One of the essential principles, which represents a pivot in the physiognomy of the legal order, is the principle of legality. His imperative is manifested through the obligation of the administrative organs and officials, the actions they take and the acts they make, to base exclusively on the laws, as well as the rules based on the law. Legality is a fundamental principle that all employees, from the top to the bottom of the administrative pyramid, should uphold. As a substantive element, it constitutes the essence of the service-based and functionally potent administrative systems of European countries and is established as a normative framework, directive, guide, roadmap and postulate for the operation of their officers. Because of its primordial and strategic significance, in states with atrophied and insufficient institutional structures, which still pass through the labyrinth of the obscure transition tunnel, this principle should be implanted as the basic substrate in the mental matrix and in the professional habitat of the administrators. In accordance with the principle of legality, the authorities of the public and state administration, in the immediate application of the laws and other regulations, have a duty to provide the rights of the clients, ie they impose obligations that arise only from the laws. In this way, the principle of equality is revived, and arbitrariness, voluntarism and arbitrariness in the resolution of the rights and obligations of citizens and other legal entities are prevented. By practicing the principle of legality, in fact, the stability of the legal as well as the social system as a whole is ensured and the fundamental, constitutional and law-enforced rights of citizens are guaranteed. The administrative authorities are obliged to apply the principle of legality and in cases when they are authorized to decide on a free (discretionary) assessment. It is a guarantee mechanism for reducing and preventing arbitrariness and arbitrariness in decision-making. The antidote to legality is illegality. In the narrow sense, the notion of illegitimacy refers to abuse of power (ultra vires), or rather incompetence, a direct violation of legal rules and errors in the establishment and the legal qualification of the facts. This meaning of the term in "narrower sense" refers, in particular, to cases where the administration procedure is regulated by a law that is very precise and in cases where the competence of the administrative authority is determined and imposed in accordance with the law, but it can also apply of cases where the administration has some kind of discretion. In a broader sense, however, illegality involves the pursuit of improper purposes and consideration of inadequate considerations and irrelevant factors. The selection of people, their deployment of appropriate jobs and the determination of their duties and powers in the work process constitute a human resources policy, which essence is summarized in the gesture: "The right man in the right place". Human resources policy involves a set of activities that should ensure that the right people are in the right place at the right time, in order to carry out the planned activities and projects, through which the body will achieve its strategic goals. Individualism and equality make up the heart of decisions about who will be employed and what kind of process will effect this employment. The valuable premises of individualism encourage the establishment of a competitive recruitment process, which is thought out in order to recruit the person that is most qualified for the given position. The concept of equality, on the other hand, requires human resources policies to provide equal opportunities and access to employment in institutions for all relevant groups in society. The concept of equal opportunities in employment has a political, cultural and emotional substrate and an acronym. It is a set of procedures and practices that effectively protect a person from being excluded from employment because of its race, color, gender, religion, age, national origin or other factors that should not legally be considered in the selection of candidates. At the heart of discrimination, there is intolerance in the workplace towards those who are different. In employment, it manifests itself in failure, equals to be treated equally. Discrimination is an unequal treatment of the equal and equal treatment of the unequal. Whether it is deliberate or unintentional, any action that has the effect of restricting employment opportunities and advancing on account of one's gender, race, color, age, national origin, religion, physical disability, etc., constitutes discrimination and is illegitimate. In labor, the attributes and immanent features of the principle of equality in employment in the public administration are diligently and extensively processed, as a universally established and well-established principle in the national legislation and in the administrative architecture of almost all countries. However, the focus of the scientific research interests of the author includes the so-called affirmative measures and "positive discrimination" in employment. The intent of the affirmative measures is to encourage employers to engage a particular target group of people based on their race, gender, or their national origin, in order to reverse or neutralize the consequences of discrimination in the past. Comparatively, affirmative measures encourage dysonant explications, and they are subject to many litigation and constant political and social debate. For years, inequality in the treatment of individuals of different backgrounds is a crucial problem. And today, the concept of equal employment opportunities is in the focus of the theoreticians and the human resources departments. However, it should be emphasized that there is no universal recipe or "panacea" as to reach the best practice for equal employment opportunities. The first roots and rudimentary beginnings of state order developed as early as the breakup of the first communities and with the appearance of the embryonic state of organization of society. State regulation, in the genetic sense, is as old as the social organization of the people. This means that its root is deeply embedded and widely branched out into social reality. State regulation is a particularly differentiated and crystallized legal and political term, which is subject to great interest in civilization and it attracts the attention of scholars in the relevant fields. Many prominent views have been circulating in the scientific literature regarding the definition of the term, essence and immanent features of the state order. The differences that exist between them are not of essential character, which means that a common denominator can be found in the sense of the substantive elements that constitute the entity of the state order. Form of state regulation means administrative and territorial architecture of the state or organizational vision and physiognomy of the state, primarily depending on where that sovereign state power is concentrated and what are the relations between central and non-central, local authorities of the state. The form of state regulation is directly correlated with the organizational constitution and arrangement of the state apparatus, or more specifically: whether there is a single structure of the whole state apparatus or is it divided into parts which are more or less proportionally independent. In the first case it is a single and compact organizational structure where the sovereign power is concentrated in the central state bodies, superior to all other organizational entities, while in the latter case it is the an organizational structure of several united and proportionally autonomous and equal states. The paper deeply and extensively indentifies and studies the forms of the forms of state regulation. Therefore, the author's scientific and research interest focuses on the study, systematization and notation of the essential features and identities of the unitary as well as the federal state. The sculptures of the idea of political control appeared with the principle of separation of power and the need for mutual control and restriction of different branches of government. To mitigate and neutralize the possibility of abuse, one of the mechanisms is to organize the government in a way that one power oversees the other government. In that sense, in the relations between the legislature and the executive, it is necessary that the legislation does not have a legal means to stop the decisions of the executive power, but with the possibility and authority to control it.Conversely, the executive has the right to veto the legal acts, but can not participate in their voting. Political control is one of the essential and standardly established functions of parliaments in all countries with a parliamentary or mixed system of government organization. It is a process in which parliament continuously and systematically monitors, analyzes, checks and evaluates the work of the government. In addition, the controlling parliamentary prism observes the overall work of the government as a collegial body of the executive power and the work of ministers as its members in terms of whether they achieve the goals and policies of parliament expressed in the constitution and laws, and whether the manner of who act, the means and the methods they use are purposeful. Subtlety in the use of instruments of political control is necessary in order not to jeopardize the fundamentals of the independence of the executive, that is, not to undermine the necessary independence of the ministers in undertaking measures within the scope of their portfolio, as well as on the activities for consistent implementation of government policy in general. However, political control, on the other hand, has been established, first of all, to prevent the independence of the holders of the executive power from reaching beyond the limits of the normatively projected trajectory of movement and action, not to turn into arbitrariness, arbitrariness and voluntarism, not to manifest ignorant attitude towards the policies and attitudes of the parliament expressed in the laws, and thus indirectly in accordance with the will of the citizens represented in the parliament. The focus of the scientific-research interest will be deep and extensive study and awareness of the immanent features of parliamentary issues and interpellations, as forms through which parliamentary control over administration is effectuated. Also, in this context, the author's intention is to capture the effectiveness of these control mechanisms, which are normatively established and practically established in the parliamentary systems. Efficiency and effectiveness are fundamental principles that all employees need to uphold, from the top to the bottom of the administrative pyramid. These are the essential elements that constitutethe essence and core of the service-based administrative organisms of the European countries and are established as normative directives and guidelines for the operation of their officials.Because of their strategic significance, in countries with atrophied and insufficient institutional structures, which still pass through the obscure transit tunnel, these essential principles should be implanted as the basic substrate in the mental matrix and in the professional habitat of the civil servants. They should also be used as productive tools in the substitution of rigid administrative systems, which are strictly formalistically based on rules and procedures in outsourced-oriented services, where emphasis will be placed on minimizing resources, maximizing results, and qualitatively servicing of clientsneeds. The basic point and premise is that if governments have the will and insistence to amortize and overcome discontent and mistrust of the citizens, they will have to find modalities and to establish mechanisms that will generate efficiency and effectiveness in the processes of implementation of policies and in the servicing of public services. Administrative activity does not become legitimate with its own performance, therefore the concept of administrative authority must give way to the concept of efficiency of administrative activity. In this context, administrative action should be reduced to only a legal manifestation of the state power, and to be more and more promoted as an active driver of social flows, ie it is necessary to transform the administration from the apparatus and instrument of the government into an efficient service of the citizens.Unlike the traditional model of the rule of law, according to which state and administrative procedures are legitimate (justified) by being legal, that is, implemented on the basis of the current regulations, modern concepts of legitimacy consider that administrative system can acquire its legitimacy with efficient and effective action. Often, in everyday life, in some literature and in practice, the terms efficiency and effectiveness are used as synonyms to denote the same, which undoubtedly is a mistake. That is exactly what stimulates the scientific and research interests of the author of the work, through in-depth and extensive study, awareness and analysis of these principles, to note their immanent features and attributes, as well as to draw a clear line of differentiation/distinction between them. Efficiency and effectiveness are not identical terms, that is, equivalent categories. Efficiency deals with the cost of creating products and services, and effectiveness is defined as creating results. That is, efficiency focuses on cost reduction, and output increase, and answers the question of whether we do things in the right way, that is, right, whereas the effectiveness that puts stress on quality and answers the question of whether we take the right actions. Basic motives for the implementation of administrative reforms are building a stable state institutional mechanisms that enhance organizational and functional structure of the administration and increasing its efficiency in order to successfully carry out public works and solving public problems, develop democratic sustainable society and a prosperous market economy. The primordial objective of the reform, above all, should be redesigning, "resetting and decoding" of existing institutions and their transformation into a responsive and service-oriented public entities whose officials in the focus of their overall activity need to put the client (citizens and legal persons). Successful countries with qualitatively differentiated and functionally potent public services are generally implementing permanent reforms, permanently honing and updating existing institutional arrangement. In these countries, where the systems are generally effective and efficient, if there is a certain stagnation of the processes, that stagnation like signal by her own will timely alert and initiate change. On the other hand, there are countries which reforms go whenever it face difficulties, while others even then when the current situation is extremely difficult and institutional framework will collapses entirely. In most countries that still wander through the labyrinths of the dark tunnel of transition, practice shows that reforms in administration are slippery ground and Achilles fifth of many ruling nomenclature, which, unfortunately, not manifested(s) consistent political will, a serious willingness and capacity for an essential and rational transformation of the administration. Public administration reform in the conditions of market economy and parliamentary democracy is imperative not only for its survival and prosperity, but also to effectively function as a political and legal system and the economic system. The administration is infiltrated in all spheres of the society, or the reflexes of its activities feel and pulsate in the functioning of law system, as well as economic and political system. Therefore, its reform must be understand and treat it as a necessity, as a prerequisite for reviving the objectives of the purposes of the state of law, not as a fad, because without modern administration can not be modern state. Seen through a comparative perspective, it can be concluded that in the administrative and legal theory and in the practice as well, are differentiated two systems of selection: spoils system and political recruiting of meritocracy system. The core of the first system lays in the political patronage and sponsorship, while the core of the other lays in the professional skills and competences. These two dichotomous concepts come to the fore and the creation of personnel policy within the security institutions. In countries with groggy and insufficient security forces, who are still wandering through the labyrinths of obscure transitional tunnel and the democratic political system is in a rudimentary stage of development, and values and morals are twisted and folded at the bottom of the social pyramid and where the virus has devastating epidemic politicization effect, there are still present symptoms of decadent spoils system in all aspects of the security system. In contrast, in crystallized state law works with functional institutional structures, the merit system is built as a major substrate in the security architecture. They are constituted by the real values and professional standards where in the mindset of staff, permanently circulate the sense in order to meet the public interest. The spoils system cause atrophy of the vital organs of the security body, but also generates decadence of the overall security infrastructure. The multidimensional and far- reaching adverse implications which are produced by the spoils system, in order to work effectively have need of consistent political will and mobilizing mass action in which the participants would be all relevant stakeholders. Also it is required a wide range of systematic, institutional, complementary and interdependent measures, instead of empty declarative floccules coiffed demagogic statements. In my article the accent is put on the commitment to unconditional and urgent depolitization, as condition sine qua non for creating efficient and effective security apparatus. So the intention is installation of the meritocracy values in the cells of security system without any compromise. The security services need real professionals, people who will feel the spirit and the rhythm of these services, people who will know well the complex of their issues and will have the capacity of independent and creative thinking. Only the officers with this background will have the potential to cope with the many social-security risks, challenges and temptations. Spoils system has symptoms of a kind of sinister ,,malignant disease" which progressively and virulently metastasizes throughout the state organism, causing paralysis of his vital organs. Given the fact that spoils system generates social anomia and decadence of the state - administrative constitution and infrastructure as well, in the paper ripples the uncompromising commitment to urgent installing of valuable meritocracy system in all cells of the state organism. In fact, meritocracy should be,,universal panacea" for resuscitation of the groggy administrative systems in dysfunctional states and for their transformation into functional civil service apparatus. One of the essential directions of the administrative reform constitutes a strategy of a new system of public management (New Public Management). As a kind of initial burst to establish the contours of the new management approach in the public sector in the 80s and 90s of last century, was an inadequacy and inefficiency, above all, of the traditional model of administration. The basic purpose of this management is to encourage the public sector to function as it functions the private sector. Most of the contemporary authors, new public management define as a combination of so-called disaggregation (wherein the large bureaucracies are shattered and broken down in several smaller fragmented parts), followed by competitiveness (among various public organizations, including public organizations and private companies and between public organizations and non-profit organizations) and motivation of employees. Established in this way, the new public management is the dominant paradigm in the United Kingdom, the United States, New Zealand, Australia and EU countries in the period from the 80s of the last century until today. The model of new public management focus on generating efficiency, effectiveness and economy of the administrative authorities, instruments and programs and delivery of services with higher quality. While the less attention is paid to the compliance of prescribed formal processes, rules and procedures. With the establishment and development of the doctrine of "new public management" is plotting a process of release of the state from functions not intrinsic and plead to introduce elements of business management in the organization and functioning of the public sector. The transfer of the important activities of the private sector, de-monopolization and implementation of entrepreneurial mechanisms of government, it comes to a change in the concept of welfare state. While the modern welfare state is transformed into a coordinator of public policies that are supposed to ensure fairness in servicing customer service through competition and regulation and streamlining of various processes. The principle of service orientation should be incorporated in the physiognomy of the security institutions as an essential ingredient, but also as the primary standard in the mindset and professional portfolio of security personnel. In the article are detected the basic attributes that constitute the identity of the substrate orientation service in terms of a law and social consideration. In addition the stress is put on the importance of this fundamental principle which is based as a substantial element in contemporary European security architecture. Service placement should be the main guide and roadmap in functioning, in other words the social welfare and security should be established as a statutory regulations for their work. Service orientation is most relevant barometer for the level of democracy, security, tranquility and comfort of the citizens in the exploitation of the guaranteed rights and the exploitation of social graces. Ultimately, the legitimacy and authority of the security institutions depend on the service orientation because the intention of some developed countries is creating a culture of "qualitative and secure services for the citizens" which is established as an ideology. Service orientation imperatively requires significant cultural change in the actions of the security organizations. Also it requires adequate facilities as catalysts of the change, and time for that change in order to be implanted and realized. The reform process that moves along this trajectory should receive treatment on an ongoing and continuous activity, which will require a serious understanding and receptivity by the employees, who must receive appropriate training, incentive and benefits. Also, in this context should be noted that successful reforms are twofold, that require action "from the top to the bottom" (for instance leadership) and vice versa (improving the performance and employees' agility). Anachronous model of rigid security system which is based on rigid and inflexible rules and procedures must be substituted with model oriented towards results. The main point of this approach is that the security services are above all providers for services or products to their clients or customers. This is the starting point for establishing the contours of the security model of an entity that guarantees quality services and generate effective results. On the other hand it leaves the retrograde concept of security system that only offers services without a clear mission profiled. The care for the efficient and effective provision of security services, which will anticipate and protect the citizen needs, is established as an essential professional and ethical component of modern security services. In this article the emphasis is placed on certain designs and recommendations as well, which should serve as an inspiring paradigm for establishing the contours of professional and valuable crystallized security entity, which will be a service to the citizens and the society as a whole.
