The Spanish institutional system has worrying weaknesses. Although the roots are older, the deterioration has been particularly intense since 2015. In this work, different institutions of constitutional law ara analyzed as a reflection of this situation. Extraordinary circumstances as the crisis in Catalonia or the health crisis have aggravated this situation. Abstract:The definition of the Spanish State of Autonomies has been changed over the past decades. While the State of Autonomies has been classified in its beginnings as a regional state, in recent years the model developed features similar to a federal country. Notwithstanding, one of the characteristics that has been frequently underlined as a distinguishing feature of the State of Autonomies is the principle of emulation. Following this principle, the trend to equalize the different territories, in addition to the potential of the «principio dispositivo», according to which all powers that have not been reserved to the central government could be assumed by the Autonomous Communities, would lead to a model of territorial organization characterized by homogeneity. In this text we will demonstrate that, on the contrary, the Constitution and the evolution of the State of Autonomies show that the distinctive feature of the State of Autonomies has been asymmetry. In this context, we understand asymmetry as the desire for a constitutionally guaranteed distinction of some territories and the reactions this constitutional asymmetry had over time. Although during a certain period the strength of the emulation principle lead to apartially symmetrical state, the successive evolution of the State of Autonomiesdemonstrated the deep roots of asymmetry as the ideological principle of the model. The fact that this feature has been underestimated can be considered as one of the reasons for the failure of the State of Autonomies as an integration project. ; Resumen:La categorización del Estado autonómico se ha desenvuelto desde su adscripciónal Estado regional en sus inicios, a su consideración como uno de los rostros del federalismo en los últimos años. En cualquier caso, una de las características que ha sido subrayada reiteradamente como nota distintiva del mismo, es el principio de emulación. De acuerdo con el cual, la voluntad de igualación de los distintos territorios más el potencial técnico del principio dispositivo, daría como resultado un modelo de organización territorial caracterizado por la homogeneidad. En estas páginas se pretende demostrar que, por el contrario, la Constitución y la evolución del Estado autonómico demuestran que la verdadera nota distintiva del mismo es la asimetría. La asimetría entendida como la voluntad de singularización constitucional de algunos territorios y por la respuesta que esa voluntad ha tenido a lo largo del tiempo. Si bien hubo un tiempo en el que la fuerza del principio de emulación dio como resultado un Estado parcialmente simétrico, la posterior evolución demostró las profundas raíces de la asimetría como principio ideológico del modelo. Decidida la independencia, las fuerzas políticas partidarias de la misma, tenían que encontrar la manera de poder encauzar sus aspiraciones. No teniendo cauce ni en derecho interno ni el derecho internacional, se busco ese cauce en el principio democrático mediante la construcción del llamado derecho a decidir. Un derecho a decidir que suponía, en esencia, reducir el principio democrático a un solo acto electoral, con reglas establecidas unilateralmente. En este artículo se pretende desmentir tanto la oposición entre principio de legalidad y principio democrático como la propia ortodoxia democrática del derecho a decidir. Junto a ello, se argumenta que en ningún caso resulta posible constitucionalizar, normativizar, un derecho de autodeterminación. Más allá de su naturaleza difícilmente compatible con la esencia de cualquier orden constitucional, las dificultades de fijar las condiciones concretas de su ejercicio, lo antojan imposible. No en vano, ningún ordenamiento jurídico del mundo lo reconoce.After having decided the objective of independence, the political parties in favour of this objective had to find a way how to articulate their aspirations. Since there is no legal way within the national or international law, the independence movement based their demands in the democratic principle by building the so-called right to decide. However this right to decide means to limit the democratic principle to a single electoral act, with unilaterally established rules and outside the existing legal framework. In this article we try to disprove both the supposed opposition between the rule of law and the democratic principle, as well as the supposed democratic spirit of the right to decide. Along with this, we will argue that it is impossible to constitutionalise the right of self-determination. The right of self-determination is opposed to the essence of any constitutional order, moreover the difficulties of setting the conditions in order to implement this right, and particularly, the definition of the subject, makes the application impossible.

Le modèle de décentralisation politique en Espagne fait face, depuis ces dernières années, à de nouveaux défis. Ces défis sont la conséquence de la crise économique et de son impact sur l'organisation territoriale, mais également du désir d'indépendance manifesté par certains importants partis politiques catalans. Le présent article considère que pour comprendre ces problèmes, il est nécessaire de présenter une brève description du modèle espagnol d'organisation territoriale, ainsi que son évolution. C'est à travers cette description que seront traités les défis liés à la crise économique et, en particulier, l'identification des causes de certains problèmes spécifiques. De là découle aussi la question de la sécession de la Catalogne, directement liée à cette problématique.
