Gelişen uluslararası hukuk sisteminde istanbul ve çanakkale boğazları ile marmara denizi
ÖZETGELİŞEN ULUSLARARASI HUKUK SİSTEMİNDEİSTANBUL VE ÇANAKKALE BOĞAZLARIİLE MARMARA DENİZİTürk Boğazları, geçmişte olduğu gibi 21.yüzyılın başlarında da jeostratejik, askeri, ekonomik ve siyasal önemini muhafaza etmektedir. Bunun en önemli nedeni, SSCB'nin dağılmasıyla ortaya çıkan Kafkas Ülkeleri'nin sahip olduğu petrol rezervlerinin, uluslararası pazarlara Boğazlar kanalıyla açılmasıdır. Burada iki sorun ortaya çıkmaktadır. İlki Boğazlar ve İstanbul'un çevresel güvenliğinin zedelenmesi, ikincisi ise ABD'nin Karadeniz'deki ticareti güvene almak için burada asker bulundurmak istemesidir. Bu çalışmayla, Cumhuriyet dönemindeki Boğazlar'a ilişkin antlaşmalar ve uluslararası kritik gelişmeler incelenerek; Türkiye'nin Boğazlar sorunun kaynağı tespit edilmeye çalışılmıştır. Sorunun sebebi Montrö Antlaşması'nın yetersiz kalması gibi görünsede, aslen bu Antlaşma'nın; Türkiye'nin 'Askeri Güvenliğini' ve Karadeniz'deki 'Uluslararası Güçler Dengesini' sağladığı görülmüştür. Ayrıca Montrö Rejimi'nin, bir önceki Lozan Antlaşması'nda ve 1982 BM Hukuk Konvansiyonu'nda belirlenen rejimlerden, Türkiye lehine üstün olduğu belirlenmiştir. Sonuç olarak Türkiye'nin Çevresel Güvenlik problemlerinin, atılmayan somut adımlardan kaynaklandığı, bu alanda hükümet destekli çalışmaların sürekli olmasının sorunları çözümleyeceği anlaşılmıştır. Bunun en güzel örneği ise şu anda uygulanan Türk Boğazları Deniz Trafik Düzeni Tüzüğü ve onu destekleyen Gemi Trafik Yönetim ve Bilgi Sistemi'dir. ABSTRACTTHE TURKISH STRAITS AND SEA OF MARMARA IN THE DEVELOPING INTERNATIONAL LAW SYSTEMTurkish Straits keep their geostrategic, military, economic and political importance at the beginning of 21st century as it was in the past. Because, reserves owned by Caucasian countries, which appeared after Soviet Russia was collapsed, were opened to international markets through straits. There are two problems arising: First one is damaging environmental safety of the Straits and Istanbul and the second one is USA's desire of deploying its army there to ensure the trade in Black Sea Region. The source of Turkey's Straits problem is tried to be found by examining the contracts related to the Straits and international critical developments of the Republic. Even if the reason of the problem is seen as the deficiency of Montreux Convention, actually this Convention ensured Turkey's Military Security and 'International Balance of Powers' in Black Sea Region. Furthermore, Montreux Regime was determined to be superior in favor of Turkey over the regimes determined in Lausanne Convention and 1982 UN Law of the Sea Convention. Consequently, Turkey's environmental security problems result from concrete steps that are not taken. The continuity of government-supported activities will solve the problems in this field. The best example is the Turkish Straits Maritime Regulation which is in use now which is supported by the Vessel Traffic Management and Information System.
