Political participation of immigrants in Poland. The case of foreigners' activity in the local government elections in 2014 and 2018
The issue of political participation of immigrants in Poland is becoming current and is worth reconsidering by the state authorities because of the growing number of immigrants settling in Poland. Due to the structure of immigration to Poland, characterized by the dominance of immigrants coming from outside the European Union, these issues are not subject to EU regulations that apply only to EU citizens. It is an open question whether the Polish authorities will take action to extend certain political rights to immigrants from third countries who have moved the center of their life activities to Poland. The article discusses the issue of political participation of immigrants in Poland on the example of their activity in local elections in 2014 and 2018. The research objective is to identify the key determinants of electoral participation of foreigners and to analyze the data of the National Electoral Commission, showing the actual degree of use by immigrants living in Poland of their electoral rights at the local level (the right to vote and the right to stand for election). The conducted analysis aims to reveal formal and practical possibilities as well as barriers and challenges, especially of a systemic nature, in the field of electoral participation of immigrants in Poland, both those who already have such rights and those who could obtain these rights.
Streszczenie
Zagadnienie partycypacji politycznej imigrantów w Polsce nabiera aktualności i warte jest ponownego rozważenia przez władze państwowe wraz z rosnącą liczbą imigrantów osiedlających się w Polsce. Z uwagi na strukturę imigracji do Polski, charakteryzującą się dominacją imigrantów pochodzących spoza Unii Europejskiej, kwestie te nie podlegają regulacjom unijnym, odnoszącym się wyłącznie do obywateli UE. Otwartym pozostaje pytanie czy polskie władze podejmą działania w kierunku obejmowania wybranymi prawami politycznymi także imigrantów z krajów trzecich, którzy przenieśli centrum swojej aktywności życiowej do Polski. W artykule podjęty został temat partycypacji politycznej imigrantów w Polsce na przykładzie ich aktywności w wyborach lokalnych w 2014 i 2018 r. Jego zasadniczym celem badawczym jest identyfikacja kluczowych uwarunkowań partycypacji wyborczej cudzoziemców oraz analiza danych Państwowej Komisji Wyborczej, ukazujących rzeczywisty stopień korzystania przez cudzoziemców mieszkających w Polsce z przysługujących im praw wyborczych na poziomie lokalnym (prawa wybierania i prawa do kandydowania). Przeprowadzone analizy posłużyły ujawnieniu możliwości, barier i wyzwań, formalnych i praktycznych, zwłaszcza natury systemowej, w zakresie partycypacji wyborczej imigrantów w Polsce, zarówno tych, którym takie prawa już przysługują, jak i tych, którzy prawa te mogliby uzyskać.
Polityka Unii Europejskiej wobec nieregularnej imigracji

Zapobieganie i zwalczanie nieregularnej imigracji było jednym z zasadniczych celów unijnej polityki imigracyjnej, od uzyskania przez UE kompetencji w tej dziedzinie. I chociaż na gruncie tej polityki imigracja nieregularna definiowana jest szeroko i obejmuje zjawiska dotyczące nielegalnego wjazdu, tranzytu oraz pobytu imigrantów w państwach członkowskich, UE zdecydowanie skoncentrowała swoje wysiłki na eliminowaniu nielegalnego wjazdu. W tym celu podejmowano działania w obszarach bezpośrednio z tym związanych, jak zwalczanie przemytu i walka z handlem ludźmi, a także takich, które stopniowo wykształciły własną logikę polityk szczegółowych jak: zarządzanie granicami zewnętrznymi, polityka wizowa czy polityka azylowa. Oznaczało to, że od początku aktywność UE wobec imigracji nieregularnej była rozproszona i stanowiła elementy kilku szczegółowych polityk, strategii i planów działania. Kryzys migracyjny lat 2015–2016 jedynie nieznacznie zweryfikował unijne podejście do nieregularnej imigracji. Priorytetem nadal pozostało eliminowanie nieregularnego wjazdu poprzez walkę z przemytem (prowadzoną środkami kontroli granic zewnętrznych z wykorzystaniem nawet instrumentów polityki bezpieczeństwa i obrony), przy wzmocnieniu wysiłków na rzecz drugiego celu, jakim stało się zwiększenie realizacji powrotów imigrantów, którzy nie uzyskali zgody na pobyt w państwach członkowskich. Ponadto, unijna uwaga w większym stopniu została też zwrócona w kierunku eliminowania pierwotnych przyczyn nieregularnej imigracji. W tym zakresie UE postawiła przede wszystkim na różne instrumenty polityki zewnętrznej, by współpracować z krajami pochodzenia i tranzytu imigrantów.
Challenges Related to Defi ning Irregular Immigration, Including the Way of Its Interpretation in EU Immigration Policy

The aim of the article is to show the challenges in scholarly attempts to conceptualize the phenomenon of irregular immigration. Although this type of migration has been of interest to scholars for several decades, it still requires in-depth analysis to better explain and understand its causes, scope, and consequences. The article attempts to clarify the nature of irregular immigration, indicating both the general ways of defi ning this phenomenon and the process of shaping it in socio-political reality since the end of the 19th century. The analysis reveals the internal diversity, dynamism, and ambiguity of this type of migration, which developed in parallel with the control instruments implemented by the states, aimed at enforcing increasingly complex immigration regulations conditioning the entry, stay and work of immigrants. The presented theoretical reflection on the complexity and the heterogeneity of irregular immigration is then confronted with the interpretation of this phenomenon in the EU immigration policy. Another important complement to these studies is to show the terminological challenges that have emerged in previous studies on irregular immigration. They are important both for the objectifi cation of theoretical investigations and for an empirical analysis of this social phenomenon.
Nielegalna czy nieregularna imigracja? Analiza wyzwań definicyjnych ze szczególnym uwzględnieniem polityki imigracyjnej UE

Schengen jako wyzwanie dla teorii integracji europejskiej

The aim of the article is to present the possibility of conceptualising of a significant, unclear, and difficult to explain European integration phenomenon called Schengen. Presenting the ambiguous definition of Schengen and the effects of literature review, the article shows the deficit of in-depth analyses of this sphere of European integration. To overcome this problem, theories of European integration are helpful. Based on these theories, the article presents three major levels of theorising on which Schengen can be conceptualised. At each of these levels, this issue will be analysed in a different way as: a special example of European integration, a model of European territoriality and a project of border governance in Europe. Each of these approaches has its separate theoretical framework and assumptions, uses a different conceptual apparatus and formulates different research questions.

Counteracting Irregular Migration in the European Union as a Priority of Poland's Position on the New Pact on Migration and Asylum

The analysis aims to reconstruct, explain and evaluate the position of the Polish government on the essential elements of the EU migration and asylum policy proposed by the European Commission in the New Pact on Migration and Asylum. Thus, the article discusses the potential priorities and objectives of the EU migration and asylum policy from the point of view of the Polish government, articulated both during the ongoing work on the EC document (2018–2020) and after its publication in September 2020. However, the article is not intended to present the Polish government's position on the particular, detailed solutions contained in the legislative proposals of the EC due to the New Pact on Migration and Asylum. Although, it allows identifying what the Polish side considers desirable, tolerable and acceptable, and what is utterly unacceptable in terms of the proposed changes to EU migration and asylum policy. Therefore, the main priorities of the Polish government regarding the reformed policy are indicated and explained. The first two concern counteracting irregular immigration by enhancing the protection of external borders and intensifying cooperation with third countries (in particular as concerns readmissions and returns), which means approving the postulates of the EC. At the same time, the third priority opposes the EC's proposal addressing asylum issues.
