Kollektive Aktivitäten werden organisiert und damit Kooperationsrenten ermöglicht, indem unter anderem Produktions- und Verteilungsprozesse institutionalisiert werden. Die Kooperationsrente im weitesten Sinne - und damit die gemeinsame Erfolgsgröße - ist die Wertschöpfung. Über formelle und informelle Regeln können institutionelle Restriktionen etabliert werden, die einen Verteilungsvorteil für spezifische Anspruchsgruppen garantieren. Als zentrale Frage ergibt sich, welche Verteilung der Wertschöpfung aus einem nicht-kooperativen Verteilungsprozess innerhalb des Zusammenwirkens ökonomischer und politischer Prozesse und der doppelten Vertragsunvollständigkeit resultiert. Hierbei wird die Beziehung zwischen Verteilungskonflikten und Institutionen in Form der systematischen Korrelation von Verteilungsasymmetrien mit institutionell bedingten Verhandlungsasymmetrien herausgearbeitet.

Der Beitrag untersucht, welche Auswirkungen die europäische Integration in der EU auf die nationalen und supranationalen Akteure, die gesetzlichen Bestimmungen und die politischen Prozesse im Bereich von Tarifverhandlungen hat. Dabei wird ein breiter Ansatz von Tarifverhandlungen gewählt, der alle möglichen Formen der Kooperation von zwei oder drei Parteien auf diesem Gebiet umfasst, um mögliche europäische Dynamiken identifizieren zu können. Es wird danach gefragt, wie die Repräsentanten von Arbeitgebern und Arbeitnehmern aber auch die Vertreter der Staatsseite, die an langfristig stabilen Arbeitsbeziehungen interessiert sind, auf die steigende wirtschaftliche Integration reagieren. Es wird untersucht, ob es unterschiedliche Reaktionen in unterschiedlichen nationalen Kontexten gibt, wie die Sozialpartner mit dem doppelten Druck von Dezentralisierung und Internationalisierung umgehen und ob die nationalen Arbeitsbeziehungen in Europa in supranationalen Arbeitsbeziehungen aufgehen werden. Die Analyse erfolgt in drei Stufen. Zunächst wird eine Bestandsaufnahme der aktuellen Arbeitsbeziehungen in Europa gegeben. Danach wird ein Ansatz skizziert, in welchen Bereichen Tarifverhandlungen optimiert werden könnten, und im Anschluss daran dieser Ansatz implementiert, um das Verhalten der Hauptakteure und ihre Interessen und Absichten erklären und verstehen zu können. Fazit: die Europäisierung von Tarifverhandlungen ist eine Kombination von zum Teil parallelen, zum Teil konkurrierenden und zum Teil sich ergänzenden Zentralisierungs-, Renationalisierungs-, Regionalisierungs- und Dezentralisierungsprozessen. The Treaty of Maastricht (1993) and the Treaty of Amsterdam (1999) strongly institutionalised and formalised the relationship between the social partners at the level of the European Union (EU). It is self-evident that notion of social dialogue also includes collective bargaining, the conclusion of agreements between the social partners. Collective bargaining, however, is a delicate flower. Indeed, quite a number of questions pop up over which opinions, especially between the social partners, diverge. Then there is the reality of the power relationship between the European socials partners; the European trade unions are nearly powerless when it comes to pushing the employers to the bargaining table. The social partners were empowered, within the social dialogue, to negotiate agreements, which the European Commission can subsequently adopt as directives (Article 137 to 139 EC). This formalised process, termed bargained legislationE by Biagi (1999), grants the social partners a mandate to initiate legislation in certain areas. Although many other substantial rights and regulations, such as a labour dispute law, are lacking at the European level, the process of bargained legislation is a stronger instrument to influence legislation than most social partners in the European Union member states have at their disposal (BIAGI 1999). Notwithstanding this potential, however, at the inter-industry level only three agreements, affecting substantial portions of the European workforce, have to date been concluded. These covered minimum standards on parental leave, part time work, and fixed-term work (HORNUNG-DRAUS 2001). Since the European Commission introduced some of these topics into the social dialogue as early as 1990, the number of successful agreements must be considered extremely low, and it is only fair to conclude that the new framework did not boost the Europeanisation of industrial relations.

The development and design of financial incentiveschemes as a sustainable and cost-effectiveintervention strategy to foster effectiveness ofmedical interventions remains a significantchallenge in health care delivery.Based on the findings of the conceptual model ofmedical non-persistence we test three differentfinancial incentive schemes. These incentives arederived upon concepts of behavioral economics, inparticular mental accounting, prospect theory andchoice bracketing, and incorporated into deposit,copayment and bonus schemes. We conductrandomized laboratory experiments to evaluate theperformance and effectiveness of each incentivescheme on persistence behavior under controlledconditions. Participants in the experiment arestudents remunerated according to theirperformance in the experiment.We find that financial incentive schemes based onthe principles of prospect theory significantlyimprove treatment persistence compared to thesituation where there are no incentives at all. Thisfinding implies that the simple but smart reallocationof co-payments and co-payment supportbetween the treatment initiation phase and treatmentmaintenance phase represents an effective way ofpromoting persistence behavior.This study delivers first applications of behavioralinterventions based on theoretical foundation. Usingthe method of experimental economics the studyserves as a first proof of concept of a scalable wayto design, calibrate and test the effectiveness offinancial incentives on behavioral change. Thisapproach is inevitable for broad application in realworld as it minimizes the need for patient researchwhile clarifying the impact of interventions undercontrolled conditions before these interventions getimplemented in the field. ; eng
