Throughout history the university has undergone academical, scientifical, administrative and political changes due to the influence of its national and international environment, in accordance with the predominant economical model, however it has not been able to keep up with the socio economical development dynamics, and even worse, while the productive sector is permanently innovating, the university sticks to its professionalizing tradition, sometimes even ignoring the real social demands, forming professionals in traditional careers with obsolete knowledge and limited possibilities to compete in the market, with a very few exceptions.Universities that resist change and permanent improvement are destined to be illegitimate and limited in their own growth. They will have very few social reasons to exist as such. The challenge is to rethink itself according to the knowledge society. This, of course, implies the assumption of serious commitments in different areas, beginning with an analysis of its strengths and weaknesses, overcoming those weaknesses and consequently assuming its fundamental role of producing, transmitting and publishing knowledge. The university has to responsibly perform its fourth mission that is added to the traditional activities of teaching, research and extension, defined in terms of "usage, application and exploitation of knowledge".The university has the historical responsibility of surpassing the old paradigm of simply transmitting knowledge, of passively observing reality and describing social, economical and environmental problems. It must challenge its own tradition constructing a proactive leadership defined by innovation and the intensive usage of new technologies, both in the educative function as well as in the intangible assets mediated by intellectual property and strengthening the productive and social tissue. El reto está planteado y es repensarse a sí mismas de conformidad a la denominada sociedad del conocimiento. Desde luego que esto implica asumir compromisos serios en diferentes ámbitos; empezando por conocer sus fortalezas y debilidades, superar las debilidades y, consecuentemente, asumir el papel fundamental de producir, transmitir y difundir el conocimiento, desarrollando con responsabilidad la cuarta misión, que se suma a las tradicionales de docencia, investigación y vinculación, definiéndola en términos de "uso, aplicación y explotación del conocimiento".La universidad tiene la responsabilidad histórica de superar el viejo paradigma de simple transmisora de conocimientos, observadora pasiva de la realidad y descriptora de problemas sociales, económicos y ambientales. Debe desafiar su propia tradición; construyendo un liderazgo propositivo, definido por la innovación y el uso intensivo de las nuevas tecnologías, tanto en la función de educadora como en la transferencia de activos intangibles mediados por la propiedad intelectual y fortaleciendo el tejido productivo y social. El objetivo del presente trabajo es reflexionar acerca de la trascendencia y alcances del derecho a rechazar prácticas médicas en el final de la vida, donde su afectación se ve más comprometida que en el resto de sus diversas manifestaciones, pues es en dicho tramo donde su vulneración se produce en mayor grado. Para lograr este cometido intentaremos develar cómo se enuncia, cómo se fundamenta y cómo se manifiesta en el mundo jurídico, destacando de sus características aquellas cuya presencia detectamos en la legislación, doctrina y jurisprudencia más significativas en los últimos años. Finalmente, presentaremos nuestra conclusión, sin pretensión de definitiva, pero que puede resultar útil en la formulación de políticas de regulación del tema. ; The aim of this paper is to reflect on the significance and scope of the right to refuse medical practices at the end of life, where his involvement is more committed than in the rest of its various manifestations, as it is on this segment where its breach there is a greater degree. To achieve this task we will try to uncover how it sets, how it is based on and how it manifests in the legal world, highlighting these features whose presence detected in the legislation, doctrine and jurisprudence most significant in recent years. Finally, we present our conclusion, no definitive claim, but it may be useful in formulating policies to regulate the issue. ; O objetivo deste trabalho é refletir sobre o significado eo alcance do direito de recusar a prática médica no final da vida, onde sua participação é mais do que no resto da suas várias manifestações, uma vez que é nesse trecho que a sua violação há um grau maior. Para realizar esta tarefa, vamos tentar desvendar como os estados, como ela se desenvolve e como ela se manifesta no mundo jurídico, destacando-se as características cuja presença detectada na legislação, doutrina e jurisprudência mais significativa nos últimos anos. Finalmente, apresentamos nossa conclusão, nenhum pedido definitivo, mas podem ser úteis na formulação de políticas para regular a questão.
Se trata de una síntesis de los resultados obtenidos en el marco de una tesis que ha comprobado que el gran desafío que hoy se le presenta a la Argentina y el Mercosur lo constituye una normatividad que, pese a reconocer a la salud como un derecho humano fundamental, debe definir si permanece a modo de fisonomía o fachada, o, si tiene el coraje de tutelarlo. Luego de un breve planteo que contextualiza la problemática, se puntualizan los supuestos que movieron a la investigadora a plantearla y se enuncian, además de los factores que la determinan y los efectos que acarrea, aquellas propuestas que, como posibles medidas a adoptar, ha analizado en su tesis. ; This article is a brief synthesis of the results reached in the thesis that proves that the great challenge that Argentina and Mercosur have nowadays is the legislation, which -even though recognizes health as a human basic right- has to define if it remains as a facade or if it has the necessary courage to protect it. After a brief contextualization of the problem, the assumptions that moved the investigator are pointed. Also the determining factors of this problem, their consequences and some possible measuresto adopt are mentioned. ; E uma síntese dos resultados de uma tese que comprovação que o grande desafio que hoje tem a Argentina e Mercosul é uma normativa que não obstante reconhecer a saúde como direito humano fundamental, deve definir se permaneceu como fisionomia ou fachada ou se o tutela.
