Since Opinion 2/13, the ECJ has gradually clarified that its role in the field of CFSP is less limited than a cursory reading of the Treaties may suggest. This article aims to take stock of this evolving case law and discuss the remaining uncertainties and criticisms regarding the Court's approach. After a brief introduction to the ambiguous position of the CFSP in the EU legal order, specific attention is devoted to the "gap-filling" role of the ECJ's case law in relation to CFSP matters. It is argued that the Court has developed a consistent line of case law, based on the horizontal application of general constitutional principles and mechanisms. The question remains how much further this "gap-filling role" can be stretched in light of the principles of institutional balance and conferral. The article discusses to what extent the specific features of EU law as regards judicial review in CFSP matters may still be regarded as an obstacle for EU accession to the ECHR.

This article puts the specific features of the Stabilization and Association Agreement (SAA) between the EU and Kosovo in perspective. In particular, it analyses how the unsolved issue of Kosovo's recognition affects the scope and content of the agreement. For this purpose, the SAA with Kosovo is compared to the SAA with Serbia. Despite the at first sight comparable structure of both agreements, the absence of mixity in the SAA with Kosovo as well as the reservations regarding its international legal status lead to a number of noticeable differences, in particular as far as the rules regarding entry and residence of Kosovo nationals are concerned.

EU accession challenges traditional Interpretations of sovereignty and independence as laid down in the Lithuanian constitution. From a comparative perspective, different options for constitutional revision are distinguished to modify this traditional approach. Furthermore, this article examines a number of technical issues that have to be tackled in order to prepare the Lithuanian constitution for EU Membership. ; Straipsnyje analizuojamas Lietuvos Respublikos Konstitucijos pakeitimo galimybių procesas Lietuvai stojant į Europos Sąjungą. Nors Europos Sąjunga nenustato ir negali nustatyti sąlygos valstybėms kandidatėms pakeisti savo konstitucijas, tačiau tai yra teisinė ir politinė būtinybė, siekiant išvengti prieštaravimą tarp valstybių kandidačių konstitucijų ir įsipareigojimų, kurie kyla iš narystės Europos Sąjungoje. Straipsnyje tyrinėjama suvereniteto ir valstybės nepriklausomybės sampratų tarpusavio santykis, apžvelgiama Europos Sąjungos jurisprudencija bei Europos Sąjungos teisės viršnacionalumo principas remiantis Europos Sąjungos valstybių narių praktika ir patirtimi siekiant analogiško sprendimo. Straipsnyje pateikiami keli Konstitucijos keitimo būdai, siekiant apibūdinti, kokia apimtimi turėtų būti keičiama Lietuvos Respublikos Konstitucija. Taip pat analizuojami konkretūs Konstitucijos straipsniai, kurte prieštarauja acąuis communautaire ir kurie turėtų būti keičiami. Nagrinėjant konstitucijos 47 straipsnį, darytina išvada, kad jo pakeitimas neišvengiamas dėl neatitikties ES teisei, priešingu atveju Lietuva susidurtų ne tik su nacionalinės teisės ir Europos Bendrijos teisės normų kolizija, bet ir rizikuotų būti patraukta atsakomybėn Europos Teisingumo Teismo. Straipsnyje analizuojama 119 straipsnio pakeitimo būtinybė bei teigiamai vertinami padaryti pakeitimai. Nors 125 straipsnis bei 136 ir 138 straipsniai tiesiogiai ir neprieštarauja acąuis communautaire, jų pakeitimas būtų labai pageidautinas. Analizuojant suverenumo problemą per narystės Europos Sąjungoje perspektyvą, daroma išvada, kad narystė Europos Sąjungoje nepažeis Lietuvos Respublikos Konstitucijos 2 ir 3 straipsnių. Vis dėlto manytina, kad aiškios konstitucinės normos, nustatančios suverenių galių perleidimą, būtų tinkamos, atsižvelgiant į Konstitucijos 4 ir 5 straipsnius ir valstybės įsipareigojimus, susijusius su naryste Europos Sąjungoje.

On 18 July 2003 the European Convention adopted by consensus the final version of the ,, Draft Treaty Establishing a Constitution for Europe". Almost one year later, at the \b June 2004 Brussels summit, the Intergovernmental Conference finally reached agreement on the EU's new Constitutional Treaty, which is now awaiting a process of national ratifications. An analysis of the Convention discussions and the first reactions to this ambitious document reveal the sensitivity of notions such as national identity" and sovereignty". According to one commentator, the EU Constitution ,,fatally undermines the concept of nation-state sovereignty", which has ,,put EU Members in the impossible position of choosing between European integration and their own Independence." [1] Against the background of this opinion it is obvious that the Impact of the forthcoming EU Constitution upon sovereignty, a central and Integral concept of national constitutions needs clarification. A basic question of this paper is whether two constitutions, European and national, can co-exist on the same territory without major legal problems. This is particularly important for a country such as Lithuania, which has several constitutional safeguards protecting the republic's sovereignty and Independence. According to Article 1 of the constitution Lithuania shall be an Independent state, whereas Article 2 proclaims that sovereignty shall be vested in the People". Moreover, ,, no one may limit or restrict the sovereignty of the People or make claims to the sovereign powers of the People" (Art. 3). Hence, the question arises whether and how the forthcoming EU Constitution will affect the traditional concept of national sovereignty as laid down in the first articles of the Lithuanian constitution. This paper first analyses the meaning of sovereignty and the evolution of this concept throughout the process of European Integration. Furthermore, it identifies limits to the transfer of sovereign rights as laid down by important decisions of national constitutional Courts and examinee how the EU Constitution affects the traditional concept of national sovereignty". Finally, this paper argues in favour of a new interpretation to sovereignty in the context of further European Integration. ; Straipsnyje gilinamasi į įvairins suvereniteto sampratos aspektus. Straipsnio autorius apžvelgia istorinę suvereniteto sąvokos raidą nuo Z. Z. Ruso laikų iki šių dieną. Autorius, remdamasis neseniai paskelbtu oficialiu ES konstitucinės sutarties projektu, labai detaliai aptaria galimas ES Konstitucijos pasekmes nacionalinio suvereniteto doktrinai. Keliami aktualūs klausimai, susiję su Lietuvos, kaip naujos ES valstybės narės, suverenitetu. Nagrinėjami kiti probleminiai ES suvereniteto aspektai, susiję su mažomis Europos valstybėmis, kurios neseniai atgavo savo nepriklausomybę. Autorius filosofiniu požiūriu aptaria nacionalinio suvereniteto sąvokos išplėtimo pranašumus ir trūkumus, taip pat analizuoja nacionalinio suvereniteto ribų nustatymo galimybes remiantis nacionalinės konstitucijos nuostatomis. Siūlomi ir problemų sprendimo variantai: autoriaus nuomone, šiuolaikinė konstitucinė teisė suvereniteto ribojimo galimybes sieja pirmiausia su konstitucinių teismų pozicija šiuo klausimu. Todėl tolesnė suvereniteto ribojimo problema ir jos sprendimo būdai gali būti išspręsti tik konstitucinio proceso keliu. Nemažai dėmesio skiriama Lietuvos Respublikos konstitucinėms problemoms, nagrinėjamos atitinkamos Lietuvos Respublikos Konstitucijos nuostatos, tvirtinančios nacionalinio suvereniteto koncepciją.

Po 2004 m. gegužės I d., kai į Europos Sąjungą įstojo daug naują valstybių, iš esmės pasikeitė ES funkcionavimo pagrindas tiek instituciniu, tiek sprendimų priėmimo, tiek kompetencijos aspektu. IŠ esmės pasikeitė ir Europos Sąjungos ateities vizija. Šiame straipsnyje daugiausia dėmesio skiriama naujųjų valstybių narių stojimo sutarčių analizei: nagrinėjama šių sutarčių struktūra, teisinė prigimtis, valstybių išsiderėti pereinamieji laikotarpiai ir ES saugumo klauzulės. Pagrindinė straipsnio mintis yra ta, kad pereinamaisiais laikotarpiais naujosios valstybės narės negali lygiuotis į senąsias, kadangi ES acquis communautaire nėra perimamas visa apimtimi. Be to, pačios senosios valstybės narės stojimo sutartyse įtvirtinto saugumo klauzules, pasilikdamos sau teisę suspenduoti netinkamai adaptuojančios acquis naujosios valstybės narės narystę siekdamos užtikrinti tinkamą ES ekonomikos, vidaus rinkos, teisės ir vidaus reikalų raidą. Visi šie aspektai išsamiai analizuojami pateikiant istorinį kontekstą ir atskirų stojimo sutarčių straipsnių analizę. Ypač daug dėmesio skiriama euro įvedimo ir naujųjų valstybių narių įsiliejimo į Šengeno erdvę pereinamiesiems laikotarpiams. Taip pat aptariami pereinamieji laikotarpiai laisvo darbuotojų judėjimo, laisvo paslaugų teikimo, žemės ūkio ir aplinkos apsaugos srityse. Straipsnio pabaigoje pateikiamos išvados, kad ES ir naujųjų valstybių narių pasirašytos stojimo sutartys diferencijuoja jų padėtį senųjų valstybių narių atžvilgiu ir iš anksto numatė potencialų nukrypimą nuo vienodo ES acquis taikymo. Pabrėžiama, kad skirtingose naujųjų valstybių narių grupėse taikomos skirtingos ES acquis dalys, pereinamieji laikotarpiai nevienodos trukmės, o saugumo klauzulės užtikrina senųjų valstybių narių pranašumą.

This article analyses the post-Lisbon legal framework for the adoption of restrictive measures against individuals or non-State entities – so-called 'targeted sanctions' or 'smart sanctions'. It is argued that the procedural differences to adopt targeted sanctions in the framework of the EU's counter-terrorism activities (Art. 75 TFEU) and with regard to the implementation of the Common Foreign and Security Policy (Art. 215 TFEU) increase the potential for inter-institutional litigation. This is particularly the case because the boundaries between the EU's competences in the Area of Freedom, Security and Justice (AFSJ) and the Common Foreign and Security Policy (CFSP) are blurred. This is illustrated with the discussions surrounding the adoption of amendments to Regulation 881/2002 imposing restrictive measures directed against certain persons and entities associated with Usama bin Laden, the Al-Qaida network and the Taliban after the entry into force of the Treaty of Lisbon. The European Parliament contests the adoption of those amendments on the basis of Art. 215 (2) TFEU and argues that only Art. 75 TFEU is the appropriate legal basis given the counter-terrorism objective of the measure at stake. This article discusses the different options to find an appropriate solution for this inter-institutional competence battle and argues that the Court's new possibilities to rule on the duty of consistency may help find a way out.
