This article raises the relevance of using westerns, such as the films The Man Who Shot Liberty Valance (Ford, 1962) and Pat Garrett & Billy the Kid (Peckinpah, 1973), as well as the videogame Red Dead Redemption 2 (Rockstar Games, 2018), to address the process of consolidation of a State ruled by Law. These contents has been analyzed in relation with various introductory subjects to Law throughout an undergraduated program. In this sense, these films and videogames have been analyzed considering the way they deal with key issues in the process of consolidation of the Law: 1) the passage from the state of nature to the rule of law; 2) the relations between political power and the Law regarding the problem of legitimacy; 3) the productive nature of the Law and its relationship with the process of civilization; 4) the ambivalence of the process of civilization, and 5) the relevance of the mythical foundations for the State and for the Law. From that analysis, the usefulness of these resources to put in context the origins of the current legal-state regime can be infered. Thus also allows a more aporopriate approach from the perspective of contemporary legal science. ; Este artículo plantea la pertinencia de utilizar elementos del género western, como las películas The Man Who Shot Liberty Valance (Ford, 1962) y Pat Garrett & Billy the Kid (Peckinpah, 1973), así como el videojuego Red Dead Redemption 2 (Rockstar Games, 2018) para abordar el proceso de consolidación de un Estado regido por el Derecho. El estudio ha analizado la pertinencia de estos contenidos en asignaturas introductorias al Derecho en estudios de grado. En este sentido, ha analizado las obras citadas considerando la manera en que tratan asuntos clave del proceso de consolidación del Derecho: 1) el paso del estado de naturaleza al imperio de la ley; 2) las relaciones entre el poder político y el Derecho a propósito del problema de la legitimidad; 3) el carácter productivo del Derecho y su relación con el proceso de civilización; 4) las ambivalencias del proceso de civilización y 5) la relevancia de las fundamentaciones de orden mítico para el Estado y para el Derecho. Del análisis se infiere la utilidad de estos recursos para poner en contexto los orígenes del actual régimen jurídico-estatal y permitir así un abordaje más ajustado a las perspectivas de la ciencia jurídica contemporánea.

From the socio-legal perspective of the studies of governmentality and the philosophy of vulnerability, the evolution of security provision strategies is analyzed, from their neoliberal orientation to the predominance of austerity since the 2008 crisis. It will delimit a scenario in which inequality and aporophobia are fundamental elements of the hegemonic axiological framework. It is relevant to the configuration and effectiveness of strategies for providing safety and managing populations at/at risk in the contemporary Spanish context. ; Desde la perspectiva sociojurídica de los estudios de la gobernabilidad, se analiza la evolución de las estrategias de provisión de seguridad, desde su orientación neoliberal hasta el predominio de la austeridad desde la crisis de 2008. Se delimita así un escenario en el que la desigualdad y la aporofobia son elementos fundamentales del marco axiológico hegemónico. Esto es relevante para la configuración y efectividad de los derechos sociales de distintos grupos vulnerables. El artículo se aproxima finalmente a la situación de las empleadas de hogar y de quienes acceden a una vivienda mediante la ocupación de inmuebles vacíos en España.

Emergence of Knowledge Commons, Risks, and Relevance for the Human-Rights Framework

The study of common-pool resources (CPRs) has become increasingly important in social sciences. CPRs emphasize a more inclusive use and an institutional and normative community-based approach. However, this approach is exposed to access, sustainability, and democracy risks. This paper shows the interest that the rationality of the institutions for the commons can have for the legal sphere and, particularly, for human rights. Both are characterized by powerful democratic legislation and share concern for meeting the needs of the subjects involved and for the effectiveness of their contents and guarantees.
Innovación social y participación efectiva de niños, niñas y adolescentes

A pesar de que la innovación social se compone de valores rupturistas, cooperativos y de superación de las soluciones preexistentes, es decir, de valores que resultan afines a las características de niños, niñas y adolescentes, estas personas no suelen ser sujetos activos de la innovación, sino solo sujetos pasivos o consumidores. Este artículo analiza los conceptos de infancia y de innovación hegemónicos que están detrás de esta situación. Con el objetivo de reforzar la efectividad del derecho de participación de niños, niñas y adolescentes en este ámbito, el artículo también propone algunos cambios en las políticas públicas para el contexto español y algunos espacios de innovación que pueden liderar este cambio.

Los distintos regímenes de políticas públicas relativas a la infancia y a la familia han estado ligados a determinadas concepciones de la infancia, de la familia y del Estado. La articulación entre estos tres extremos ha servido como criterio de inteligibilidad de las políticas públicas en este ámbito, como mostró la clásica obra de Fox Harding (1991) "Perspectives in child care policy". En la actualidad, la gestión de la crisis económica, sobre todo desde 2010, ha reconfigurado el funcionamiento de este triángulo e insta a su redefinición a través de un nuevo marco de referencia para los análisis sociales. Este artículo pretende introducir algunas de estas cuestiones.
EU's democracy promotion policy in the Mediterranean : Squaring the stability - democracy circle?
Why does the EU have an ambiguous and inconsistent democracy promotion (DP) policy towards the Mediterranean countries? This paper argues that the EU's DP is determined by a crucial conflict of interests conceptualised as a stability - democracy dilemma. The EU has been attempting to promote democracy, but without risking the current stability and in connivance with incumbent autocratic regimes. In view of this dilemma, the four main characteristics of the EU's DP promotion are explored, namely: gradualism, a strong notion of partnership-building, a narrow definition of civil society, and a strong belief in economic liberalisation. A fifth feature, relation of the EU with moderate Islamists, is analysed in the paper as it represents the most striking illustration of its contradictions. The paper concludes by arguing that the definition of a clear DP by the EU that considered engagement with moderate Islamists would represent a major step towards squaring its stability - democracy circle. ; Per què la UE té una promoció ambigua i inconsistent de la democràcia cap als països mediterranis? Aquest treball sosté que la promoció de la democràcia de la UE està determinada per un conflicte fonamental d'interessos conceptualitzats com l'estabilitat - dilema democràcia. La UE ha estat tractant de promoure la democràcia, però sense posar en risc l'estabilitat actual i en connivència amb els règims autocràtics que incumbeixen. Davant aquest dilema, les quatre característiques principals de promoció de la UE DP són explorats, a saber: el gradualisme, una forta noció de creació d'associacions, una definició estreta de la societat civil, i una forta creença en la liberalització econòmica. Un cinquè aspecte, la relació de la UE amb els islamistes moderats, s'analitza en el document, ja que representa l'exemple més cridaner de les seves contradiccions.
