This book addresses fundamental aspects of the concept of public international law in both theory and practice. The argument developed by the author is that, underlying the traditional, horizontal, structure of public international law, a vertical structure of the concept of law may be discerned. This vertical structure is seen unfolding into two, mutually exclusive, frameworks: a framework of obligation, accounting for obligations, and a framework of authorization, accounting for rights. The problem then arising is that a concept of public international law which only admits either rights or obligations cannot be regarded as coherent. The author, however, takes and substantiates the position that coherence can be achieved by suppressing the mutual exclusivity of both frameworks. This move paves the way to formulating the function of public international law in terms of the constituting of international society.Since in public international law the theoretical aspects profoundly affect practice, this book is not only of interest to academics, but also for practitioners, such as officials of foreign offices and international institutions.

Covid-19 appeared with its quarantine and forced isolation, and psi experts were quick to make their analysis and recommendations. This essay primarily claims that, for the pandemic to offer an opportunity to do things differently, it is necessary to think through a rigorous psychoanalytic critique not only of the psychologization, but also of the digitalization (the translation of the subjective and the intersubjective into the digital sphere) of the covid-19 crisis. The triad of concepts obedience, indignation and uprising give us the opportunity to start this task. Therefore, we will examine the paradoxical relationship between obedience and criticism; then we will make a call for the indignation of imposed dignity; and, finally, we will proclaim that the uprising will not be digitized. Is at this point, of course, that psychoanalytic critique must open up to a political project. ; Vino el virus covid-19, la cuarentena y el aislamiento forzado, y no tardó mucho en que los expertos psi llegaran con sus análisis y sus recomendaciones. Este ensayo principalmente reclama que, para que la pandemia ofrezca una oportunidad de hacer las cosas de otra manera, es necesario pensar una crítica psicoanalítica rigurosa no solo de la psicologización, sino también de la digitalización (la traslación de lo subjetivo y lo intersubjetivo a la esfera digital) de la crisis del covid-19. La tríada de conceptos obediencia, indignación y sublevación propuesta en la convocatoria para este número 21 de la revista nos ofrece una oportunidad de iniciar esta tarea. Por eso, examinaremos la relación paradojal entre obediencia y crítica; luego haremos una llamada a la indignación de la dignidad impuesta; y, finalmente, proclamaremos que la sublevación no será digitalizada. In this paper I question whether the plea for depathologisation and the regaining of our ex-propriated subjectivity from its psy and neuro-colonization is, in fact, not itself enmeshed with the notion of some real core of the human being, and thus amenable to some or an-other Academic discipline and praxis. Critics of mainstream (neuro)psychology could unwit-tingly, then, join the strong but unacknowledged undercurrent in today's neuropsy-discourses to restore the subject as a fully fleshed-out agent; one who is situated beyond pathology, beyond abnormal and normal. I juxtapose this observation with critical readings of an artistic project looking to revalue subjectivity in the aftermath of a mining disaster, and the popular Theory of Mind-approach. In conclusion, I argue that an understanding of the subject as caught between subjectivation and de-subjectivation (where subjectivity be-comes a social and a political issue) could allow us to rethink the terms of normality and pa-thology. ; En este artículo pregunto si el alegato de despatologización y la recuperación de nuestra subjetividad -expropiada por su colonización de las ciencias psi y neuro- está, de hecho, enredado con la noción de algún núcleo real del ser humano, y de esta manera, sensible a alguna otra disciplina o práctica. Las críticas de la (neuro)psicología mainstream pueden, involuntariamente, unirse a los discursos actuales de la neuropsi -no reconocidos y a con-tracorriente- para recuperar el sujeto como un agente completo; un sujeto situado más allá de la patología, más allá de lo normal y anormal. Yuxtapongo esta posición con lectu-ras críticas de un proyecto artístico que busca reevaluar la subjetividad a raíz de un desas-tre minero, y el popular enfoque de la teoría de la mente. En conclusión, sostengo que un entendimiento del sujeto atrapado entre la subjetivación y la desubjetivación (donde la subjetividad se entiende como un asunto político y social) nos permite repensar los térmi-nos de normalidad y patología.
