procesal de infringir este deber es la inadmisibilidad del acto incoherente. Este efecto es compatible con otras medidas específicas, como el pago de las costas y la indemnización de los daños causados.
