Internal forced displacement, a consequence of territorial control strategies by armed groups, has resulted in profound socioeconomic challenges for receiving areas. Approximately eight million people have been affected in Colombia, where internal conflict and criminal networks have prevailed for over five decades. This paper explores the relationship between internal forced migration and crime rates in Colombian municipalities from 2003 to 2016, focusing on spatial dynamics. The study utilizes a spatial panel model and considers five crime categories: homicides, kidnapping, personal injuries, automobile theft, and residential burglary. The results reveal significant associations between forced displacement and certain types of crime, highlighting the importance of spatial analysis in understanding the interaction between migration and crime. The findings offer valuable insights for policymakers and researchers, facilitating informed policy interventions and community initiatives to address the repercussions of internal migration on crime dynamics.

En esta primera fase de la Investigación, adelantada durante el año 2012, se da cuenta de dicho inventario, y se señalan los pronunciamientos más relevantes de la Corte Constitucional en materia sancionatoria administrativa.

Comúnmente, se afirma que en los procesos de justicia transicional inmersos en un contexto de negociación política orientada a la terminación de un conflicto armado interno, hay una tensión irreductible entre justicia y paz. No obstante, en esta visión subyace un paradigma predominantemente retributivo de justicia apuntalado en el deber internacional de investigar, juzgar y sancionar a los responsables de graves violaciones de derechos humanos. Sin embargo, en escenarios de justicia transicional como el referido, además de que los problemas de legitimación de la justicia penal son aún mayores que los que hay en contextos "ordinarios", este deber internacional no es absoluto y, en cambio, deja un margen importante para la concesión de amnistías e indultos condicionados y para la imposición de penas alternativas. Lo anterior posibilita la adopción prevalente de un paradigma restaurativo de justicia en esta clase de procesos de justicia transicional, lo que permite tanto reducir considerablemente la tensión en ellos existente entre justicia y paz, como desencadenar una auténtica reconciliación política nacional. Esto hace que tal paradigma resulte más idóneo no solo para facilitar la firma de un acuerdo de paz entre el gobierno colombiano y la guerrilla de las Fuerzas Armadas Revolucionarias de Colombia – Ejército del Pueblo, Farc-EP, sin renunciar a la justicia, sino también para impulsar un verdadero proceso de reconciliación política del pueblo colombiano. ; It is commonly said that in processes of transitional justice immersed in a context of political negotiation aimed at the end of an internal armed conflict there is an irreducible tension between justice and peace. However, to this view underlies a paradigm of justice that is predominantly retributive which is underpinned in the international duty to investigate, prosecute and punish those responsible for serious human rights violations. Nevertheless, in scenarios of transitional justice as the one mentioned above, on the one hand, the problems of legitimation of criminal justice are even greater than those existing in "ordinary" contexts and, on the other hand, the duty referred is not absolute and, in contrast, leaves an important margin for the granting of conditional amnesties and pardons and for the imposition of alternative convictions. The foregoing, enables the predominant adoption of a restorative justice paradigm within these transitional justice processes, allowing both considerably reducing the tension between justice and peace, as triggering a genuine national political reconciliation. This makes such a paradigm more suitable not only to facilitate the signing of a peace agreement between the Colombian Government and Revolutionary Armed Forces of Colombia—People's Army, Farc-EP, guerilla's group without sacrificing justice, but also to promote a genuine process of political reconciliation of the Colombian people.

This article addresses the rise of private authority in contemporary global governance based on the role of global law firms in the management of a specific international regime such as international investment arbitration. The purpose of the research is to demonstrate the presence and influence of private actors in the management of agendas, topics, and global issues, which derives from them being considered as authorities of a private nature. The CIADI arbitrations related to the economic and political crisis of Argentina in the period 1999-2002 are the case study that illustrates the presence of private authority in the conduction of an international regime. ; Este texto trata la emergencia de la autoridad privada en la gobernanza global contemporánea a partir del papel que desempeñan las oficinas globales de abogados en la gestión de un régimen internacional específico como el del arbitraje internacional de inversiones. El objetivo de la investigación es demostrar la presencia e influencia de los actores privados en la administración de agendas, temas y asuntos globales, que se deriva de su consideración como autoridades de naturaleza privada. Los arbitrajes CIADI relacionados con la crisis económica y política de la Argentina en el período 1999-2002 son el caso de estudio que permite ilustrar la presencia de la autoridad privada en la conducción de un régimen internacional.

La diferenciación entre los derechos civiles y políticos por un lado y los derechos económicos, sociales y culturales, por el otro, originó la creación de dos ratados diferentes contentivos de derechos humanos: el Pacto internacional de derechos económicos, sociales y culturales (PDESC) y el Pacto internacional de derechos civiles y políticos (PDCP), ambos instrumentos jurídicos internacionales.El Reino Unido, fue uno de los estados que ratificó el Pacto internacional de derechos económicos, sociales y culturales (PDESC) en mayo de 1976. Este instrumento internacional para la protección de los DESC, parte constitutiva de la Carta Internacional de Derechos Humanos y expresión consagrante de las obligaciones contractuales específicas sobre estos derechos, aún no ha sido incorporado en la legislación interna inglesa, a pesar de haber sido ratificado por el Reino Unido. Así las cosas, es preciso analizar qué carácter jurídico tienen las obligaciones surgidas del pacto y por tanto, determinar cuál es la obligación jurídica del Reino Unido frente a los DESC como uno de los 133 países que han ratificado el pacto. En el Reino Unido la situación actual del Pacto de derechos económicos, sociales y culturales no es muy favorable en términos de aplicabilidad y efectividad de sus disposiciones, básicamente por el sistema dualista de incorporación de un tratado internacional que rige en su legislación interna, lo cual deja sin recursos efectivos al Pacto de derechos económicos, sociales y culturales en el Reino Unido (PDESC), o al menos con posibilidades muy restringidas de realización en el nivel interno. ; The difference between Civil and Political Rights on the one hand and Economic, Social and Cultural Rights on the other, originated the creation of two different content treaties on Human Rights: the International Covenant on Economic, Social and Cultural Rights (CESCR) and the International Covenant on Civil and Political Rights (CCPR), both international judicial instruments.The United Kingdom was one of the states that ratified the International Covenant on Economic, Social and Cultural Rights (ICSCR) in May, 1976. This international instrument for the protection of Economic, Social Cultural and Rights ESCR, is an essential part of the International Bill of Human Rights and a sacred expression of the specific contractual obligations on these rights; yet, has still not been incorporated into the English internal legislation, in spite of having been ratified by the United Kingdom. Notwithstanding, it is vital to determine what is the United Kingdom's judicial obligation toward the ESCR as one of the 133 countries which has ratified the Covenant.The current situation of the International Covenant on Economic, Social and Cultural Rights in the United Kingdom is inauspicious in terms of the applicability and effectiveness of its provisions, basically because of the application of the Dual System of Incorporation of an International Treaty which is at this time in effect in its internal legislation, situation that leaves the International Covenant on Economic, Social and Cultural Rights (CESCR) without effective recourse in the United Kingdom or at least with very restricted possibilities of execution at an internal level.

Este artículo aborda la guerra civil colombiana de 1851 como escenario de construcción del Estado-nación, desde la perspectiva de sus determinantes políticos y sociales, las acciones político-militares de los partidos, las élites regionales, el clero, los sectores populares y las implicaciones de la guerra en el contexto del medio siglo XIX. Las fuentes de análisis son memorias, crónicas, correspondencia oficial y prensa.
