RESUMENLa responsabilidad en materia de derechos humanos es aquí analizada desde distintos ángulos, con el fin de indagar si ella compete exclusivamente a los Estados o puede cobijar otros sujetoscolectivos o individuales, controversia muy actual en la que inciden no solo razones juridicas sino intereses políticos.La diversidad étnica y cultural es un elemento que ha de ser tenido en cuenta en el criterio sobre la violación de los derechos, sin que ello lleve a desconocer el carácter universal de los derechos humanos.PALABRAS CLAVEDERECHOS HUMANOS- RESPONSABILIDAD- MULTICULTURALISMO-CIUDADANÍAABSTRACTThe paper examines the issue of responsibility in human rights from different points of view, with the aim of inquirying whether it should be imputed exclusively to states or, likewise, to other subjects , collective or individual. Aspecto central en la Autobiografía de Hans Kelsen, publicada por primera vez en Alemán en 2006 y editada en español por la Universidad Externado de Colombia el presente año, es el relativo al establecimiento del Tribunal Constitucional de Austria en 1920, y al proceso que llevó a su disolución por razones políticas. Es evidente que regímenes dictatoriales o gobiernos autoritarios no pueden coexistir con un verdadero control de constitucionalidad. ; The central theme in the autobiography of Hans Kelsen, published in German in 2006, and edited in Spanish by the Universidad Externado de Colombia this year, is the establishment of the Constitutional Tribunal of Austria in 1920 and the process that led to its dissolution for political reasons. It is evident that dictatorial regimes or authoritarian governments cannot coexist with true constitutional control.

El artículo resalta los aportes realizados por Hans Kelsen en temas relativos al derecho internacional y su conexión con la justicia, la filosofía política, la democracia y la teoría del Estado. En los años en que Kelsen trabaja para el Instituto Universitario de Altos Estudios Internacionales, elabora importantes estudios sobre el, en aquel momento, nuevo proyecto de Organización de Naciones Unidas. En este sentido, aparece una comparación entre la teoría del derecho internacional que elabora Kelsen y la que elaboró su discípulo Alfred Verdross. Por último, también aparecen desarrolladas cuestiones vinculadas a las relaciones existentes entre la Teoría Pura del Derecho y el derecho internacional. ; This article remarks the contributions made by Hans Kelsen in topics related with the international law and its connection with the issue of justice, politics philosophy, democracy and theory of State. In the years in which Kelsen was working for the International High Studies University Institute, he made some approaches to the, in that time, new project for the United Nations Organisation. In this sense, it appears a new comparison between the international law theory made by Kelsen and the theory made by his disciple Alfred Verdross.
