We show that U.S. withdrawal from the Kyoto Protocol can be rationalized under political economy considerations. The reason is that U.S. compliance costs exceed low willingness to pay for dealing with global warming in the U.S. The withdrawal had a crucial impact on the implementation design of the protocol prior to its likely ratification. The remaining non-EU Parties to the Kyoto Protocol gained veto bargaining power &, thus, were successful in asserting far-reaching concessions from the EU on sink credits &, in particular, on the tradability of emission rights. Taking these concessions into account, the Kyoto Protocol was essentially reduced to a symbolic treaty that codifies more or less business-as-usual emissions & makes compliance a rather cheap deal. 11 Tables, 2 Figures, 35 References. Die Autoren diskutieren die Bedeutung, die Gerechtigkeitserwägungen bei der Entstehung von Institutionen wie z.B. dem Kyoto-Protokoll spielen können. Dabei geht es ihnen weniger um die Skizzierung einer dynamischen Theorie des Verhandlungsprozesses als um die Frage, warum rational handelnde Staaten einem derartigen Vertragswerk aus eigenem Interesse zustimmen sollten, bzw. unter welchen Bedingungen mit dieser Zustimmung zu rechnen ist. Unter dem Begriff "Institution" im Kontext internationaler Umweltverhandlungen wird das Endergebnis des jeweiligen Verhandlungsprozesses verstanden, welches im Falle des Kyoto-Protokolls einerseits die nominalen Reduktionsverpflichtungen für Treibhausgase und andererseits die vereinbarten Prozeduren und Instrumente zur Erreichung dieser Ziele umfasst. Nach einem Überblick über den Stand der Klimaverhandlungen und die Rolle von Equity-Kriterien in der klimapolitischen Diskussion werden die Verhandlungspositionen einzelner Staatengruppen dargelegt und die grundlegende Anreizproblematik beim Klimaschutz erläutert. Anschließend werden die Auswirkungen der Equity-Präferenz auf das kooperative bzw. nicht-kooperative Verhalten von Ländern empirisch untersucht. Die Ergebnisse zeigen, dass wichtige beobachtbare Verhandlungspositionen und dadurch induzierte institutionelle Regelungen des Kyoto-Protokolls unter Berücksichtigung von Gerechtigkeitserwägungen erklärt werden können. AbstractIn 2003 the Kyoto Protocol, which imposes legally binding greenhouse gas emission constraints on industrialized countries, is likely to enter into force. The Protocol has been celebrated as a milestone in climate protection, but standard economic theory casts doubt that it will go beyond symbolic policy. In this paper, we show that the final concretion of the Kyoto Protocol is consistent with the theoretical prediction: Kyoto more or less boils down to business‐as‐usual without significant compliance costs to ratifying parties. Si le protocole a été accueilli comme un grand pas en avant dans le combat pour protéger l'environnement, la théorie économique jette un regard sceptique sur la portée réelle d'un tel accord et le considére comme un geste symbolique. Dans ce mémoire, on montre que la concrétisation finale de l'accord de Kyoto s'arrime aux prédictions théoriques : Kyoto n'est rien de plus que « business‐as‐usual » et n'impliquera pas de coûts significatifs pour les parties qui ont signé le protocole.

Ten years after the initial Climate Change Convention from Rio in 1992, the developed world is likely to ratify the Kyoto Protocol which has been celebrated as a milestone in climate protection. Standard economic theory, however, casts doubt that Kyoto will go beyond symbolic policy.
