The essay analyses the role played by the Parliament and the Government during the pandemic, trying to identify trends and changes in the lawmaking process and in the legislative approach to the emergency before and after the change of Cabinet on February 2021.

Il saggio muove dalla recente approvazione della legge costituzionale in mate- ria di riduzione del numero dei parlamentari al fine di affrontare il più ampio tema della forma delle revisioni costituzionali. In particolare, esso si concentra sulla tendenza della politica a presentare simili riforme travisandone la reale portata e le loro implicazioni sul piano dell'equilibrio costituzionale delineato dalla Carta costituzionale. In questa prospettiva, l'Autore si interroga su qua- le, fra il criterio dell'organicità e quello della puntualità, possa dirsi maggior- mente coerente rispetto all'impianto della Carta, che riconduce espressamente la revisione costituzionale nel novero delle "garanzie costituzionali". ; The essay moves from the recent approval of the Constitutional Law that reduced the number of Italian parliamentarians in order to address the issue of constitutional revisions and its forms. In particular, the work focuses on the political tendency to put forth such reforms misrepresenting their actual scope and implications on constitutional equilibrium outlined in the Consti- tution. In this perspective, the Author questions which, between the orga- nicity and punctuality criterion, can be considered more consistent with the constitutional framework, that refers explicitly to the constitutional revision in terms of constitutional guarantees.

Il saggio si propone di analizzare, anche in chiave storica, le principali distorsioni che hanno caratterizzato il ricorso alla decretazione d'urgenza – quale principale strumento di produzione legislativa – negli ultimi decenni, nel tentativo di individuare la portata, le ragioni e il significato del processo di trasformazione in atto, sia sul piano della forma di governo che, più in generale, su quello dei rapporti di equilibrio fra l'organo della rappresentanza politica e l'Esecutivo. ; The essay aims to analyze, even in a historical way, the main distortions that have characterized the use of decree-law – as the main legislative tool – in last decades, with the aim to identify the scope, the reasons and the significance of the transformation process currently underway in terms of both form of government and, more generally, the balance between Parliament and Executive branch.

The essay focuses on one of the most important legislative measures adopted by Italian Parliament during the Covid-19 pandemic: the decree-law "Cura Italia". Its analysis offers a key place from which to observe main issues related to the use of decree-law in general, even under normal circumstances. However, it also provides important evidences of new criticalities and the ease with which Government uses sources of law, raising questions about whether such distortion will continue even after the pandemic.

The latest COVID-19 pandemic has brought the Italian Government to the adoption of a series of measures concerning constitutional rights and freedoms, necessary to contain the spreading of the virus and to safeguard the health of people. Most of these measures, however, seem not to have been fully adopted within the constitutional framework for reasons of urgency, although the Constitution provides Government with all the appropriate tools to tackle the emergency. With this in view, the case of COVID-19 may represent the opportunity to reform the Constitution introducing a special declaration of "epidemiological emergency" that can make the approach to such calamities more respectful of the constitutional framework, at the same time preventing the approach followed might constitute a dangerous precedent

Il saggio si propone di verificare se e in quale misura l'Ufficio parlamentare di bilancio (UPB) stia incidendo sulla forma di governo italiana, soffermandosi sulla natura costituzionale dello stesso nonché sui primi anni della sua attività. In quest'ottica, il saggio muove dalla derivazione sovranazionale dell'UPB e dalle aspettative della governance economica europea su di esso, per poi passare a evidenziare come l'individuazione di una prospettiva nazionale delle sue funzioni appaia necessaria ai fini della buona riuscita di tale organismo. Infine, l'analisi tenta di dimostrare come il Presidente della Repubblica, la Corte costituzionale e l'opinione pubblica possano avere un ruolo fondamentale nell'aiutare l'UPB a fungere da elemento di razionalizzazione della forma di governo e nel ridare vigore alle prerogative parlamentari di bilancio. ; The essay aims to verify if and how the new Italian Parliamentary Budget Office (PBO) is affecting the Italian form of Government, analyzing its constitutional status and performance in its first years. From this point of view, the supranational origins of the PBO are first discussed along with the expectations of the European economic governance about the PBO. The work stresses the need to find a national perspective of its functions for the success of the body. In conclusion, the analysis shows how the President of the Republic, the Constitutional Court and public opinion might play a key role in restoring the prerogatives of Parliament on the budget and in helping the PBO to rationalize the form of Government.

Il saggio si propone di ripercorrere i momenti chiave della vita finanziaria dello Stato, in particolare soffermandosi sull'approvazione del rendiconto generale, delle leggi di spesa e della legge di bilancio, al fine di ricostruire la portata e le dinamiche istituzionali che risultano caratterizzare gli stessi nelle prassi più recenti. Nello specifico, esso si concentra su una serie di criticità che è possibile riscontrare in relazione all'esame e alle modalità di approvazione di tali provvedimenti da parte dell'organo parlamentare, nel tentativo di meglio definire come esse, da un punto di vista costituzionale, vadano a inserirsi nell'attuale crisi del parlamentarismo. ; The essay aims to examine the key moments of the financial and budgetary life of the State, analyzing the approval procedures of the General Financial Statement, of the expenditures, and of the budget, in order to define the scope and the institutional trends which characterize these moments in the recent years. More specifically, the essay focuses on some critical issues that can be detected with regard to the scrutiny and approval modalities under which these provisions are adopted by the Parliament, in the attempt to better define the role these criticalities play, in a constitutional perspective, in relation to the current parliamentary crisis.

The Eurozone crisis has provided the EU with the occasion for experiencing the great impact credit rating agencies may have on States and the economy as a whole. Nevertheless, the ability of these agencies to influence governments and public policy seems to stem more from the effects that financial regulations attribute to ratings rather then the credibility or reliability of the agencies themselves. In this light, the essay analyses whether it is opportune to establish a European credit rating agency as a tool to reaffirm the values of modern constitutionalism.
